As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I would add that "all types of families" should include the families of undocumented immigrants. It would be hypocritical to deny help to survivors of people who chopped vegetables and cleaned floors for the better-off documented people whom came to the WTC. They unfairly penalize those who provided for their families by paying premiums for life insurance protection and for savings under 401(k). There is absolutely no incentive for them to opt for the settlement since they receive nothing. Yet under the legislation they are limited in what they can do if they choose to sue. It seems so terribly unfair. In addition, the non-economic compensation is ridiculously low. $250,000 is nowhere near the value of this type of compensation under normal circumstances. It seems if this legislation was designed to protect the airlines from being bankrupted by numerous lawsuits it is sorely off the mark. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. L Zwick, I realize the comment period for Final Rule has ended, and after reviewing the comments posted on the DOJ website, I wish to submit a comment for later consideration. The entire issue of the Government compensating the victims of the horrible 9/11 is clearly WRONG! Everyone feels sincere sympathy for those killed or injured in such a tragedy, but to provide a pay out to their survivors using taxpayers funds is just plain wrong, and without precedent. Many, many millions were given to charities and funds set up for the victims through individual and corporate donations. But the government is not responsible for the terrorists actions, and neither are the airlines, and certainly not the American taxpayers! The victims had the same opportunity to insure against untimely death as the rest of us do. Additionally, after reading many of the submissions posted during the comment period, I am appalled at the greed evident, and at the opportunistic reasoning that subsidies should be given to parents, siblings, homosexual friends of the victims, and even to "undocumented immigrants"(which I read to be illegal aliens) and foreign visitors! It is simply sickening! To think so many donated so much to aid the victims and surviving dependent family! Zwick, Director Office of Management Programs U.S. Department of Justice I strongly encourage you to take a few minutes to assure that the voices of gay, lesbian, and bisexual persons are heard -- and that we remind the U.S.Justice Department officials that justice is only served when all families --and all types of families -- impacted by September 11 are treated with equality. From the brave young gay man who lost his life on the plane attempting to save the lives of innocent people... to the gay priest who lost his life while ministering at Ground Zero... to the many lesbian and gay employees working in the World Trade Center... it is vitally important that our government treat all of our families with dignity and respect and equality. Within our own Metropolitan Community Churches, our lives have forever been touched by the death of , a member of MCC New York, and the horrific loss experienced by her life partner and their teenage son. Our pain is no less. Our loss is no less. And our access to justice and equality in the aftermath of this crisis must be no less. 1. I ask the Justice Department to include among relatives eligible for compensation those who lost their life partners as well as de facto parents or children, without regard to sexual orientation or marital status. 2. I ask the U.S. Government to follow the example already set by New York Governor Pataki in granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and the emotional bonds of family deserves help in this time of need." Tuesday, January 22, 2002 4:01 PM Fund: Thank you for the few moments to respond and voice my opinion on the 9-11 funds that you will have to decide how to spend. I, like all Americans, feel great remorse about the events that happened on 9-11. I ,however, do have concerns about the message that is being sent by compensating victims of the event. I am also concerned that this is setting in motion future problems for this country for which we will not be able to respond. I have watched as numerous people have lined up and said that they should get a large sum of money due to the events of that day. I have also seen others go as far as to put a value on the lives of the victims and suggest that the amount should be based on the amount of income the person was making. This, in itself, says that if you were a cook for a cafe, your life was not worth as much as the executive. I hope that you would ask the family of the cook if they think that is true. I have lived in Oklahoma all of my life and can only relate this to what happened here several years ago at the time of the bombing of the federal building in OKC. After that event which claimed almost 200 victims, Oklahoma received the warmth of the nation. However, not one fund was set up to make the victims' families wealthy. I can only go back to the sayings that I grew up with....(There are no guarantees in life). That said, I think that while the events were as bad as it gets, I hope, it is no worse for the families of the event than it is for the families of the Marines who have died since that time. Death is an event faced daily, and It concerns me that the government is getting into the business of "paying for death"....... Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Your policy limiting those benefits to just those who lived in states where partners are recognized is wrong -- both morally and politically. As you and the Justice Department are well aware, there are very few states recognizing such relationships. Nevertheless, those gay and lesbian heroes as well as those who died simply because they were in the wrong place at the wrong time, died because of terrorists acts, not because of lack of recognition of who they were. They should not be stigmatized in death, simply because they were stigmatized in life. Tuesday, December 04, 2001 3:07 PM Sept. 11 Victim Compensation Fund Dear Mr. Zwick: I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones.
