I am ashamed that my government would see fit to so openly discriminate against Gays and Lesbians, people who were equally devastated by the events of September 11. I rejoice over the new found freedoms of the women of Afghanistan, but wonder how we can call other governments discriminatory when we won't even acknowledge such a large, politically active, community-oriented group in our own country. Is there something that tells you that gays and lesbians grieve less, sacrifice less, or in any way are less affected than other U.S. Citizens by these events? How can you in good conscience say that you will forgive immigration violations to compensate illegal immigrants, yet ignore and marginalize a group of citizens who were legally employed? How can you look into the faces of the loved ones of those who died - people who loved and cared for the victims as much as any spouse - and tell them that they don't count simply because of their sexual orientation? I think the obvious answer is that you decline to look at them at all. For that you should be ashamed, especially to wrap your discrimination in the cloak of warding off lawsuits, an incredibly specious argument and one not worthy of consideration. Not in this country, not in this time. I hope that you will reconsider your actions, take the right and moral step and compensate those who lost loved ones, regardless of their sexual orientation. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. We did not have the good fortune of having other relatives in this country to be at our side during this terrible and tragic time. In response to the request for Victims Compensation Fund, there are several issues I would like to emphasize upon: 1. My husband was a responsible estate planner and planned extremely well in terms of purchasing adequate life insurance and other benefit options that in conjunction with his employer he had managed to build up with years of extremely hard work. This was my husband's life long build up, and being so, it is very unfair that the government subtract whatever funds that my family may have been eligible for from the estate my husband left for his family through his hard work and dedication to his employer and the country. The government should not penalize my family because my husband was a responsible citizen and worked hard to build an adequate estate. 2. There have been many organizations that have been kind and charitable to provide some type of benefit to my son and I. While their charitableness and kindness can never be forgotten, I do feel it is in the best interest of everyone that the government subtracts any benefit my son and I have received from these organizations. 3. The government should understand my personal situation and circumstances. I have become a widow after my 25th anniversary with my husband, and I have been at my husband's side ever since I was married 25 years ago. Again neither one of us had the good fortune of having any relatives within the United States to be with us or at our side, especially at the time of my husband's untimely and tragic death at the World Trade Center. I must support and raise my 12-year-old son who now is fatherless. Whatever estate planning my husband did along with all the benefits provided to my son and I, we will have to make good of it for the remainder of our lives. Our sense of security was taken away from us on September 11, 2001 when my husband died. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Wednesday, November 07, 2001 3:06 PM September 11 Victims Compensation Fund I am a personal injury lawyer in New York City and have volunteered to represent victims before the Special Master without fee. It is hoped that sharing my perspective with you will be of some help in determining whether or not to consider charitable contributions as a "collateral source" to reduce any award to September 11 victims from the U.S. government. As pointed out in the page one article in the New York Times article on November 7, 2001, this is not an easy issue to decide. It is my opinion that charitable contributions should not be used to reduce any award. Doing otherwise will make the task of determining a fair award more difficult. The fund is set up to make an early determination of damages and pay the award quickly. However, how will the Special Master be able to determine how much money any particular victim is likely to get from charity after an award is made? With pension benefits, insurance proceeds and the like, it is a fairly easy and routine task to calculate and determine the value of money that will be paid out in the future. Charitable contributions to the victims are not based upon any contract or legal obligation and by their very nature will be arbitrary and unevenly distributed. For this reason, charity should not be considered a deduction from these awards. Further, I do not believe there is any precedent in routine personal injury litigation establishing charitable contributions as a collateral source. Deducting charitable contributions from Fund awards will also make it far more difficult for the various charities to determine an equitable way to distribute money to the victims. They will be faced with the prospect of distributing much needed money immediately to victims or families knowing that it will reduce the ultimate award from the Fund or delaying distribution of the money in the hope that doing so will ultimately result in a larger amount of money going to the donees. It seems to me that the only disadvantage of my proposal is that it will cost the government more to compensate the victims. Whether the money to victims comes from charity or the government, it ultimately will be paid by the American people. Everyone I have spoken to feels strongly that the people who directly suffered from this attack on our country should be compensated as fully as possible. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The comments I make reference to are those directed at Gay and Lesbian AMERICANS whose partners perished in that terrible, unforgivable act of terrorism on September 11, 2001. During the aforementioned interview, you indicated that surviving partners will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones. Your rationale behind this position seemed to be that you were simply following guidelines set forth by individual states as to how they addressed "domestic partnerships." As I understand it, and please, by all means correct me if I am wrong, surviving family members of ILLEGAL IMMIGRANTS will be fully compensated, but because you have to bow to the will of "state laws," widowed gay partners and their surviving children will not be afforded the same consideration. So let me get this STRAIGHT. (every pun intended) This country, this land that I love, the home of the free and the brave, where all men are created equal, the country to which I pledge my allegiance, gives more consideration to an illegal immigrants surviving family members than it does to the surviving partners and children of gay men and women who perished??
