That's because I am not a traditional broker who is licensed and appointed to sell a one-size-fits-all product: the structured settlement annuity. I work with a full service, fully-integrated brokerage firm with a focus on securities and managed products of all kinds. The major difference in the traditional structured settlement broker and me is that I am a registered rep with the NASD, and - as you would know - regulated by the SEC as a representative of a NYSE member firm. I am fully authorized by my firm, and fully qualified, licensed and appointed to ascertain what product or service is the absolute most suitable for any given recipient of settlement/qualified fund proceeds. Suitability is key, and is based on personal and family situations, previous financial products experience, and myriad intricacies that are only revealed in some sort of interview setting. Why the long-winded prelude to my love for periodic payment and the annuity product? There are certainly survivors who lost the money manager of the house. There are most certainly lost souls who will not have a clue as to how to manage their financial affairs. Periodic payments funded by a structured settlement annuity would most assuredly benefit the overwhelmed, as the internal rate of return is guaranteed, the beneficiary - in most cases - cannot outlive the payments, and the principal is managed by the issuer for the benefit of the payee...a wonderfully mindless way to fund a future. Of course, there will be the financially astute group of recipients that will only need the comfort of their trusted financial advisor to plan their families' futures. Suitability as a strict doctrine of guidance should determine the needs of others, and should the structured settlement annuity product be deemed most suitable, my advocacy is undying. Feinberg, On September 12, 2001, while firefifgters and others in stunned disbelief descended on the World Trade Center, airline executives and their lobbyists descended on Congress in an effort to save their industry. The problem was; an industry already hit by recession was about to go under. Four aircraft were used as weapons of destruction and the airlines were partially to blame. Lawsuits would cripple them. Congress acted quickly. In ten days legislation was passed that would save the airline industry. The Congress, our Senators and Representatives, crafted in the same instrument provisions that would compensate victims and their families and promote tort reform. Tort reform? What has that got to do with anything? Just this. Past damages for negligent behavior set by citizens in courts of law were getting a little high. Some say the damages were downright excessive and that tort reform is long overdue. High insurance premiums based on $2,700,000 per airline victim were impacting the bottom line. Those same citizens who were so imprudent in the past would not be compensating victims here. They were excluded from the process and access to them thwarted. In their place a special master was appointed to administer rules set by Congress that would limit what victims and their families could recover. In addition, offsets were incorporated into the victims' compensation to further control costs. Precedents could be set here that would influence judgements for damages well into the future. Or course, the victims and their families could always sue the airlines. Congress thought of that also and capped what they could recover. And we thought it was about compassion. It's about tort reform and saving the airlines at minimum cost. And never forget that. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am particularly concerned about the fact that the survivors of gay and lesbian heroes (for example: &nbsp who helped bring down flight 91 in Pennsylvania, F.D.N.Y. &nbsp who died in the line of duty when the first tower fell, and &nbsp who was &nbsp of the plane that crashed into the Pentagon, and many more) will be overlooked and under-compensated because "the law is the law and no exceptions can be made?" None of these heroes were discriminating against any of their fellow Americans when they courageously gave their utmost, and ultimately their lives for our country, on this tragic day! How could we, as their fellow Americans disregard, devalue, and "second class" their sacrifice? This would be flat out: Wrong! Their survivors, partners, spouses, life-partners (whatever one would call "them") deserve the same amount of victim compensation as any other citizen of the USA, a fetus, and even an illegal alien (who will be receiving benefits currently). Please don't add serious insult to the monumental injury that the survivors of gay and lesbian Americans are facing by denying them the same compensation and benefits that others are entitled to! My heart is filled with compassion and gratitude toward all the survivors of those who died on 9-11. Let us endeavor to do what is right! Tuesday, March 19, 2002 7:12 PM America's love for our heroes I read an article about the 911 fund not going to gay families who lost their lives on that horrible day trying to save others. I think this is ridiculous these people deserve it just as much as anyone else. The 911 fund was here for the victims families and just because these people are gay you are trying to say they were not victims. I am not gay I have a family and a husband (so I guess if I was the victim you would give me the 911 fund). But my family consists of a lesbian (my sister) I love my sister she will always be