I am writing to express my outrage and to protest the blatant discrimination against gay Americans which appears to be fundamental to the implementation of the September 11 Victim Compensation Fund. In an appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press," Kenneth Feinberg, the head of the September 11th Victim Compensation Fund (a fund created by Congress and run by the Department of Justice), said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones. At the same time, in reading the details of the fund, I find that even illegal aliens will be receiving benefits under this fund. but "not necessarily" gay-Americans? Apparently, there's even a promise to overlook federal law and NOT arrest and kick out the families of illegal aliens, nor will American companies be punished for hiring illegals in violation of federal labor laws. At the same time, the law is being cited as the justification for discriminating against the loving partners and loved ones of the gay Americans and gay American heroes who died in the tragedy. How hypocritical and unjust! This is hardly the America I spent 20 years of my life defending as a proud member of the United States Navy. I call upon the administrators of the fund to implement in a way that is fair to all of the victims, not just some of them. I applaud the decision to waive law in the case of illegal aliens, but we should also waive the discriminatory laws that would prevent Americans, albeit gay Americans, from receiving the same benefits. Tuesday, December 18, 2001 8:06 PM Your help is needed December 18, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I am writing to you at this time as I am appalled and ashamed that my fellow Americans are becoming greedy over what they feel is due them from other taxpayers of this great nation! I agree with the governments handling of this fund and the disbursements that have been recommended; something that I do not often do. After having viewed some excerpts of a meeting on CNN with Mr. Feinberg and some of the families that suffered a tragic loss on the 11th of September, I could not help but think how very greedy these people are and their eagerness to profit from a loved ones death. I believe in my heart that what is being offered is indeed "the best deal in town" and that they are lucky to get it! When this tragedy occurred, I like many other people went without the luxury of dining out, spending needlessly on items that I did not need but only wanted, in order to send (large) checks to the American Red Cross and a fund to help the families of the firemen & policemen who risked their lives to save others. And now, it pains me to see these very same families greedily reaching out to line their pockets with whatever funds can me made available to them. My parents have crossed over and when they died, both early in their lives, we felt and still feel, very lucky that our family and friends came together to help us to bury them. We did not search out, in vain, in attempts to pilfer any other coffers. When my 19 year old cousin was murdered and we watched the man who killed her walk away due to "insufficient lack of evidence", we went on with our lives. We were angry and frustrated with the system, yes! But, we did not look to sue the government or anyone else for this wrongful crime. Instead, we held our heads high and went on with our lives. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, November 14, 2001 6:15 PM Assistance My husband and I are both residents of Battery Park City and also worked at 2 World Financial Center. Not only were we displaced for our residence, but also displaced for our office. We are residents of Gateway Plaza, the Building luckily and not the Building. We had left for our honeymoon on September 10th in the evening. We arrived in Rome to find out that our office and potentially our home was destroyed. Upon arrival back in the States, we needed to find somewhere to sleep, and the next day buy clothes, masks, gloves etc...just to gain entry into our apartment to assess the damages and see what was left of our home. In those 15 minutes we were allowed we tried to grab clothing and important paperwork related to our lease and apartment insurance. Thankfully we had some. Our windows were left open when we left on the 10th and our apartment suffered large amounts of dust damage. We have had to dispose of our fabric couch, 3 area rugs, a Lay-z-boy chair, lampshades, food and various health items. After my inital visit to my apartment, I had to meet FEMA that Thursday. Upon entry I learned that had initially permitted entry to some type of cleaner without our permission. They had surface cleaned. Their qualifications were also circumspect. FEMA assessed our apartment and initially approved for the payment of all of our things to be cleaned. Numerous residents had things stolen by these cleaners. Upon hearing this I lived in angst every day we weren't allowed to go home wondering what could be missing now. Our insurance company provided us with the name of an EPA cleaner and a special drycleaner who deals with fire and smoke damaged articles. When our insurance company provided an EPA cleanere have had our apartment EPA cleaned to find out that we had one of the worst apartments covered in dust that they had been to in the area. This is AFTER let in people to clean without our permission. We were asked by our Insurance Company if we needed rental assistance for Temporary Housing. We declined because our Firm, had offered us corporate housing for 30 days. Yesterday, November 13th, I received a call from a Partner within the firm asking if we had received any compensation from Fema...of which we were declined any compensation until our Insurance Company declines us. I explained this to the Partner, who then informs me that the Firm (who initially offered Corporate Housing) now wishes their money back. None of this was disclosed before we occupied the corporate apartment. The cost on the rent of that apartment for 30 days was $6,000.00. We were then told that if we cannot get this money from our Insurance Company we were then going to have that $6,000.00 added as INCOME and then would have to pay TAXES on it. We did not ask for this to happen to our home. The least thing I ever wanted to do was to start a new Married Life without a home. Now, I am getting treated worse than those people who attacked us. I understand that many people have lost loved ones. My question is, if we were denied by FEMA, how come this TERRORIST ATTACK is costing my SANITY and My Financial State, My new Married life undue harm----even more than I could have ever assumed? Tuesday, March 19, 2002 6:16 PM Government's 9/11 Fund Exclusions To the Bush Administration and 9/11 Fund Administrator Feinberg: I am disgusted, angered, and disappointed by the recently announced decision to exclude surviving partners of lesbian and gay victims of the 9/11 attacks. That this exclusion is cloaked in an ostensible reliance on state laws is a transparent attempt to deflect responsibiltity by harking to a kind of "state's rights" interpretation - "if they don't recognize 'em, we won't." Mr. Feinberg in a television appearance stressed that with a short life to the fund - 1 1/2 to 2 years - he is not able to follow any path BUT these particular state laws (though the same is not true of other laws and regulations, for example those dealing with immigrants). I would suggest that it is _exactly_ the limited nature of this fund's life and of his mandate that creates a perfect case for NOT discriminating among victims - to determine whose life is, in the case of this fund, literally worth more to the survivors. There can be little rational complaint about "social engineering" or charges of an effort to change state laws when the focus of this fund and its time frame are so limited. In addition, treating the survivors of _all_ victims the same would allow the Bush administration to act upon its rhetoric of U.S. unity and to model equality in the wake of these attacks. Because, make no mistake, I am not suggesting that anyone Mr. Feinberg has already "defined in" be excluded; rather, I want you to treat all survivors the same and bring in those he chose to leave out. How can anyone, in good conscious, provide money for fetuses & illegal aliens but not gay men & women. You call this America, the land of the free? I have to laugh every time I hear people say that attack united us-it did not unite us all-it united those that fit certain criteria & apparently gays are not included. As a member and an American citizen, I support equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. When considering rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed (as well as straight not-quite-married folks) have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. This importantly should include the partners and children of same sex unions. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. When has the government ever before paid compensation to families who lost loved ones in war. Many of them drafted against their will. There are numerous faith based charities and secular charities that are helping these victims. Let the United States so what it does best, let the people and private enterprise do the job. It is not the place of the federal government to think they have to "fix" everything. it is our tax dollars you are spending and we are also giving to charities. I say no federal dollars to victims.
