As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Gay people were among the most visible heroes of that dark day, so to learn that their partners of up to 30 years are being denied the compensation that the administration is even granting to the families of illegal aliens is a shocking and deeply cynical maneuver by an administration that seems more interested in throwing a bone to its right wing than in protecting the rights of tax-paying gay and lesbian citizens. Why, then, should I not be surprised that many partners of gay and lesbian Americans killed on September 11th will not receive money from this fund? Kenneth Feinberg's comments on this past Sunday's 'Meet the Press' underscore the discrimination gay and lesbian Americans face daily. Does Mr.. Feinberg realize that state's do not recognize gay unions and partnerships? Does he realize that the majority of US cities do not have partnership registration nor recognize gay and lesbian partnerships? Does Mr.. Feinberg care about the partners of gay and lesbian Americans left behind after the tragedy? I can only believe the answers to my questions are a resounding 'no.' Perhaps Mr. Feinberg should realize that United Airlines Flight 93 was (most likely) headed to Washington DC that fateful morning. And, that it was a gay man, , who was one of several passengers that stormed the cockpit and brought the plane down before it could reach our Capitol. Perhaps Mr.. Feinberg should think about that as he discriminates against gay and lesbian Americans. In addition, countless other gay Americans died in New York City and Virginia. Too many to list, but each one as much a hero and tragic victim as the next. Yes, Mr. Feinberg can hide behind laws which are inherently discriminatory. Yes, Mr.. Feinberg may not want to get into a local battle. But, what message is he truly sending? Perhaps this one: that while it is fine to distribute money to illegal aliens, people who have no legal claim to anything in this country, it is perfectly fine to skip a group based solely on their sexual orientation. I am a proud gay American. I am a proud gay American who contributed to the 9-1-1 fund and local firefighter's funds here in New York City. I am gay American who is ashamed of our leaders who continue their campaign of bigotry and discriminatory practices. I hope Mr. Feinberg will rethink his position. Tuesday, March 19, 2002 11:19 AM 9-11 Fund Fairness and Non-Discrimination To 9-11 Fund Administrators; I am a heterosexual white male who works within what used to be the World Trade Center. I am saddened and deeply troubled to learn that gay and lesbian partners of those who perished in the attacks will not automatically receive the same benefits as heterosexual spouses. I am not a "gay activist", but I DO believe in equal protection under the law and basic fairness without prejudice. His new wife of 4 years is 53 and worked at for 28 years with a pension of 1.5 million. I think you need to be careful compensating new wives of a few years. For example in her 4 year marriage, she now receives $220 weekly from Workman's comp for the rest of her life. My children lostlose it at age 23. You need to be careful compensating new wives. They must reduce this by the Social Security benefit the child received as well as the Workers Compensation benefit. In simple terms our children will owe the Government money and for the rest of their lives will slowly learn how the Government of the United States has not protected their parents. Of the 2500 families many work for the government as well. Including my husband. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed.
