My husband was a 52 year old employee of for 20 years, and is one of the many employees who is missing at the World Trade Center. Unfortunately, he was on the 101st Floor at the time of the terrorist attack. To say that my two children and I are devastated and are feeling a great loss is to grossly understate our feelings. He was a wonderful husband and a very involved father, and will be greatly missed. As a result of this horrible tragedy, my family is now in a state of great uncertainty. We have not only lost our husband/father but the sole supporter of our household. I am in the midst of seeking financial relief and have tried to keep abreast of all developments relating to governmental programs currently being discussed. The September 11 Victims' Compensation Fund has been one option that I am eagerly awaiting the details. However, there have been many rumors that have not only upset me but have made me feel like my husband has become a victim a second time. I have heard that Congress is working on a formula in order to figure out the compensation a family will get under this Fund. It is my understanding that a victim's annual compensation and age on September 11th will be determining factors in that formula. It is also my understanding that in the formula the amount of years that one is expected to work is also a critical factor. Lastly, it has been suggested to me that Congress is contemplating using an age that will be less than 65 years old as the baseline for one to retire, and that compensation would not be figured for any years past that. I am of the further understanding that the expected workable years will also vary according to the industry (in our case, that being the brokerage industry). To say that the above factors, in my opinion, are grossly unfair and lacking in justice, once again, understates my feelings. I'd like to point out that while my husband did work in the brokerage industry, he remained with one company for 20 years as a credit officer. Notwithstanding the fact that there is a large amount of movement within the industry, my husband clearly was an exception. Furthermore, this would indicate that he would have continued to work in this capacity, in the brokerage industry, until he was at least 65 years old. To make a broad generalization that people in the brokerage industry do not remain in the industry (or with a firm) on a long-term basis would result in a gross injustice and prejudice against those who do not fit the presumed profile. Such a presumption is wrong. My husband was a healthy 52 year old man, who had every intention of working until he was at least 65 years old. Retirement before 65 was simply not an option for him since financially we were not prepared. All savings towards retirement were made by my husband's contributions into a 401K plan. The market, however, has been such that my husband's 401K Plan was adversely affected. For these reasons, we could not have afforded retirement at an early age and, therefore, he would have continued to work as a credit officer until 65 years old or older. I am certain that I am not the only one in this situation. Therefore, since you are now in a position to make decisions that will greatly impact the survival of my family, I ask that you truly represent my family (and, most importantly, my deceased husband) when Congress puts together the final details for the September 11th Victims' Compensation Fund. It is not my desire to take the litigation route, especially since my family is not in a position to wait for the Courts. I have two kids that need to be taken care of and without a fair compensation program I will be unable to adequately provide for them. Since my husband was 52 years old, he had at least another 13 years that he would have had to work. My husband's life was cut short by terrorists. Please do not make him a victim again by cutting short the years that he planned to work. He would never have considered retirement before the age of 65 and I am simply asking that Congress take our situation into consideration when they fine-tune the formula in which they use in determining the compensation that the victims' families receive. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. For 16 years, &nbsp&nbsp&nbsp&nbsp worked for on the 104th floor as an &nbsp&nbsp&nbsp&nbsp, and throughout his career at , achieved titles such as &nbsp&nbsp&nbsp&nbsp, &nbsp&nbsp&nbsp&nbsp, and &nbsp&nbsp&nbsp&nbsp. He was 38 years old and leaves behind myself, our two children, ages 6 and 7 months, his parents and two sisters. We miss him terribly and cannot articulate the pain this has caused us. I am writing with regard to the recently published regulations by Special Master Ken Feinberg on the September 11th Victim Compensation Fund. On behalf of 257 other families who lost loved ones on September 11th, I am writing to say that, not only are we outraged with the regulations, but we feel that these regulations are in direct contradiction to the mandate of the statute which provides for full economic losses to be awarded to all families. We want to make you aware that on December 17th, Ken Feinberg held a special meeting for families