Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. First, I would like to say that I laud you for not taking into account specific emotional distress. My husband was on the 96th floor of WTC 1. I was appalled to hear the women who said that she spoke to her husband four times and thus was entitled to more compensation as she had more emotional distress. Perhaps I had more emotional distress as I did not get to say goodbye to my husband. I think it is wise of the government not to entangle itself in these claims. Second, I would like to express what I am dissatisfied with. My husband was very bright and had a huge earning potential. He had been hired at his company only 6 months prior in March of 2001. In December/January, he would have received a significant pay increase amounting to 20-25%. The chart has an approximate 5% per year pay increase in place. Thus, My husbands earning potential was vastly higher than what is computed. The special master should take into account what specific companies policies are for raises and reviews. Zwick DATE: January 15, 2002 After reading and re-reading the Interim Final Rules pertaining to the Victims Compensation Fund, I have spent many nights tossing and turning trying to figure out why the Department of Justice has ignored the fundamental mandate of the Victims Compensation Fund to provide full and fair compensation to victims and their families. All of us who have lost our loved ones in the 9/11 disaster are suffering so immensely, why would the Department of Justice inflict more pain and cause us to worry even more? I am deeply disturbed thinking the following reasons are real possibilities: Money - The Department of Justice will look good if they save the government money. Will this be done at the expense of the 9/11 victims and their families? More Money - Perhaps if the whole package is closed efficiently and effectively many people in your department will benefit monetarily? For example, perhaps certain people will be called for future government issues? Will money be made now or in the future at the expense of the 9/11 victims and their families? Position: Perhaps certain people will gain favor with their superiors ensuring advancement in their own career or ensure political favors in the future? Will political goals be achieved at the expense of the 9/11 victims and their families? Job Description - Perhaps the Department of Justice employs people, who lie well and can listen with deaf ears. Examples: Back in December, Mr. Feinberg told all the people at the meeting that there would be no caps on income-then the interim regulations were published showing caps. Also, I just cannot get the image of Mr. Feinberg out of my head when, at the end of that meeting, he looked one mom straight in the eyes, shook her hand, smiled and nodded. She begged him to remember her five children! Maybe I am off base, maybe I just expect too much. You see, for the last 11 years, I have been married to a man of unbelievable integrity, A man, who believed that his success was based on the work he performed, even if that meant sustaining a loss to make the sale his clients requested. My confident(and very successful) husband knew that nothing was a loss as long as he was fair and consistent. Hopefully, the above reasons(that I keep thinking of why the Department of Justice and the Special Master have set forth such oppressive, unfair and inconsistent regulations) are not true. I guess one way we will find out that they are not true is if the regulations are rewritten to reflect the original intent of the statute. None of the victims asked for the fund. Instead, the airline's lobbied (no later than September 12, 2001) for help and in response Congress capped their liability. Since Congress acknowledged the fact that the airline liability cap severely restricted the victim's right to sue the airlines, the Victims Compensation Fund was created to provide the victims and their families with full payment for a wide range of specified non-economic damages and full restitution for economic damages (e.g., lost future income), minus collateral payments. The intent of the statute allows awards to be based on the actual damages of each individual claimant. The regulations are contrary to the original intent of the statute and these horrific shortcomings need to be addressed. For example: Pre-determined and presumptive awards do not account for individual facts of each claim or actual damages of each claimant. Nowhere does the statute require or suggest that the Department of Justice of the Special Master have the right to impose limits on economic or non-economic losses. Presumptive and arbitrary determination of the value of non-economic losses should be removed. Again, the Act requires that the awards for non-economic losses should be based upon individual circumstances of each claimant. To be successful in obtaining awards above the pre-determined, presumptive guidelines, each claimant must show "extraordinary circumstances" that were not addressed by the presumptive award methodology. Nowhere, does the statute require proof of "extraordinary than any other family's circumstances? In addition, since the Special Master has repeatedly stated that he will not make Solomon- like distinctions between families, how can any family successfully prove that their circumstances are more extraordinary than any other family's circumstances? Hearings should not have a set time limit. I don't understand how the pre-determined hearing limit of two hours was established in light of the requirement to establish "extraordinary circumstances" to justify a higher recovery, I keep thinking that when I go for my hearing, I will be in the middle of explaining my claim and someone will say, "I'm sorry, your time is up, NEXT" It appears that the term, "hearing" should be more than adequately defined in the regulations. Each claimant should be allowed to obtain an advisory opinion as to the valuation of one's claim without the pressure of having to waive any rights upon submission of their claim. A record of hearing should be required. This way, If a claimant feels that the award is inappropriate, they can file an appeal with the Special Master and the Special Master could review the award based on the record of hearing. The regulations need to be more specific regarding the definition of collateral source deductions. If a nation can find $15 billion dollars to bail out the airlines and $40,000,000 to fund the Afghanistan Freedom and Reconstruction Act 2001, It can surely provide the full amount necessary to fairly compensate the families of the innocent victims of September 11, 2001 attacks. If the regulations are not changed to conform to the original intent of the Victims Compensation Fund and the Fund is not implemented in a fair and consistent manner, then, the Department of Justice and the Special Master will not only fail the victims and their families, but the Department of Justice and the Special Master will also have failed Congress! We must assume immediate needs were met with our donations, but the millions of dollars now available through charities should most definitely be taken into consideration when providing crime victim compensation. Our 50 states all provide crime victims compensation and each program uses collateral sources before a claim is paid. We should not be seeking to make wealthy survivors out of terrorist victims. Monday, January 07, 2002 12:03 AM comment I think this is disgusting. How do you put a price on someone's life? This isn't the only place these people should have been receiving compensation. I know for a fact that other countries have been raising money for relief for these victims and their families. Case in point. A school in Manchester, England had a bake sale for the victims and families and what about all the commercials to send money here and there and everywhere to help these families? It is a tragedy that this happened but mothers, fathers and family members die everyday. My father died when I was four years of age. My friends husband left her and two children under 5 when he died. Both were senseless deaths and my mother was left to raise four children on social security and my friend to raise two on social security. There were no scholarships for us or lump sums or fund-raisers and the deaths were no less traumatic on the families. The only difference was my Father died alone on a mountain doing a job and my friends husband died coming home from his job instead of a sensational crime that we all could cash in on. After this tragedy I was proud to say I am a American raised with the value this country was built on that hard work pays off not a handout. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. These terrorists did not discriminate in their heinous attack on our country. They sought to destroy two towers and a Pentagon full of Americans and their allies - people of all races, of all religions and of all sexual preferences. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
