Monday, March 11, 2002 12:37 PM Discrimination against gays under the 9/11 fund I am writing to express my shock, sadness and anger over the fact that gay Americans will not be compensated for the loss of their loved ones in the 9/11 attacks at the same level as any other person. This discrimination simply must stop. I am the mother of a gay child, aged 16. He came out to his father and me when he was 14. It came as no shock to us: from the time he was 5 years old, we suspected that our son was gay. It was, and is, clear to me that sexual orientation is something over which a person has no choice, that one is born gay. Our son¹s sexual orientation has made absolutely no difference to us: it is just simply who he is. He is also a great human being ? sensitive, funny, and gifted with an impressive intellect. He has been an honor student throughout his academic career, has received numerous awards, and is at present taking courses at a local college, even though he is still a junior in high school. He has never been in trouble, never smoked a cigarette, never taken drugs. In short, my son is every mother¹s dream. And ? not but, ³And² -- his ³high school sweetheart² is a boy. He is dating a wonderful young man, whom we love dearly. They have attended proms and formals together, they buy each other presents on birthdays and anniversaries, they are a source of joy and comfort to one another. In short, my son is wonderful boy, completely average in some respects and above average in others. The only thing that sets him apart in the universe is that he was born gay. What is it about that which would allow you to discriminate against him, or any other gay person, so cruelly and unjustly? I appreciate the fact that for some people, their religious convictions do not allow them to see my son as ³normal.² But this is America. Our Constitution guarantees us the right to believe as we see fit, to say what we have to say, to be whoever we are, so long as we are not harming other people or violating their rights. The people who flew planes into the Twin Towers and the Pentagon are enemies to those values. They want to make over the world to fit their image of what is the ³right² way to be. By discriminating against gays, you are not only turning your back on the Constitution, you are essentially agreeing with the terrorists by affirming that there is only one right and appropriate way to be. You should be ashamed of yourselves. To say that the fund must follow state rules is the coward¹s way out, since you are merely saying that, if a state discriminates against gays, then you will too. All I can say is, thank God wasn¹t such a coward. Thank God was not such a coward when he bent down to give a dying fire fighter the last rites. If you want to truly remember those heroes, then you will do it by showing a little backbone yourself. You will do the right thing and provide the partners of the gay and lesbian victims of the 9/11 attacks what is due to them as American citizens, heroes, and patriots. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Washington, D.C. 20530 Dear Mr. Zwick: Thank you for the opportunity to submit comments on the Notice of Inquiry and Advanced Notice of Rulemaking for the September 11 th Victim Compensation Fund of 2001 ("the Act"). I offer comments and recommendations in the following three areas. 1. It was not the intent of Congress or the President to preclude those who proceed with claims under the Act from also filing suits against the assets of Osama Bin Ladin, El Queda, the Taliban or any other terrorist individual, organization, or government involved with the events of September 11 th. Such "frozen asset" suits should be specifically excluded from the waiver provisions under the rules implementing the Act. 2. The economic loss amount should not be reduced or offset by amounts received from life insurance proceeds or other benefits or assets owned by the September 11 th victims. 3. The rules should be very clear as to the rights of those who dismiss civil actions within the ninety day period in an effort to file a claim under the Act, but then are subsequently deemed ineligible under the Act or elect not to file a claim. Those individuals should be returned to the "status quo" so that they may, if they so choose, file in another forum. Monday, March 18, 2002 2:51 PM Same-Sex Partner Compensation I am writing to call for the equal treatment of our gay citizens who lost a loved one during the Sept 11th disaster. The Special Master indicated that he would abide by the State's probate statutes in determining who would receive compensation. This is not an equitable way in dealing with those lost who were in same-sex marriages. The State has refused to recognize these marriages, even though in common law, they should be. The fact that a couple is financially interdependent on each other, hold joint property, in some cases raising children, should be plenty of evidence that these citizens had formed the moral equivalency of marriage, and for the purposes of this statute, should be honored. How can you justify that a couple who have been together for YEARS have less of a right to the protections afforded in the fund than a straight couple married for an hour? I urge the federal government to fairly treat ALL of its citizens, and stop pandering to the hate-mongers who want to marginalize our gay citizens. Gay people died on Sept 11th, are fighting in the Armed Forces, and served as fire and police men and women. These people deserve as much as any other CITIZEN of a country. It is time to place this pettiness aside, and do what is right, fair, and equitable. We should not have a second class in this country.
