Zwick------------ It has come to my attention that the current interpretation of legislation pertaining to the Sept 11th Victim Compensation Fund unfairly discriminates against partners of gay victim American citizens of the attack, including, of all people, the surviving partner of who led the "Let's Roll" call aboard Flight 93 in order to divert it from its target (allegedly the US Capitol Bldg in Washington), a fact which was heinously kept from the American public (which only reminds one of the post mortem "amnesia" in the press about the valiant actions of who perished while praying over the bodies of the slain when struck by falling debris at Ground Zero in NYC). Clearly, this Administration (and a noticeably sycophantic press corps, which routinely caters to the Administration's core messages) has consciously made a decision to overlook the heroic acts of these two individuals, both outstanding American citizens, for reasons which can only be ascertained as "politically motivated" (i.e. catering to the threats from the socalled Religious Right Wing of this country, an ignorant group who by and large have no first hand understanding of the cultic legal system of the semi-nomadic Iron Age "Israelite amphyctionies" yet never refrain from quoting bad English translations of ancient unpointed Hebrew Texts they cannot read nor comprehend). The whole scenario reminds the historian of Italy under Mussolini, who denied that gays (uomines omosexuali) even existed in Fascist Italy, a fact which made Michelangelo and Leonardo da Vinci rather "inconvenient", to say the least. Please open up the dialogue on this issue with the President and others appointed to interpret the letter of the appropriate legislation pertaining to this blatant discrimination currently being overlooked in high places in Washington, for whatever reasons (political, religious or politico-religious even). It seems a stretch of logic to extend "benefits" to illegal immigrants who already make "illegal" us of American public services in this country, and not extend the same class of benefits to gay American citizens whose tax dollars are used to finance such operations (among others) which do not in anyway benefit them. I feel it is time that someone in Washington had the intestinal fortitude to voice these objections loud and clear for the American people to hear and decide upon for themselves. Americans generally are fair on such issues when the facts are presented to them without prejudgment. I believe that compensation to victims by government should be even and not based on the individuals finances. I believe that insurance that individuals may have obtained on their own should not be factored in either. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. A structured settlement can assure the financial security of child victims with a benefit schedule designed to satisfy their immediate and future needs, ie. education. We suggest that the plan to settle claims under the September 11 Compensation Fund include a process to immediately segregate claims involving children, with the expectation that such claims can be put on a "fast track" settlement mode. Given a child's date of birth, a settlement offer can quickly be initiated using a generic structured settlement design that includes a college fund and/or lump sum payouts at varying age levels. The structured settlement proposal can easily be adjusted to satisfy other needs as they are assessed. In most instances, a structured settlement can best provide the financial security for all victims of 9/11 that we believe the September 11 Compensation Fund was set up to assure them. And, because structured settlements drive directly at specific claimant needs, these claims can be resolved within a short time span. Tuesday, January 15, 2002 10:51 AM Disappointment with deduction of collateral resources from potential awards Dear Mr.Zwick: I am writing to express my disappointment with the rules outlined for the Federal Victims Compensation Fund, particularly the rules which would deduct collateral resources from any award amount. I was told that the purpose of this fund was to provide victims with an alternative to the long and costly litigation process. After reviewing the rules outlined by Mr. Feinberg, I determined that the fund would clearly not provide ANY financial assistance to my family. By deducting collateral resources from the calculated award, my family would receive NOTHING from the fund. This cannot have been the intention of the authors of the statute. Regarding these collateral deductions Mr. Feinberg stated: ??after we compute economic loss and non-economic loss, that gross number must then result in a deduction for collateral offsets. ?Why? The statute requires it. The statute states that certain -- certain awards, certain compensation, certain benefits to victims must be offset -- such as life insurance or other death-benefit programs.? Feinberg weasels out of this by stating that he is only doing what the statute requires. The answer to his dilemma is simple ? CHANGE THE STATUTE. Legislation like this has never been passed in our country before. It was written in a hurry and everyone agrees there are flaws. It is imperative that the statute be changed now, before great injustices are committed and terrible precedents are set. He refers to private life insurance as a ?death benefit program?, as if it is something sponsored by the federal government. Private life insurance is an individual choice and not something that the government should penalize some for having (while rewarding others for not having it). It is not as if the federal government would be paying these families twice. The amount the families have been compensated by private insurance companies should have no effect on the award from the Federal Victims Compensation Fund. I lost My best friend my lover my life when was killed .We lived together we shared all our expenses, we did everything together . I have documentation to prove we were interdependent on one another. My loved one moved to NY 5 years ago to be with me she left her grown married children she left a world of tragedy behind to be with me. My pain and suffering and economic loss is no different than a married couple or a gay/lesbian couple . Why am I left out? We weren't married yet because felt my daughters were not ready for me to marry. that was 4 and half years ago . We were going to be married this June. If the fund was set up to ease the pain and economic loss of all victims then there should be no exclusion for me. However, the US govt should be expected only to supplement insurance companies and charities assisting the families of victims, not to replace them.
