His body has never been found. The decedent left $200,000 in life insurance benefits to the three children, $300,000 in life insurance benefits to his spouse (who is the children's stepmother and does not live with or support the three children), and $340,000 in life insurance to the decedent's sister. The policy paying benefits to the sister had a face amount of $170,000 and a double indemnity provision. These children will be receiving less than 25% of the life insurance benefits left by their father. The children live with their natural mother, and were over 50% dependant on their father's support. A. THE COLLATERAL SOURCE PROVISION SHOULD BE REPEALED Benefits received from collateral sources should not affect the amount awarded to victims under this Act. Victims and their families have suffered and will continue to suffer due to these terrorist acts. Families should not be punished for victims having alternative measures in place, such as life insurance, which they are now entitled to after years of paying premiums. This Fund should be regulated according to the purpose for which it was created, as "an unprecedented expression of compassion on the part of the American people to the victims and their families devastated by the horror and tragedy of September 11." Our country's expression of compassion should not be limited by the compassion of others or various benefits available to families. B. ALTERNATIVELY, THE COLLATERAL SOURCE PROVISION OF THE SEPTEMBER 11TH VICTIM COMPENSATION FUND OF 2001 SHOULD BE AMENDED We are especially concerned to the extent that the Act arguably reduces the amount of compensation to be given to victims based on collateral sources, including life insurance, regardless of whether the victims received the benefit of the insurance that is causing the reduction. We ask that this offset not be applied as an across the board rule. In the situation of the three children, fundamental fairness should not allow their potential recovery to be reduced by $840,000, when $640,000 of that amount will never be available to them. The purpose of this fund was to provide monetary compensation for the loss so many families are suffering due to terrorist attacks. By applying this collateral source provision, it goes against the meaning for which this fund was intended. As it stands, these three children will have their award reduced by "collateral compensation" from which they will never benefit. This type of reduction was not intended by the drafters of Section 405 (b)(6). At very least, benefits should not be reduced based on the total amount of collateral compensation, but rather, reduced by compensation that the individual receives from outside sources. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. Do you realize how far behind the United States is on the issue of recognizing gay relationships? We are supposed to be the country of freedom, justice, and opportunity yet we lag behind countries such as Denmark, Norway, Sweden, Iceland, The Netherlands, France, and Germany who have already passed partnerships laws. Even Finland, Portugal, Switzerland, Luxembourg, Belgium, and Spain are considering passing such laws. What does it say about the land of the free that we still will not recognize the loved ones of gays and lesbians, especially when providing relief for such a tragedy as the deaths on September 11, 2001? Feinberg said that the United States is willing to over look those who have illegally entered our country and those who illegally employeed them, but the our country will not provide relief for its gay and lesbian citizens. I hear that the 9/11 Fund, contrary to what was previously stated, plans to discriminate against the partners of gays and lesbians that died 6 months ago in that horrible tragedy. I think this is terrible! In an appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press," Kenneth Feinberg, the head of the September 11th Victim Compensation Fund, said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones. According to Feinberg, lots and lots of people will receive compensation under the plan, including children, babies, and even fetuses. And as an indication of how generous the fund will be, even illegal aliens, who aren't American citizens and who are in the US in violation of federal law, will receive benefits. Feinberg even says that the Attorney General has promised that if undocumented aliens come forward, they won't be kicked out of the country, and their employers won't be penalized. "The attorney general, in consultation with Immigration, etc., undocumented aliens who come forward, the families will not suffer any consequences. They are covered by this program. They will get a check. The employer, where we need the economic information about the undocumented alien, will not be penalized," Feinberg told "Meet the Press." As is only right! But when it comes to gay Americans who lost a loved one in this national tragedy, suddenly there is an about face: "[Gays and lesbians are] left out of my program to the extent that their own state doesn't include them. I cannot get into a position in this program, which has a one-and-a-half or two-year life start second-guessing what the state of New York or the Commonwealth of Massachusetts or the state of Virginia or New Jersey, how they treat same-sex partners, domestic live-ins, etc. I simply say this: What does your state law say about who is eligible? If your state law makes you eligible, I will honor state law. If it doesn't, I go with the state. Otherwise, , I would find myself getting sued in every state by people claiming that I'm not following how the state distributes money. I can't get into that local battle. I've got to rely on state law." - Kenneth Feinberg on NBC's "Meet the Press," March 10, 2002. That's a long-winded way of saying that if state law discriminates against gay people, then so will Feinberg and the 911 Fund. The problem for gay Americans who lost loved ones on September 11 is that most states do not legally recognize gay relationships, and the very few that do tend to do so only for state employees, not for citizens at large. And while a handful of cities do in fact recognize such relationships, under Feinberg's formula, it's the state's law that counts, not the city's. So, in the end, pretty much everyone who died - including people who aren't even American citizens and were living in the US illegally - will be honored by the September 11th Fund as deserving of America's special recognition and thanks. The sole exception will be gay and lesbian Americans. On this six-month anniversary of the attacks on the World Trade Center and the Pentagon, Kenneth Feinberg and the September 11th Fund are telling the American people that regardless of whether a gay man was one of the four heroes on United Flight 93 who saved the US Congress and the White House from utter annihilation, the 911 Fund plans to discriminate against an American hero because most of the country sanctioned such discrimination prior to September 11. