I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Prostest 9/11 Fund-Exclusion of Gays from Benefits
Hello my partner   and I believe that gays should have just as much right to spousal and partner benefits that the 9/11 fund offers heterosexual couples. Discrimination of any type is just unacceptable and un-American, domestic partners need to be included in the benefits package.   ,

No compensation for domestic partners?
I am outraged, though sadly not surprised, that the September 11 Fund will not provide compensation to the survivors of gay victims of the terrorist attacks.
What of , a gay man, who was one of the heroes of United flight 93? And what of NY Fire Department , who was gay? What of the untold numbers of gay people who died alongside their straight colleagues in the most horrific event of our nation's recent past? Is the grief and need of their survivors somehow less significant than those of heterosexual victims?
According to the transcript from March 9's Meet the Press, Kenneth Feinberg has indicated that while fetuses and illegal immigrants will be eligible for benefits, domestic partners will not unless their state laws recognize the partnership. He is willing to bend the law for fetuses and illegal immigrants, but not for homosexuals. How petty. How small. How bigoted and how sad.
Patriotism, heroism, sorrow, anger, and need do not discriminate. Apparently the Justice Department does. One more reason to weep for our nation.

Victims of WTC disaster need your help
To Whom It May Concern:
I am writing to say that I recently learned that domestic partners are
not covered by the September 11 Victims Compensation Fund. I think this
is wrong and I ask that you change this policy.
My partner and I have been together for 14 years. We own a home
together. We are a family in every sense of the word. I would hate to
think that if i died in a sudden, unprovoked terrorist attack mitigated
on innocent people that my life partner would not be able to receive the
same benefits that any married person would receive - including non
American citizen illegal aliens. If society allowed gay and lesbian
people to marry most couples would marry, but because of a homophobic
society we have been included from the rights every other American
receives.
The idea that survivors and victims of the terrorist attacks would not
be compensated the same as everyone else in the gravest of hours of
their lives is wrong. I would hate to think that if I died this way my
partner would not only lose me, but she would lose our house and who
knows what else. Would you want this for your children or grandchildren?
Please rethink this discriminatory policy and help ALL Americans who
have suffered in this tragedy that includes all people in domestic
partnerships -- straight and gay.

This letter is in response to the Department of Justices Notice of Inquiry and Advance Notice of Rulemaking (66 Fed. Reg. 55,901 (Nov. 5, 2001)) (the "Notice"), seeking public comment on the development and implementation of a program to provide compensation to victims of the September 11, 2001, terrorist attacks.
Ernst & Young is a leader in providing accounting, assurance, and information technology services around the globe, with 84,000 employees based in 130 countries. Of particular relevance to the Victim Compensation Fund, Ernst & Young performs accounting, internal audit, claims compliance audits, and tax services for several large class action settlement funds across the country.
Our comments are directed to the proposed claims process, eligibility requirements, and compensation determination methodologies.
Claims Process
As outlined in the Notice, the Air Transportation Safety and System Stabilization Act (the "Act") requires the Special Master to make a final determination on any claim within 120 days of its receipt, and, if an award is made, to authorize payment within 20 days thereafter.
To comply with the time frame established in the Act, the Special Master may want to establish a process that expedites claims adjudication, allowing, in certain cases, for claims to be decided on the basis of a paper record (the claim form and other written evidence), without the need for a hearing. If this is the case, claims forms must be designed to provide all of the information that is needed to adjudicate the claim and to determine an award. At the same time, it must be easy for the claimant to understand and follow. To accomplish this, the individuals designing the claims process must coordinate with those designing the forms from day one. It has been our experience that such an integrated approach, in which process and form designers work in tandem, accelerates implementation and avoids potentially confusing, misleading and disjointed claims procedures and forms.
Eligibility Requirements
Given the large sums of money to be disbursed by the federal government as a result of the Act, there exists a high likelihood of individuals claiming awards based on false or fraudulent information. Ones presence at the World Trade Center, the Pentagon, or Shanksville, PA "at the time, or in the immediate aftermath" of the terrorist attacks may be very difficult to prove or disprove.
Additionally, any regulations should clearly define terms such as "physical harm," "at the World Trade Center," and "in the immediate aftermath," to name a few. To deter bad actors, the claims forms should clearly communicate that the Justice Department will prosecute individuals who submit fraudulent claims, and require a statement, signed by the claimant or his representative, stating that all of the information being submitted is factual to the best of his or her belief and knowledge.
Furthermore, provisions should be made, under the supervision of the Special Master, to verify information contained on the forms. Procedures should be designed that are both comprehensive and sensitive to the claimant, and allow for random auditing of claims, with special emphasis placed on exceptionally large awards. Finally, potential claimants should be advised that their forms might be selected for audit.
Nature and Amount of Compensation
Section 405(b) of the Act indicates that the Special Master shall determine the amount of compensation based on "the harm to the claimant, the facts of the claim, and the individual circumstances of the claimant." As the Notice suggests, this will be difficult to accomplish in a detailed, consistent fashion given the potentially large number of claimants and the short 120-day period in which determinations must be made.
We believe that a fair and consistent methodology for determining compensation can be developed using statistical and actuarial techniques. Matrices set up to determine compensation based on the information provided in the claims forms would serve many purposes, including: treating each claimant consistently within the guidelines as determined by the Special Master, reducing the emotional subjectivity that could arise by providing a framework for fairness, and expediting the process in light of the time constraints established by Congress. Several large class action suits have used this methodology very successfully in determining claimant awards. Publication of such matrices would further assist potential claimants in determining whether to apply for compensation from the Fund.
Use of a matrix system for determining compensation would not unduly limit the Special Masters flexibility. Even with such matrices, hearing officers would need to weigh individual factors when making a compensation determination. Moreover, after notifying a claimant of an initial determination, a claimant could request a hearing to present additional information.

