Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." She was my life partner and the last time she parted from me she never returned. Our wedding was to take place shortly after the tragedy. My loss is the same as the loss that any spouse suffered. We had a very long term loving relationship and had planned to spend the rest of our lives together. States have different laws concerning domestic partners. In fact we both thought that we were in a common law marriage, since our relationship was for over 7 years together. In deciding who can collect from the Victims Compensation Fund, Mr. Feinberg, points to state law on this issue, although state laws vary on this subject. In some states, one can live together for just 6 months and be considered a common law spouse. When discussing other issues at his meetings, Mr Feinberg refers to federal guidelines. Most victims and public officials to which I have spoken to, feel that he should use a more relaxed standard due to the suffering of many fiancees and domestic partners in this tragedy. This fund was established by federal legislation in order to compensate the victims families and loved ones. The Dept of Justice seems to have the power to allow the funds to be distributed as intended......to compensate for the loss of our loved ones who died in that foreign attack against the strongest symbol of our nation. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, January 22, 2002 3:30 PM Victim Compensation Fund I have been watching and listening to the stories that have been presented on the news for the last several months. I am growing concerned about this Victim Compensation Fund. Please don't take me wrong. I believe that the events of September 11th was the most horrific thing that I hope and pray that I will ever see in my lifetime. However, I am continuing to hear stories about the survivors of the victims from September 11th and how they are not be fairly treated....they haven't received any money from the charities or from this fund...when is it coming...and so on... My question/concern is that this money that is going to be given to the survivors/victims of September 11th is EXTRA. Had any of these people been killed in a car accident, drowned boating while on vacation, or any other accident that claims the lives of innocent people everyday, the EXTRA fund/monies would not be given to them. One story that caught my attention was about a widower who had already been given approximately $20,000. She had spent this money in about a month's time. That is more than some people make in a year or even 2 years! Are their bills that astronomical? Was there no insurance? What would have happened if their loved one was killed in an everyday accident? How would they have survived then? Were the families of the Oklahoma City bombing treated in the same manner? Are families that lose everything and/or loved ones in hurricanes or floods or earthquakes treated the same? My thoughts and prayers go out to the many who lost loved ones on September 11th. We have shown since September 11th that we are one of the greatest countries in the world and that we are United. Thursday, March 07, 2002 5:16 PM Re: Victim Compensation Fund (9/11) I feel it is an absolute atrocity the people directly affected by the destruction of the Twin Towers are going to become rich over this tragedy. I feel they, of course, are due SOME compensation, but referencing your own 'Loss Calculation Tables' many of these people are going to become INSTANT millionaires. In my mind this is absolutely unacceptable! This is a terrible precedent to set. I say give the victims families one years wages and the children a fully paid college education. Period!!! Of course, without prejudice, the fallen/injured police and fireman and their immediate families should get MUCH more. I am retired U.S Navy... I, by choice, gave my country the best 20 years of my life. It is no secret that much of what was promised career military in the 50s and 60s has evaporated. In truth, we haven't even been given a decent cost of living raise in the 14 years its been since I retired. And our pensions are not near what our 'government employees' counterparts are. Basically, guess what I am saying is, "Where is our million dollars?' We certainly earned it. Also, giving the victims of 9/11 so much sets up a free for all for future incidents. Are we going to henceforth make all families of tragedies of this type millionaires? What about the families and victims of the Trade Center bombings in 1993? Or the Oklahoma City Bombing? Or the victims of the many tornados, earthquakes, and tornados in our country every year? Or the families of the people killed on our highways everyday? Or the shooting victims families? The list is endless. And the victims of the Twin Towers were not the only ones hurt by the attack. What about all the people laid off from their jobs because of it? Perhaps we should give all them a million dollars also... In summary, giving these people so much is a BAD idea. Let them make it in this world just like the rest of us. We all know this war against terror is going to be lengthy and costly both in money and lives. Our kids (soldiers) are giving THEIR lives for this campaign and their beneficiaries only get $100,000. Tuesday, March 19, 2002 12:12 PM 9/11 Victim Compensation Fund I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. Once again, gays and lesbians are being treated as lesser individuals, no longer equal in the eyes of the law. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family just got a divorce. The hyphens seem not to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now more equal than others. People like , and fought all their lives against prejudice and bigotry as good, honest, and law-abiding Americans who just happen to be gay (one small aspect of their lives). These men, and others like them, gave the ultimate sacrifice of their lives for their country, a country that continues to turn its back on them. Yet we will provide benefits to the families of illegal aliens even if they are here illegally themselves. And this is justice in America. I have been and always will be proud to be an American, however, I am terribly dissapointed and saddened when the phrase "liberty, freedom and justice for all" is still applied selectively. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Saturday, December 29, 2001 9:34 PM Dear Mr. Feinberg, The amount that you assigned for pain and suffering is woefully low. It is causing more pain and suffering. Please understand that my 14 year old son watched the WTC burn while he was in school on 9/11. He knew that his Dad was in the burning building. My 12 year old daughter was told by a classmate, while she was in school on 9/11, that the WTC had been struck by a plane, she was worried sick. I too watched the buildings burn on T.V. and watched as my husband took his last breath. This is not like any other situation in history. Please show your sensitivity to this matter and raise the amounts for pain and suffering for all victims across the board. Raising the award for pain and suffering would go a long way in helping to show the families that America understands what occurred on 9/11 and how much of a scar these events have left on all of us.
