What does the US provide to the survivors of those who have died in battle? Are the benefits from the proposed September 11th Victims Compensation Fund going to be MORE than what is given to the survivors of armed forces' members who are killed while in service to the country? I am not a veteran, nor are any of my immediate family. I just find it beyond comprehension that the government would allocate tax resources to compensate the Sept 11th victims' families at a higher level than those who have "signed up" and died defending our country. There are veterans groups and other non-profit organizations that address the gap which exists between government services provided and what is ultimately needed. (An argument can be made that some of these "gaps" are still unaddressed. That is a different issue.) Those efforts should continue to be governed by the laws regulating 501(c)3 organizations. September 11th was a horrible horrible thing. I cannot imagine the grief I would feel if one of my loved ones were killed in the towers or on one of the egregiously-used airplanes - or one of the FDNY or NYPD who died in the line of duty. However, we must use good judgment and apply a sense of fairness to the compensation being ascribed to the victims' families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. However, I am particularly close to one of the families that directly lost a loved one who was innocently working at the World Trade Center. Four months later, one of the strongest characteristics of my lost friend that I have committed to memory was his dedication to his family - a wife and two young children who are almost 3 yrs old and 9 months old, respectively. We all have made a vow to honor his memory by helping to see that the plans and dreams that he and his wife had set out for their family continue to come true despite his absence. I appeal to you today to do the same - as an American, and as a decent human being. I find several problematic areas as it relates to the relief aid to families from the Victims Compensation Fund. First, its calculation should be based on up-to-date New York Earnings Tables which accurately reflect the earnings potential of these victims. Second, the cap on compensation and the rights that victims must give up in order to receive this disproportionate award are inconsistent and insulting. Third, collateral offsets, such as life insurance, and pensions... should not be subtracted from the compensation awards to these families. No amount of compensation can bring my friend back to his family. However, I insist that it is my responsibility as his friend and YOURS to make every effort possible to ensure that the intentions that he and his wife shared for their family come close to being met. The more assistance that we can bring to these families, the more we are doing our part to help the surviving spouse to remain focused on seeing their dreams through to reality. In your capacity, I emplore you to modify the terms and conditions for family relief to the vicitims of September 11th. January 15, 2002 Dear Mr. Zwick: Before the Victim's Compensation Fund Rules are made final, I feel compelled to put some of my thoughts, regarding those rules, on paper and send them on to you. I will endeavor to set my thoughts down clearly and concisely. But first I need to tell you that my 28 year-old son, , is among the lost. He was an Equities Trader at and had been employed there for the last 5 years. He had started at the lowest rung of the ladder and by diligence a bright mind and much hard work, had just started to hit his stride in his chosen field. 1. I ask you to please reconsider the amount currently being considered for pain and suffering(Non-Economic Loss). Please realize that many, many people located in offices on floors above the point of impact were alive for at least one hour, and in some cases, even longer, It is very apparent because "911" calls were being received well beyond one hour after impact and almost right up until 1 WTC collapsed. This is a matter of public record contained in the logs of the "911" calls received by the NYC Police Department on September 11, 2001. Portions of those logs were published in the NY Daily News on Sunday, September 30, 2001, as well as in other publications since. Our "trapped" loved ones spent that time fully realizing that they could go neither up nor down to save themselves. They also knew that no one was going to be able to reach them to save them. There are records of phone conversations they made wherein they state the conditions around them-- heavy smoke, sections of floors collapsing around them, difficulty breathing, people falling sick and passing out, etc. They were begging for help. And they were terrified. The hour or more that they lived until 1 WTC collapsed was more than an eternity of "suffering" for them. A mere $250,000 trivializes the agony and minimizes their pain and suffering, 100 times $250,000 would still not be enough to compensate our loved ones for the pain and suffering they endured. We cannot simply "blow off" the enormity and horror of how they suffered. True, there is no amount of money that can equal their pain and suffering . But does that mean that since there is no number that can -2- compensate them for their pain and suffering, that to only give them a minimum number is fair? Does that not minimize the horror they endured? We can not lose sight of the fact that these people were civilians. To be put into this type of danger "on the job" was certainly not on their job descriptions. So please increase the Non-Economic award to reflect the true pain and suffering that our loved ones endured. It was simply unimaginable. 2. Please use the wages earned for 1999, 2000 and an annualized income for 2001(We were already three-quarters of the way into the year so please do not disregard the earnings of that year.) when computing awards for the victims. Many of these victims worked very hard to make huge strides in their salaries from year to year, so please do not demean that ambition and their hard work by totally disregarding 2001's earnings. 3. Please do not average those 3 years when computing the awards. Instead please make note that most of the incomes of employees tended to increase yearly by many more percentage points that the national average of 5.5%-6.0% as noted on statistics produced by the Bureau of Standards. It was common for salaries of young, up and coming Traders and Brokers at to increase by $20,000 to $30,000 and possibly even more per year until a very substantial salary level was reached. Please take into consideration the way salaries rise in the brokerage industry. The salary escalation for a middle management executive in corporate America would differ greatly from the salary escalation of a young up and coming trader or broker in the financial services industry. And lest we forget, they were targeted simply because they worked in the financial services industry. They sacrificed their lives for their country and their country cannot think so little of them as to demean the value of those lives. 4. Please configure your charts to show the typical award for a high wage earner. Please bear in mind that many of the employees (both traders and stock brokers) earned more than your present cap of $231,000. They should not be penalized because they earned salaries higher than 98% of the country. These people worked hard to provide for their families and had they been allowed to live out their lives, in many cases, would have provided very substantially for their families well into the future. Their awards should reflect that. One very important last thought that I must leave you with is that our loved ones worked at jobs that were not in the military of law enforcement fields. They were ordinary, everyday citizens, just like you and me, who went to work every day to put food on their tables and a roof over their heads. They were doing their jobs to the best of their ability in order to provide for their families. And those jobs did -3- not ask them to put their lives on the line. Yet that morning that was exactly what they did. They put their lives on the line, merely by working for a financial services company in the most well-known financial area of one of the greatest cities in the world. They paid the ultimate price for living out the American Dream. Please do not punish them for that. The terrorists have already done that. I'm sorry this letter is so long; and I'm also sorry that I wrote it in plain English. But I just needed to tell you how I felt and to tell you also that your decisions and your tables and charts affect the lives of thousands of people, including many, many children. I will pray that you will be guided by your conscience to be fair to the families of the victims, taking into consideration how they would have provided for these same families had their lives not been cut short by an act of terrorism that totally destroyed much more than two buildings.