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

I believe all survivors of the victims of 9/11 should receive compensation for their loss - yes, this would include the illegal aliens, but it must also include the loved ones of gay and lesbian victims. Most will be able to prove their domestic relationship if this is needed. Many gay and lesbian citizens have honorably served this country in many capacities - and they deserve the same recognition of their loss. Bigotry has no place in this process, as it should not in this land whose freedoms we proclaim, and whose respect for individual rights we trumpet. Please, do the right thing.

comments on the Federal Fund for 9-11 victims
Dear Mr. Ken Zwick:
I lost my brother in the WTC on September 11. He was a young man who was full of promises and dedicated to providing for our parents.
In determining economic loss, the interim rule for the federal Fund states that determination of economic loss requires a prediction about each claimant's future. The rule states that income between 1998 and 2000 will be used to determine this loss. However, if there is evidence that serve as better indicator of lost income, the rules should allow it to be used. In my brother's case, he had a two year employment contract from April 2001 to April 2003 for a minimum compensation that is significantly higher than his average income from 1998 to 2000. It was an indication of his promoted status as a bond broker. Moreover, a large portion of his income was paid in January of the year after he earned his bonus. Therefore, the average income from 1998 to 2000 would not include bonus earned in 2000. As you can see, a strict application of 98-2000 tax returns would mask the evidence of true economic loss for my brother and those like him.
Also, my parents were financially dependent on my brother, but this would not show up in tax returns in 98-2000. My parents relocated to New Jersey from their previous home in the summer of 2001 to be closer to the rest of the immediate family. As evidence would show, he was fully intent on providing for them financially and would have claimed them his dependents in 2001 tax return. Again, we request that this type of circumstances be considered in determining economic loss for my family and other victims' families.

as someone who lost my father in the world trade center along with many
peole that my family knew that worked in the upper floors of 1 world trade
center, i feel that the proposed details and stipulations of the fund are
extremely unfair to many. my mother, brother and I were very
disssapointed when we heard the results. my father was 54 years old, was
planning on working for many more years, he loved his job, had worked
there for about 20 years and was very successful at what he did. he made
much more that the cap of $225,000. i do not see how one can cap
someone's earnings at that rate. then to take out what someone's family
has received in life insurance and donations from the many charities. one
would think that at a time like this, that the government would give some
kind of payback to those people that have been paying the majority of the
taxes over the years. basically as it works out, we would not see any
such beneifts from the fund, we might even end up paying the government
money. if the government could spend all those billions of dollars to
bail out the airlines after the weeks of sept. 11, you would think that it
could assist those people better. i could see if my father had died of
natural causes, but this was an act or terrorism. there should be some
kind of better solution to this fund to make it equitable to those on the
higher end of the scale who have been eliminated from the scale or capped
out at $225,000. some may think that if someone made all that money that
they dont need any more assistance from the fund, but guess what , my mom
has mortgages, she has cars, she pays taxes and she does have normal
expenses like everyone else. they may be proportionately higher, but they
are still expenses. it should be interesting to see what eventually
happens, i know many peole that have lost their spouse, and they are
extremly unhappy. thank you for allowing me to express a small portion of
my opinion.

I want to express my concern about the way the federal government and the various charities
distribute
the funds. I want to bring one case to your attention.
The live-in girlfriend of 6 months,

, obtained an incredible amount of compensation from               and various charities in excess of 100,000. In addition, her exorbitant rent of almost 2,000 per month is being paid by a charity since September 2001. Her parents,

I oppose this kind of distribution because the donated money should only go to family members and children of 9/11 victims. Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Gay Partners Non-Compensation
It is my understanding that in recent interviews, Kenneth Feinberg, the head of the September 11th Victim Compensation Fund (created by Congress and run by the DOJ), said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones.
I am outraged that this discrimination is taking place. This is an insult to the memories of those men and women who were killed, including   who helped bring down the flight in Pennsylvania,   who died in the line of duty when the first tower fell, and   who was   of the plane that crashed into the   . This is also a dishonor to the people whose lives were saved by these brave people, as well as their surviving loved ones.
I urge you to rescind this deeply offensive policy.

I live on Warren Street, just three blocks from the disaster site so the reality of the
tragedy is part of my daily life. I still I am writing in response to the Department's
request for public comments regarding the forthcoming regulations for implementing and
administering the "September 11 Victim Compensation Fund." I strongly urge the Department
to draft regulations that ensure compensation is available to all victims of the attack,
including the committed partners and the non-biological children of gay and lesbian
victims.
It is unquestionable that the devastating grief and economic losses suffered by the
families of gay and lesbian victims are no less than that of other families. Just as the
terrorists drew no lines in choosing their victims, our country must draw no lines in
compensating those who suffered the most personal of losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom left behind loved ones. I
urge the Department to honor these bonds by treating the families of gay and lesbian
victims as you would any other.

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th,
including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to
those
who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to
prove
that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already
announced that they will not discriminate against gay and lesbian families. The Department of Justice
should
do the same.

important
issues.

set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.
