Monday, March 18, 2002 6:30 PM Equal Compensation To Whom It May Concern: I am writing this to express my outrage that gay and lesbian heroes of September 11 are being neglected in regards to compensation for loved ones left behind. Considering how many other "exceptions" are being made (such as with illegal aliens) there is no justifiable reason that the spouses and partners of gays and lesbians killed on September 11 should be overlooked. The fact that we cannot have "legal" marriages in this country yet is not our fault, but rather a problem with the laws which will hopefully be corrected over time. In retrospect, it is now hard to believe that there was ever a time in our country when women and blacks were denied so many rights, including the right to vote! Some day, this kind of discrimination against gays and lesbians should look equally as shocking and unbelievable. Many gay and lesbian couples would have a marriage license if they were able to; don't cut them out just because at this time they can't get one! I have spent the past few weeks researching Title 4 and I have a few comments and questions: First: Why is pension funds listed specifically as a collateral source of income? The only time this would be available would be in the case of the death of the victim, when it would convert to the victims family. Wasn't this money that the decedent had already earned and then saved? How is this a benefit? Is it fair to use this as an offset against the compensation of Title IV? It is my opinion that this would not be fair. Second: Are charitable contributions and grants made by charities going to be listed as collateral sources of income? This too would not make much sense, unless the actual purpose of this plan was only to keep the cost of the potential exposures low. Third: Under the terms of Title IV, anyone applying for this fund would not be able to pursue a lawsuit against anyone else. This would seem to include the following: The security firms that were directly responsible for checking the passengers for weapons The management of the World Trade Center, who did not have an adequate evacuation plan and had told the people in the second tower to go back to their desks despite that the construction of the two towers did not allow for fire stop walls. Some have said that it is standard operating procedure to have people stay in their current locations until removed from the building by rescue workers, usually the fire department, but that only works in buildings that have walls and fire doors to separate areas from one another as per the current code regarding residential high rise buildings. The towers were built in such a way as to allow for the greatest amount of free working area, were office space and were built before the residential codes were in effect. And, despite an anti-terrorism law that is currently on the books written to deal with precisely this situation, the terrorists themselves cannot be sued. The law that was enacted still requires the airlines to place the limits of their liability insurance to the Victims Compensation fund, but none of the 3 groups above are required to place any amount into the fund, but still receive the same if not greater protection under this act. This is also extremely unfair. The monies frozen by the government belonging to terrorist organizations should be entered immediately into this fund, while the other groups involved should also be forced to agree to place into the fund the limits of their insurance in order to have the same basic immunity from litigation. While I understand that the airlines do serve a vital national interest, the same cannot be said for the other groups that should share to some extent the blame for the deaths of thousands. I understand the monumental responsibility with which you are charged, and appreciate the enormity of the task at hand. However, many constituents in my district have expressed grave concern regarding the interim rule that you have issued to administer the Fund. I concur with their trepidation. This letter, then, serves to express the disappointment that my constituents and I feel toward the current administration of the Victim Compensation Fund. More than 50 people in the Eighth Congressional District died in the September 11th attacks. Their family members and loved ones still live with the indescribable suffering and sadness of loss. While we do not pretend that these families can ever be fully compensated, the award for their damages must strive to reflect their pain to the greatest extent possible. The Victims Compensation Fund simply fails at this. The non-economic award of $250,000 is too low. Even without comparing this sum to higher court-awarded damages in recent years, I feel that this figure does not adequately reflect a family's pain and anguish. Furthermore, I am also concerned that the formulaic chart whereby economic damages are determined does not adequately address the full range of potential economic loss a family may experience. It is my hope that families, regardless of their income, will be awarded their actual economic losses. To do this, each claimant must be evaluated on an individual basis for careful consideration of the individual circumstance. Finally, I wholeheartedly believe that compensation awards under the Fund should in no way be reduced by insurance and pension payments. It is wrong that families who purchased life insurance may be penalized. It is imperative that these families are treated fairly. The collateral source rule in the Fund does not do this. Wednesday, January 23, 2002 12:03 AM Sept. 11 Federal Victims' Compensation Fund I don't agree with the granting of federal tax dollars in this case. All of the money that has been collected by various organizations for the victims of the Sept 11 terrorist attacks and their families has not been distributed. The DOJ might be able to help fix the problems with the distribution of what's already been collected, rather than creating another quasi-agency. I'm sorry that, collectively, we so often turn to litigation that Congress saw the need, or was persuaded by interested parties, to pass legislation for the sole purpose of preventing future litigation in the aftermath of such tragic events. Yet, realistically, I can understand the desire to limit future, costly litigation. Maybe the legislators saw this course of action as better management of tax dollars than just waiting for the lawsuits to be filed and paying more later. They and the interests lobbying them are apparently very concerned about future litigation, although I thought this type of event (act of terrorism) would be considered a "force majeure" event. My initial reaction to the news of the federal fund was one of disagreement because all of the money collected for the purpose of helping the victims had not been distributed. Will the tax dollars used as fund distributions be reimbursed by those parties that benefit from fewer future lawsuits stemming from the Sept 11 terrorists attacks? Were federal funds distributed to victims of other previous terrorist attacks on US embassies, US military installations, etc.? Although I would prefer no federal government intervention, except to get the charities to fairly distribute the money they supposedly collected for these victims and families, I think a low-interest federal loan would have been preferrable to an outright grant. Yet, a loan program may not have served the purpose of the federal fund, which was to provide a disincentive for filing future lawsuits.
