As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. Gays and lesbians are already suffering under the antigay discrimination of our marriage laws. Sent: Thursday, January 24, 2002 9:03 AM Subject: Victim's Compensation Fund Good morning, I have tried to accept the idea that our government has created a compensation fund for families of victims to the 911 tragedy; not that we as a united nation want to take care of our citizens, but that we are compensating the victims far more than we ever did our surviving families of active duty military servicemen. This is something that offends me personally and I am not a combat veteran, I cannot imagine for a second how offended our servicemen who fought day and night for weeks, months, and even years at a time in addition to rescuing and surviving the trauma. $1.6 million dollars is a ridiculous number! I would accept the same as military receive $250,000.00 and no more. The issue of the families arguing no offset is also offensive. Some of the families didn't prepare for any long term situations if any event occurred that was out of their control. Most people plan for this type of situation by obtaining life insurance, etc. Those that didn't are now going to be supported more than an average citizen who had their family member killed by a drunk driver. Those families are forced to go through the red tape and file and wait for the social service program processes to take its course, meanwhile barely survive. This is only slightly different because of the magnitude of the issue of terrorism (new kind of war); but what about the Pearl Harbor Victims?! Did they receive any Department of Justice funds that were relative to the $1.6 million dollars! Not to mention the money that the country has given for donations! I am sure this sets the 1.6 million to a very low bottom line. If you give to the families that fell victim to 911, then YOU MUST GIVE TO THE MILITARY SERVICEMEN'S FAMILIES!!!! I request that a serious look be given to what the Department of Justice has done by offering such a avenue to receive compensation from the government! It is ridiculously unfair and NOT Right! I understand that the rational behind this is to come up with a reasonable compensation figure t o use as a starting point. Using the average of three years would likely iron out any aberrations caused by large increases or decreases in a particular year. I agree with the goal, but I see two major problems its application under the interim rules: 1. In the case of some workers, there have been major promotions and additional job responsibilities taken on that render the earlier years much less applicable. For example, if a young worker was an inexperienced employee in 1998 paid at a salary of say $45,000 per year. Yet, he spends the next three years learning job skills and attaining confidence of his employer and increases in responsibility and compensation and his salary moves to $60,000 in 1999, $80,000 in 2000 and $100,000 in 2001. How is the 1998 compensation figure relevant? Would this person every go back to his state of inexperience during his projected work life? Are the large increases in pay an aberration or does the $100,000 level constitute a base for which future increases will be added? It would seem to me that in a situation like this the 2001 compensation level should be given the most weight, yet under the interim rules it is not even considered. 2. Even if you do (wrongly) decide to use the three years 1998 through 2000 as a starting place, that figure gives a snapshot of an average compensation figure for the victim for mid-year 1999. Since death occurred in September of 2001 this figure should at least receive an adjustment to get it to September 2001. Using your figures this would be one and a half years at 6.6 percent for those under 30, 5.1 percent for those aged 31-50, and 4.2 percent for those over 50. To do otherwise would be to have a starting place that doesn't even reflect keeping up with inflation. Thank you for considering the above. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Unfortunately, NY does not offer the benefit of marriage or Civil Union to Gay and Lesbian partners, as we do here in Vermont, but that does not make the 'union' of these partners, or the lives they shared together any less important. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am writing today to ask you to invest a few minutes in the cause of justice and equality. In the aftermath of the September 11 terrorist attacks, the U.S. Justice Department established the "September 11 Victim Compensation Fund." The purpose of this fund is to provide assistance to persons who were injured as a result of the attacks and to compensate the relatives of those who were killed. I want to remind you, the U.S. Justice Department that justice is only served when all families -- and ALL TYPES OF FAMILIES -- impacted by September 11 are treated with equality. From the brave young gay man who lost his life on the plane attempting to save the lives of innocent people... to the gay priest who lost his life while ministering at Ground Zero... to the many lesbian and gay and transgendered employees working in the World Trade Center... it is vitally important that we demand that our government treat all of our families with dignity and respect and equality.