my sister and she will always be an AMERICAN. I do not agree with her action but I do not have to live it. On September 11, the very fabric that symbolised the American family was torn with such finality as to eliminate any possibility of mending with "monetary thread." Despite that realization, I understand that the only compensation available to the families of those lost on that horrific day is monetary in nature. Subsequently, the establishment of the "Victims Compensation Fund" (the fund) is logical. However, while the establishment of the fund is logical, I fear that the guiding principals and mechanics of the fund are not. After all, it is commonly stated that "the distance between thought and deed is often far." Having said that, and having reviewed the parameters of the fund, I felt it was imperative to share with you the many reservations associated with the fund's ability to accomplish its single purpose - economic equity for those now painfully suffering from the loss of their loved ones. Below, you will find those reservations. First and foremost, it is imperative that each and every claimant be given the opportunity to share their unique circumstances with the individuals who will be instrumental in determining an award. In doing so, each claimant shoukd be afforded both the opportunity to present evidence through their own personal testimony and enlist the assistance of experts, if desired, in order to provide a clear and concise depiction of their position. Allowing such an opportunity will ensure fairness and onjectivity as each case will be heard separately and awards will be based on the circumstances associated with each case. On a personal note, the ability for an individual to share their pain and suffering is instrumental to the long journey associated with the healing process that every individual must now embark upon. Second, I am alarmed by the fact that the government, who will ultimately pay the awards, will be "appointing" one individual (The Special Master) to determine the "extent of harm to the claimant." the amount of compensation to be awarded based on "the harm to the claimant," "the fact of the claim" and "the individual circumastances of the claimant." While I understand that the "Special Master" will be designating individuals (hearing officers) to hear each case independently, that knowledge does not instill the confidence or peace of mind that I require to participate in the fund. Instead, I would prefer an independent panel, perhaps three(3) to five (5) individuals, who demonstrate expertise in areas such as "human life value," "wrongful death" and "taxation." I believe that these individuals along with a "hearing officer" are more likely to determine an award that is commensurate based on the unique circumstances of each individual. Additionaly, I believe by maintaining a panel of "hearing officers," the decision making process would demonstrate a greater degree of objectivity. Equally alarming is the fact that the determinations made by the "Special Master" and "hearing officers" are "final" and "not subject to judicial review." It is imperative that the option to appeal such a determination be made available to the claimants. Again, fairness and objectivity should be the guiding principals of the fund. In the event an award is not viewed as equitable, an individual should, as in any hearing, maintain their right to appeal a decision. The right to appeal a decision is often a connerstone of legal defenses. If an appeal is available to a criminal, why then should an innocent person not be afforded that same courtesy? Next, the method used to compute "economic loss" is of paramount importance. A "cap" with regard to recovery associated with "economic losses" is simply not acceptable. In fact, we believe an approach such as the one commonly utilized in personal injury cases is most applicable. Pursuant to such a method, the deceased's retirement date should be set to coincide with the date that the decease would have been eligible to recieve full Social Security benefits. Also, the deceased's income should be averaged over the last three (3) years given the fact that "economic losses of many of these individuals are associated with future income streams that wou,d have been highly contingent, variable, or unpredictable." With that in mind, an approch that utilizes an "average income" is obviously the most appropriate method for determining an individuals income. Also, be sure to keep in mind that it is imperative that "income" include wages, bonus", stock options, partnership earnings, etc. Finally, in an effort to fully reflect the earning potential of those lost on September 11th, inflation, historical wage increases, merit and opportunity for advancement must be considered. The final result of such an exercise would represent the individual's "base income." The "base income" could then be multiplied by the number of years that the deceased individual would have worked had he/she been eligible to receive full Soical Security benefits. Furthermore, with regard to reducing the amount if the conpensation by the mount of the "collateral source compensation," Life insurance proceeds (private and/or group) associated with premiums paid by the deceased, should not be considered as a "collateral source." After all, the deceased, in an effort to ensure financial support for his/her family, made a prudent decision to dedicate a portion of his/her after tax income to the financial security. To consider life insurance