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. It would be ironic if the generosity of so many Americans in giving to the September 11th Fund were used to further divide us as a people, and send the message to all that some American heroes are more equal than others. My children and I have been robbed of a perfect father and husband. There are no words to convey our loss and devastation, only words today to express my strong views on The September 11 Victims Compensation Fund. I am in agreement with all of the points outlined in the letter that will be submitted to you on November 19th by , except for their proposed formula for calculating future compensation (which I have addressed below). I am particularly concerned with the following issues: Collateral Sources: I completely reject to the proposal to deduct life insurance proceeds, pension funds, IRAs, 401K plans or charitable contributions from the payment to my children and me. I am particularly outraged by the deduction of life insurance proceeds. Why would you penalize my family for planning ahead and paying for life insurance? My husband and I took the time to research the available products in order to secure the futures of our children. This was a personal investment that we made with our hard earned money and that we paid for over several years in order to guarantee the security of our family. The proceeds from this life insurance belong to my children and me, separate and apart from the money the government has allocated to assist my family as a result of what happened to my husband. Our purchase of life insurance - which we paid for with our own money - has nothing to do with the events of September 11 and its horrific effect on our lives and our security. Why should we be worse off than others who decided not to plan and pay for their future security? Additionally, the idea that you would deduct money that I have received from charitable organizations to help me pay our bills, memorial expenses, and other critical day-to-day costs is unthinkable. The loss of my husband not only has taken a devastating emotional and physical toll, but it also has caused my family extreme financial duress. This has forced me to plead and grovel for money from numerous so-called "charities." At a time when I have been trying to cope with overwhelming emotional pain, I have been forced to spend countless hours (just as I am spending hours to write this letter) presenting invoices and bills to convince them that my costs were indeed justifiable. The definition of charity in this Country is forever changed, e.g., The Red Cross. Not to mention the fact that my husband worked for under the infamous . Why do we have to fight for help? Under the circumstances, it is your job to take care of us. The United States helps those who are burdened or victimized throughout the world. How about those of us who are tax-paying citizens and have actually paid for the aid you have sent abroad? I already have faced resistance from numerous charities and my husbands employer. Must I now face resistance from my own government, who in my opinion should have immediately stepped in to show these parties the error of their ways? Please do not abandon me and my family or make us jump through more hoops; this has been needlessly difficult every step of the way. Please do what is moral and right and take swift action to make this as easy as possible on us. Economic Losses: I would like to ensure that the retirement age used to calculate economic loss is, at a minimum, the age the federal government already uses for allowing its citizens to collect Social Security benefits. Given the unique circumstances here, I would hope that my government, whose job it is to protect its people, would bend over backwards to ease the pain of those whose suffering is far too great to quantify. Unlike the proposal has presented, I believe the Fund should use my husbands income during the past work year, 2001, to calculate the economic losses my family has sustained. This is the most fair and accurate figure for determining the economic impact that the loss of my husbands income will have on our family. I am certain that, like my husband, most of the victims salaries were at their peak during the work year just preceding the attack. Again, under these horrific circumstances I am looking to my government to be as generous and empathetic as possible. Additionally, please clarify how the government plans to determine what my husbands future income would have been if you do not use my suggested formula. The factors for making this determination must be disclosed before I would be willing to join the Fund or sign a release of claims. Also, the government must disclose the total amount I will be eligible to receive before I sign on with the Fund or release possible legal claims. As is typical with all legal releases, I must have all of the pertinent information about the payment my family is entitled to receive before you can ask me to waive my rights to pursue legal action for the losses my family has suffered. Non-Economic Losses: The Fund is purporting to compensate us for our non-economic losses as well as our economic losses. I am concerned, however, that "non-economic losses" are very vaguely defined. It is unclear to me - and therefore obviously