Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. January 28, 2002 Dear Mr. Feinberg, On September 11th I lost my fiance &nbsp&nbsp&nbsp&nbsp , an employee at &nbsp&nbsp&nbsp&nbsp to the World Trade Center terrorist disaster. We were to be married October 26, 2001. We were in the process of making our wedding arrangements. We had already filed for our wedding license, I had purchased my wedding gown and we had made arrangements for our reception. We were together for 4 years and on September 11th I not only lost my partner, future husband and promises of a family, but financial and emotional support. My loss is compounded by not being recognized by the law as having any kinship to &nbsp&nbsp&nbsp&nbsp and therefore without any legal rights. &nbsp&nbsp&nbsp&nbsp life insurance beneficiary papers have been destroyed in the WTC disaster and all benefits by default are to go to his next-of-kin. My future economic survival is questionable. As a group, fiances and domestic partners have fallen through the cracks of the legal system. At this point, it is unclear if The Victim Compensation Fund will recognize the deceased's intentions and give any recompense for my life being thrown into turmoil. I ask that you grant the same rights as family members and spouses to those of us who suffered from this loss to collect from the Victims Compensation Fund. Monday, November 12, 2001 2:11 PM SEPT 11th VICTIM COMPENSATION FUND OF 2001 TO: DEPARTMENT OF JUSTICE DATE: NOVEMBER 12, 2001 RE: SEPT 11th VICTIM COMPENSATION FUND OF 2001 Enclosed are my comments: Because of the terrorist attack on September 11th, I am, as of this writing, with no end in sight to my homeless situation, still one of the "Battery Park City Displaced" While the majority of us have sustained no personal physical injury, we are suffering psychologically, financially, and emotionally. I usually take the subway every morning at the WTC. That morning, I was late and took a taxi at 8:40AM. I saw the first tower burning in flames minutes after from the West Street. My building is directly opposite what is commonly referred to as "Ground Zero" My apartment did not sustain any damage in the initial collapse of the towers...unacceptable damage occurred in the weeks following the disaster. Until September 20th, more than a week after the disaster, no information was available as to the condition of my apartment, the building or to my estimated time of occupancy. I can understand that during this time, the area was designated a "crime scene" and sealed off. Although I left numerous messages with the management office, no phone calls were returned until the 20th. I indicated to the management that there was to be no access to my apartment without my authorization. I was advised that this was "on the record" and assured that they would adhere to my wishes. On the 25th, I received an anonymous voice mail message at work that gave me a number I could call for more information. The number was perpetually busy. The next day (9/26) I asked a Sgt. , who is a friend of mine, to take a look at my apartment for me. He found my door wide open and the lock removed. There were other apartment doors on that floor in the same state which were being installed with new locks for which the building refused to turn over the new keys. I had to argue with them over the phone to authorize their turning over my keys to a uniformed police officer. I returned to my apartment. I came with a police escort, had exactly 10 minutes to survey the scene and discovered that someone had entered my apartment, made some semblance of cleaning, but basically just moved all my personal possessions. In the 2 days that followed, I had little success in reaching someone to talk with at building management or who would return my e-mails. I did have people assure me that no apartments had been cleaned unless permission had been granted by the tenant. No one could give me an estimated time of occupancy or when I might go to the apartment to retrieve some personal items. At this point, I had alternately stayed at (and moved between) one apartment, 3 different hotels and was wearing a combination of borrowed clothes, new clothes and the clothes I was wearing on September 11th, and eating nearly all my meals in restaurants (not inexpensive in this city). I have had enormous dry-cleaning and laundry bills, food bills, personal care items. I did not gain "official" access to my apartment until October 2nd, and, again, only briefly. I realized that my soft furnishings (mattress, couch, chairs) would be unusable or, at the very least, require expensive and specialized cleaning to remove microscopic asbestos. Even a full month after the disaster, there was no definitive word when we might return. All we were advised was that the apartments would require intensive (and, no doubt, expensive) cleaning of filters and ducts and vents. As of October 31st, I moved out of my apartment. All of my possessions are in storage. I am still living temporarily with a friend. In total, the costs and stress of moving coupled with the health hazards of the area have had a huge effect on my life. And the way the rules read, gays and lesbians will probably get nothing. Forget that &nbsp&nbsp&nbsp&nbsp , a gay man, was one of the heroes who brought United Flight 93 down in a field in Pennsylvania instead of on top of the US Congress, where it was supposedly headed. And forget that &nbsp&nbsp&nbsp&nbsp was gay, as was the &nbsp&nbsp&nbsp&nbsp . No, according to John Ashcroft's Justice Department, apparently some heroes are more equal than others. They are as married as I am in a heterosexual relationship. Six years ago they adopted a child that was abandoned by a drug-addicted white middle class young woman. This child has been raised in love, with two hard working parents. One of her parents conducted tours at the World Trade Center and for some amazing reason was off on September 10th. If she had died, restrictions to your program would have kept the child from receiving compensation for the loss of her parent. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because theoption of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I lost my life partner when she went to work September 11, 2001 in the WTC buildings. I have been crying and grieving everyday since then, the SAME as hundreds and thousands of other "spouses" who have lost their loved ones. We shared our home, shared bills, shared love and many happy times together. We had made a commitment to each other and were indeed "family" to each other. We were first & foremost to each other. I firmly believe domestic partners whether same-sex or not, absolutely MUST be acknowledged and afforded the SAME rights, privileges and priority as would any other 'legal' spouse. Why should a brother or sister who did NOT provide for any type of support either financially or emotionally in addition to those who disapproved of their lost sibling's life-style now find themselves with a potential "windfall" simply because they are "next of kin". I am taking medication just to function normally, my work has suffered due to days missed because its difficult to know that she's gone and now I'm alone so subsequently I am docked pay. There is no amount of money that can give me back the person that I have loved. She was taken from me because of the ignorance and hatred of others. Wednesday, November 07, 2001 5:34 PM rules for victim's fund To be fair, there should be a limit on total aid received. I say this as both a taxpayer and a charitable contributer. Financial resources are finite and the victims eligible for aid are not the only people to suffer from the WTC disaster; unemployment is climbing and the economy is stalling. My opinion is that victims should receive the monies donated to charities first, including the Red Cross, and the government should fill in the gaps. The loved ones lost in the disaster cannot be replaced by dollars. While their families deserve financial assistance, they should not unreasonably profit at the expense of others. Thursday, December 20, 2001 1:07 PM 9/11 relief fund December 20, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
