The article, based on a Meet the Press interview, states the reasoning behind the decision as the need to adhere to individual states' laws governing same sex relationships. I'm very disturbed by the possibility that illegal aliens and their families will be taken care of by the fund with no punitive recourse regarding their illegal status in the US. And companies who hired illegal workers will also not be punished when they come forward to discuss compensation for their workers' families? Can this be true? Federal and state laws will be pushed aside for illegal workers. People who, although precious as human life and undeserving of the tragedy that befell them, were breaking our laws yet will be welcome to reach their hands into the funds coffers while honest tax paying Americans, partners of the people we call heroes who happen to be gay or lesbian, will be considered less important. Congress of the United States House of Representatives Washington, DC 20515-0922 October 9, 2001 The Honorable Dennis Hastert Speaker of the House H-232 The Capitol Washington, D.C. 20510 Dear Mr. Speaker: I am writing as the sponsor of the Structured Settlement Protections Act (H.R. 1514) to strongly urge the enactment of this legislation as soon as possible to protect injured victims and the families of those killed in the September 11 attacks who will be receiving compensation in the form of structured settlements under the September 11th Victim Compensation Fund created by the Air Transportation Safety and System Stabilization Act recently signed into law by the President. Structured settlements have been widely used in the tort area for years to compensate victims of serious, often profoundly disabling or fatal physical injuries and their families. Under a structured settlement, the injured victim (or the surviving family) receives damages in the form of a stream of periodic payments tailored to the specific future medical and basic living needs from a well-capitalized financial institution. Congress has adopted special tax rules to encourage the use of structured settlements to provide long-term financial security to these victims and their families. I understand that the Federal Government through the Justice Department makes substantial use of structured settlements to resolve physical injury and wrongful death claims under the Federal Tort Claims Act and the National Vaccine Injury Compensation Program. Based on this experience, I would expect that the September 11th Victim Compensation Fund also would make substantial use of structured settlements to compensate those injured or killed in the September 11 attacks. I am very concerned that injured victims and surviving families receiving structured settlements as compensation under the September 11th Victim Compensation Fund not fall prey to so-called factoring companies seeking to purchase their future payments. In these "factoring" transactions, factoring companies induce these injured victims or the surviving family to sell off part or all of their future compensation payments for a deeply-discounted cash lump sum, thereby unraveling the structured settlement and the crucial long-term financial security that the settlement provides to the injured victim or the surviving family. My concern here is very real. These factoring companies got their start in buying up lottery annuities, moved on to buying up structured settlement payments and then worker's compensation payments, and most recently VA disability and retirement benefits. Structured settlements under the September 11th Victim Compensation Fund--given the number and size of claims expected under the Fund are sure to be the next target for unregulated factoring transactions. We must act without delay to protect these injured victims and surviving families. My Structured Settlement Protection Act, which is cosponsored by a broad bipartisan majority of the House Ways and Means Committee, would protect these structured settlement recipients form the harms posed by factoring transactions. Under the Act, the States are given the consumer protection role. The Act utilizes the threat of a penalty on the factoring company to discourage factoring companies from purchasing structured settlement payments from victims and surviving families except where the factoring transaction has been reviewed and approved by a State court. The State court review process with respect to a proposed factoring transaction ensures that the structured settlement serves the purpose Congress intended providing long-term financial security for the injured victim or the surviving family while enabling the victim or family to get access to future payments should the court determine that such access is in the best interests of the victim (or family), taking into account the welfare and support of the dependents. In addition to the broad bipartisan cosponsorship totalling 23 Members of the Ways and Means Committee, my legislation has been endorsed by the disability community including the American Association of People with Disabilities, the National Spinal Cord Injury Association, United Cerebral Palsy, Easter Seals, National Foundation of the Blind, National Organization on Disability, the Arc of the United States, and NISH--and has been accepted as the basis of regulation by the National Association of Settlement Purchasers on behalf of the factoring industry. The Treasury Department has been briefed on the legislation and has indicated that it has no objection. Thus, the legislation should be noncontroversial and has been scored by the Joint Tax Committee as being essentially revenue neutral, with a total revenue loss of $5 million over a 10-year period. With the September 11th Victim