will be unclear to the person who will be assessing the "value" of my claim - whether I will be compensated for the physical and emotional pain that my children and I have suffered as a result of losing my beloved husband. Needless to say, the grief I personally have experienced over the last 2 months is indescribable and beyond my wildest imagination. The pain my kids have and will continue to experience as a result of losing their father is something I cannot even bear to think about. If our government truly wishes to make my family "whole", at least from a financial standpoint, it cannot ignore the heartache and pain my children and I have and will continue to endure as the result of having lost our greatest source of strength, love and stability: my husband. Miscellaneous: Finally, I have some additional concerns with the Fund, which are not addressed in letter. Specifically, it is unclear what expenses I will incur if I decide to make a claim for recovery under the Fund. What will I be responsible for paying, if anything? Are there any other administrative costs associated with making a claim? Before I get involved in what is likely to be a long, drawn out hearing about my claim - which will be very difficult for me at this time in my life - I am entitled to know this. Additionally, it is unclear to me how any payment will be made. This is not clearly described in the plans description and is something we are entitled to know. In closing, I feel that by its inaction my government failed to protect our spouses, fathers, mothers, children, brothers, sisters and friends from this horrific attack on our Country. Although it cannot bring back my husband - or any of the thousands of innocent victims - it can and must assume its undeniable responsibility to take care of those of us whose lives have been irreparably shattered by this evil attack. I currently live &nbsp&nbsp&nbsp&nbsp in Boca Raton. I lost my brother &nbsp&nbsp&nbsp&nbsp and &nbsp&nbsp&nbsp&nbsp on Sept 11th. Both &nbsp&nbsp&nbsp&nbsp and &nbsp&nbsp&nbsp&nbsp worked at &nbsp&nbsp&nbsp&nbsp on the &nbsp&nbsp&nbsp&nbsp floor of Tower 2. &nbsp&nbsp&nbsp&nbsp was 28 years old , unmarried (engaged) with no children. &nbsp&nbsp&nbsp&nbsp was married with 2 children. My concerns regarding the interim final rules are basically two: 1. Knowing what the final award will be prior to official acceptance. If claimant is required to waive their right to pursue legal action it would seem only reasonable that the exact settlement to claimant is verified and agreed to prior to acceptance. This would eliminate the possibility of any misunderstandings. 2. Private insurance premiums paid by the Victims were paid to protect their loved ones financially in the event of death. Their responsible behavior should in no way be offset by this horrific terrorist act. If the concern of the Federal Government is minimizing the use of American dollars then freeze the assets of the 60 countries engaged in or supporting terrorist activities and use those monies to compensate the impact to the treasury. Wrongful death, i.e.. murder, should have no beneficial financial offset flowing to anyone culpable on the back of the murdered victims. Finally, by way of an editorial comment; I sincerely hope that no additional weight is given to the numerous mass e-mailings going to this site on the part of those groups with an obvious political agenda. In fact it is my hope that they be discounted. Specific Objections to the arbitrary interim final rule construction: I am writing to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private fund available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actual suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive nothing from the fund under the interim final regulations. DOJ's formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range of non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent. In a wide variety of air crash and terrorism cases, however, judges, juries, and mediators commonly have provided non-economic damage awards well into the seven-figure range. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable worklife and life-cycle earnings data. DOJ greatly underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. The interim final regulations also arbitrarily cap a victim's income at $231,000 a year. Combined with the faulty methodology described above, the income cap would result in some families receiving compensation for less than 25% of their actual economic losses. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits. We do not believe these are the outcomes Congress intended. Please contact Attorney General John D. Ashcroft and Special Master Kenneth R. Feinberg and tell them of your concern that the interim final regulations fail to conform to the language and intent of the act. With the regulations soon to become final, I believe that only the swift and strong support of Congress can avert unnecessary financial and emotional damage. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Should they not be allowed the same benefits under this Fund BEFORE an illegal alien? Those illegal aliens, if lost loved ones, deserve the compensation just like everyone else. However, I would think an American Citizen, someone who actually lives here LEGALLY, would get a nod and compensation long before someone living here illegally. I sincerely doubt anyone is going to stop and say, "Let's sue because some gay person got benefits and our state doesn't allow that!" Do you know what kind of ill will and basic dislike that person would receive? Not just from gay americans (There's that word again - AMERICANS!!) also from other people who are heterosexual. For someone, to actually attach a lawsuit again someone who suffered through the 9/11 with their loved ones dying, would be horrendous! That person would probably be received as a terrorist in his own country for something like that. All those people died for no reason whatsoever, and they will always be remembered. However, why should some of them be considered lesser of a memorial than others? Surely it would not be of their sexual orientation?