proceeds associated with premiums paid by the deceased as a "collateral source" would be akin to punishing the deceased for loving & caring enough about his/her family to ensure their financial future in the event of a tragedy were to occur. Also, Social Security benefits should not be considered as a "collateral source." After all, the deceased paid into the system in an effort to ensure "social security." Unfortunately his/her family now represent the members of society that are in need of the very "security" that the system was designed to provide. The deceased was not given a choice of "opting out" of social security system. On the contrary, an individual has no choice but to contribute to the Social Security system. With that in mind, it is obvious that his/her family should not be punished for recieving such benefits. After all, the Social Security system was never intended to be a "needs based" benefit. All individuals, regardless of income and assets, assuming that they secured the appropriate number of "quarters," have always been entited to benefits regardless of the other type of assets/income that they may or may not have. Interestingly, countless millionaires receive Social Security benefits despite the fact that the income is not needed to ensure their financial well being. With this in mind, why should a benefit that plays an instrumental role with regard to a family's financial security be deducted from an award? Next, retirement plans (IRA'S, 401 k, etc.) funded by the actions and sacrifice of the deceased should not be considered as a "collateral source." Again, the deceased, in an effort to ensure financial support for his/her family, made a prudent decision to set aside funds designed to ensure a comfortable retirement. A great deal of legislation (past & present) has been adopted in order to motivate individuals's to plan for their future. Today represents the first step of that financial future. To consider retiremment plans a "collateral source" would again be akin to punishing the deceased for loving and caring enough about his/her family to forgo current enjoyment in order to ensure financial stability in the event of a tragedy. Additionally, A "cap" with regard to recovery associated with "non economic losses" is simply not acceptable. In fact. it is imperative that the assistance of expert in the field of "human life value," be enlisted to determine an appropriate award given the ambiguity associated with valuing the "non economic role" of an individual. After all, the loss of the family unit, enjoyment of life and emotional pain is not easily discemible. However, given that I am both questioning the "fairness" of the fund and taking the position that benefits (life insurance proceeds & social security benefits) associated with payments made by the deceased should not be considered "collateral source compensation." It is understandable that the benefits funded by an employer (i.e. Workers Compo.) may be deducted from an award. After all, the maintaining of "Workers Compensation" is mandatory for employers and the premium associated with such coverage is an expense of the employer. This in turn may make this benefit similar in nature to the employer provided, non-contributory life insurance coverage - the $100,000 received from CNA. With this in mind, it is easy to understand that the "benefit" is employer provided and may be considered a "collateral source compensation." As the compensation plan now stands I do not plan on submitting an application to it. I think the whole concept is unfair. It would appear that I would receive next to nothing for my son's life. Although I have no desire to do so, unless you revise the way you figure compensation I will go with the lawsuit. It appears that you are rewarding people for being irresponsible and selfish. It's made me proud to call myself and American... the way we've banded together across society's lines: skin color, religion, sex... and even sexual preference. Tuesday, January 22, 2002 11:05 AM 9-11 Fund, Distribution Idea To whom it may concern: I submit this comment in response to the protracted discussions over how to distribute the 9-11 fund monies fairly & equitably. First I think one entity should collect and supervise ALL the monies donated to date.This will ensure the donor's intent--to give to the families--is protected and honored. Secondly, as to a distribution plan, here is my idea: Divide the fund in half. Distribute one-half on a per capita basis and distribute the other one-half according to the decedent's " market value." Thus, satisfying the concepts of humanity and capitalism. A person who gave his life in order to spare the destruction of one or more buildings and many lives in Wash. D.C., IS something worth considering and recognizing, whether or not you accept, embrace or despise Gays and Lesbians. And don't even think of using the excuse that "the law is the law" when excluding the partners of Gay men and Lesbians. There are countries in Europe that have laws respecting and recognizing Gays & Lesbians, and their relationships/partnerships that make the U.S. laws and attitude look like something from the Dark Ages. Gays & Lesbians in the U.S. are "in it for the long haul", in case you haven't noticed. Gays and Lesbians are no different from any other group that is "kept down"------the more you suppress them, the more determined and harder they pound away at the inequities. In the end, there will be victory for Gays & Lesbians. IT IS ENEVITABLE.