Compensation Fund preparing to begin operation, it is critical that we put these structured settlement protections into place as quickly as possible, and accordingly I would strongly urge that the provisions of the Structured Settlement Protection Act be included in the tax stimulus package that the House is preparing to adopt. Zwick Department of Justice BY FAX Dear Mr. Zwick: In the immediate aftermath of the tragic attack on the United States on September 11, 2001, Congress enacted the Victims' Compensation Fund of 2001, P.L. 107-42, to compensate the families of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package that bailed out the airline industry and imposed restrictions on the rights of the victims' families to recover damages in court. I implore you, as a public official, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter and the spirit of the legislation which was enacted. Specifically, I request that you act on behalf of the victims' families and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry and their families are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked -- the World Trade Center, the financial capital of the world, the embodiment of financial success. Those who achieved such success should not be penalized because of that success. They personified American business and commerce, democracy and freedom. I ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support it received before the death of the family member. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, without regard to the extent of the actual pain and suffering. This is unacceptable. In the words of Congressman Peter King, "[E]very death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world -- in a scene which will be repeated in the media for decades to come -- is a horror these families will never escape from. The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, I request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by their loved ones. I hope that you seriously consider these requests, as well as the hundreds or thousands like them that you will receive in the next few days. I realize that as a public official, you must seek a balance between the ability of the government to shoulder this heavy economic burden and a just and merciful compensation to the thousands of families and children irreparably affected by this tragedy. However, it is clear that the limits set by the Special Master are much too restrictive and do an injustice to the victims and their families. ("PRLDEF") is a national non-profit civil rights organization founded in 1972. It seeks to ensure the equal protection of the laws and to protect the civil rights of Puerto Ricans and other Latinos through litigation and policy advocacy. As an organization dedicated to advancing and securing the rights of Latinos, PRLDEF is deeply concerned that the Interim Final Rules proposed by the Special Master to implement the September 11th Victim Compensation Fund (the "Fund") may discriminate against minority and female victims of September 11th by the use of race-based and gender- based calculations. We write to let you know that we are immensely troubled by even the suggestion that the government would consider using such discriminatory criteria to determine eligibility for disaster assistance. In addition, we urge you to seriously consider and give great weight to the detailed comments submitted to you on this date by the NOW Legal Defense and Education Fund, Inc. Located just blocks from the tragic events that occurred in New York on September 11th , PRLDEF has been working in a variety of ways to offer support and assistance to those directly affected by these events. In October, PRLDEF began offering translation and support services to the many non-English speaking Latino immigrant claimants seeking assistance at the lower Manhattan disaster relief center. Realizing the need for these services were greater than PRLDEF s small staff could handle, PRLDEF has provided training to close to two hundred volunteer translators who have in turn assisted hundreds of claimants. In addition, PRLDEF is collaborating with other groups who are working with immigrant families affected by the tragedy to ensure that the needs of this population are not overlooked. Through this work we have observed that non-English speaking immigrants are disproportionately denied assistance for what we believe to be discriminatory reasons. Various estimates place the number of Latinos dead or missing at about 1,200 victims and although the exact number may be hard to pinpoint it is clear that Latinos have been deeply impacted by this tragedy. It would be adding insult to injury if Latino families, who are already facing discrimination as they are attempting to have their basic needs met at the family assistance centers, are also discriminated against by the federal government by the use of race-based distribution of funds. A move in this direction is contrary to the letter and spirit of our nation s civil rights laws and would negate decades of advancements that PRLDEF and other civil rights groups have fought hard to achieve. We urge you not to follow this path and to consider other means of determining eligibility that are nondiscriminatory. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. In fact, many of them were cited for their heroic efforts that day in saving other people. It would be wrong for this country to deny their grieving partners and children just compensation from the September 11 fund. Their grief and financial need is no less than that of straight families who also must find a way to cope and move on with life. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