at the Mariott Marquis in New York City to explain the statute and its mandate to compensate all victims' families. This meeting was tape recorded by various families. Mr. Feinberg specifically stated several times that there would be "NO CAP" placed on the settlement for each family. He explained to us that awards for economic loss would be based on a combination of our loved ones average income over the last 3 years, plus a projected income to the retirement age of 62. He did also explain that "collateral resources" would be deducted from the settlement. On December 20th, the regulations were published as "Interim Final Rules", meaning that the government is accepting public comment on the regulations until January 20, 2002. Although we have several concerns, our outrage and extreme disappointment is based on our main concern with the regulations as they relate to economic loss. Our concern is the artificial cap Mr. Feinberg imposes on our loved ones earnings. It is now our understanding that Mr. Feinberg has placed a cap on victims who earned over $231,000 per year, Mr. Feinberg will NOT take higher earnings into account. To our astonishment, the Special Master has indeed capped economic loss by limiting the amount of compensation he will consider. Not only did Ken Feinberg lie to hundreds of Center families on December 17th, due as to our understanding that the statute specifically provides that the award must set forth the economic loss based upon the individual harm and circumstances. Mr. Feinberg has also stated since December 17th that with respect to those earning in the top 2 percentile, "multi-million dollar awards out of the public coffer are not necessary to provide them with a strong economic foundation from which to rebuild their lives". This is extremely unfair! There are 258 families at alone who fall into this top 2 percentile. We are disgusted! Our spouses worked hard to achieve their success and earn the money they did. Why should their families be treated differently than any other victims? These 258 victims paid their fair share in taxes-many of them paying hundreds of thousands of dollars a year in taxes! Why should their families' and especially their childrens' lives be diminished and their futures be disrupted any more than they already have been by these tragic events? Obviously, we expect the regulations to be repeated to apply to all families equally. We believe these regulations to be unlawful, and furthermore, the way they are currently written are a betrayal of "trust" that were and our deceased spouses-have placed in our government. Our government is sending billions of dollars in relief and aid to these terrorists' countries, but when it comes to your own taxpaying, hardworking, innocent victims, they are disregarded...all because they achieved the American dream. This makes us sick! We expect you to speak out on our behalf against the caps and limits contained in the regulations and to demand for the modification of the regulations. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. So the bottom line is if your husband paid for life insurance with his own money, and then he put his own money into a 401K, and he had Social Security taken out of his salary but will never receive any benefits (but a child will for one year) then the family is out of luck because after these deductions the compensation plan doesn't give us anything. Maybe if they used his real salary, but we are penalized by the salary cap put on by the "special master" You are also going to determine how much longer he would have worked even though his father is doing the same job at 92 YEARS of age. I'm surprised I don't owe the government money with the way this is being handled. I guess no one is responsible for our loved one's death, not the airlines, or airline security, nor the Port Authority for offering the victims no way out even though they were still alive after the plans hit, or the government for not doing its job or protecting its citizens. Like a lot of red-blooded gay and lesbian Americans, 's life was about his career, his family and his friends. was revered by his fellow firemen, equally by those fallen in 911 and those who survived. And how can we forget 's role in thwarting the terrorist's evil plan to bring down our government? Have the families, lovers, children, spouses (whether recognized by church, synagogue of state) of gay and lesbian 9.11 victims suffered any less than the other victims who happen to be straight or illegal aliens? The answer is assuredly, no. If anything, they have suffered more, because they are not being recognized as "legitimate" family members. Take a moment, regardless of your religious and moral beliefs, to reflect upon those people who are left behind. Those that sit across from an empty chair at the dinner table, those that stare at drawers full of clothes, so little of what is left of their loved ones, and those that sit alone, in the dark, and grapple with the question, why... Let us not continue these prejudices and get on with the business of living our lives. I urge you to reconsider your policy regarding who is eligible for 9.11 victim benefits.
