I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Re: Comments on the Department of Justice's Rulemaking Regarding the
September 11th Victim Compensation Fund of 2001
The American Civil Liberties Union respectfully submits the following comments in
response to the Department's November 5, 2001 Notice of Inquiry and Advanced Notice of
Rulemaking Re: the September 11th Victim Compensation Fund of 2001. The ACLU urges the
Attorney General to make the Fund available to same-sex partners of deceased victims. Unless
the Attorney General takes that step, same-sex partners will have no choice but to have the courts
apply the authorizing statute's choice of law rule to order relief under the laws of states that
recognize the right of a same-sex partner to recover for the death of his or her partner.
The purpose of the September 11th Fund is to provide victims of the September 11th
terrorist attacks with the ability to recover relatively quick and certain compensation from the
government in exchange for a waiver of claims they might otherwise have against the airlines or
other entities that may have been negligent or otherwise culpable in the hours, days, or weeks
leading up to the attacks. To encourage the maximum number of potential claimants to elect
compensation through the Fund instead of through the courts, the Fund must be designed to
ensure that all potential claimants who could recover in court could also recover through the
Fund.
One action the Department can take to encourage the maximum number of potential
claimants to elect compensation through the Fund rather than through the courts is to ensure that
the regulations implementing the Fund recognize same-sex partners of decedents or injured
parties as potential beneficiaries of the Fund. Failure to do this could have far-reaching ripple
effects: For every individual who cannot recover for his or her loss through the Fund, at least
one more piece of litigation will likely result in the courts.
Same-Sex partners, if excluded from the scope of the Fund, could pursue litigation based
on the laws of many states, including states whose laws already do or are likely to recognize
same-sex relationships. The Fund's authorizing legislation provides that anyone electing to seek
compensation in court, as opposed to though the Fund, must bring suit in the United States
District Court for the Southern District of New York, See Section 408(b)(3). However, the
legislation also provides that the "substantive law for decision in any such suit shall be derived
from the law, including choice of law principles, of the State in which the crash occurred...."
Section 408(b)(2) (emphasis added).
While the crashes occurred in New York, Pennsylvania, and Virginia, the choice of law
rules of those states could easily result in the application of other states' law to the disputes. For
example, the law of Massachusetts or New Jersey could apply, since the planes took off from
Boston and Newark as well as Dulles. The law of Washington state could apply, since some of
the planes were manufactured and fitted with inadequate cockpit doors. And the law of a
variety of other states, including California, could apply, since machines such as the x-ray
machines used to examine luggage or metal detectors used to screen people prior to boarding the
planes were likely manufactured in many different locales. Thus the law of at least five states,
but most likely that of many more states, may ultimately determine who can sue to recover for
the losses occurring on September 11th. These states include New Jersey, whose law would
allow a same-sex partner to recover for the death of his or her partner, and California, which has
provided the same rights through case law and statute. In addition, if same-sex partners are
excluded from recovery through the Fund, they will have no choice but to pursue what we
believe will be powerful state and federal constitutional attacks on any state laws that would
exclude them from recovery by failing to recognize their committed relationships with the
deceased.
For the foregoing reasons, the ACLU urges the Attorney General to reduce the likelihood
of what could be a new flood of litigation by ensuring that same-sex partners of victims of
September 11th be eligible for recovery through the fund.

I wish that I could say that I am surprised that the decision to exclude same
sex partners from receiving their share of the September eleventh fund.
We have the nerve to ask "why do they hate us so much," and then we go and do
something like this. First our country discriminated against women, then
African Americans, Jews, ect, and now of course it only follows suit that we
continue the trend with homosexuals............... And we (as a country)
claim to be so superior. I think not.
Funny how no one ask me if my "gay money" was good enough to donate. I guess
we should have split off into a separate group to take care of our own. And
we wonder why even our country is so divided...................
I won't happen again. Next time I will be more careful of where my money goes!

In support of equal access to crisis relief benefits

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

will be obtained only when all families and all types of families who have
suffered such unbearable loss on 9/11 are treated with dignity, equality,
respect and admiration for their courage.

Disbursement of Funds
I am writing to support the equal distribution of funds to those families who were not in the conventional marriage or relationship such as a GAY couple (male & female), or those who had lived together. It may mean that some type of documentation would be required to verify that the individuals were a couple. I am assuming that those married partners would also have to show some documentation as to their claim to the money. Dear Mr. Zwick:
We are writing to provide comments on the Air Transportation Safety and System Stabilization Act, (hereinafter, "The Act"). The points that we would like to comment on are twofold.
First, with regard to the consideration of "collateral source" as defined in Section 401 of Title IV, and the associated "collateral compensation" as set forth under Section 405(b)(6), we would comment as follows:
The acts of September 11, 2001 were a very emotional and trying time for every American. We have spent time reviewing some of the heart wrenching comments submitted by the victims surviving family members and they are truly disturbing. However, it is imperative that the underlying rationale for the Act be remembered - - and that is, to ensure that Americas air transportation system will continue to function and be a viable part of the United States economy. For this reason, the only conclusion that should be reached is that charitable contributions that have been either received by, or earmarked for victims families must be treated as a collateral source and any compensation should be reduced by the amount actually received. Collateral charitable contributions should not be ignored in considering plaintiffs compensation from the air carrier under the Act. To not include charitable contributions, in light of these unusual circumstances, would put the airline industry and insurance providers that support the ongoing viability of the airline industry in jeopardy. If victims families are allowed to recover compensatory damages irrespective of charitable donations, then these claimants would essentially be obtaining a windfall while future Americans that loose loved ones would be without recovery because the insurance industry that supports the airlines may not be there for such future claims.
The events of September 11 are horrific and are indelibly etched in every Americans mind. What the victims families have gone through is unthinkable, and it is also difficult to comprehend the tens of thousands of lives that have been forever changed, but this Act must balance what is fair in compensating the victims of this tragedy with ensuring that the airline industry continues to be a vital part of the American way of life, continuing to be there for future Americans. The airline industry will not be able to exist without insurance, and the insurance carriers that will be responsible for bearing the bulk of the loss stemming from September 11th will be stretched to their elastic limits. Consequently, we ask that the charitable contributions received by victims families from the generous outpouring of supportive Americans be included in the victims total compensation under the Act. This will in effect allow these contributions to be used for the greater good of all Americans.
The second element that we would like to comment on regards representation by counsel before the Special Master. Under Section 405(b)(4)(A), the claimant shall have the right to be represented by an attorney and under (B) the right to present evidence including the presentation of witnesses and documents. There is no provision currently noted for the air carrier, as defined under the Act, to be represented by counsel. We would recommend that in the event the claimant chose to be represented by counsel, then the air carrier should have the option of being represented by counsel out of fairness. For those cases where the claimants choose not to be represented by an attorney, then likewise the air carrier should not have the opportunity to be represented by counsel. The intent of this comment is to strike an equitable balance in these proceedings.

To Our Elected Officials:
In the immediate aftermath of the tragic attack of The United States, on
September 11, Congress enacted the Victims' Compensation Fund of 2001
P.L. 107-42, to compensate the relatives of the victims of that brutal
attack. As you know, this Fund was enacted as part of a comprehensive
package which bailed out the airline industry and imposed restrictions
of the rights of the victims' relatives to recover damages from court.
We implore upon you, as our elected officials, to demand changes to the
interim rules issued by Kenneth Feinberg, the Special Master. As it
stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or
the spirit of the legislation, which was enacted.
Specifically, we request that you act on our behalf and demand the
following changes to the interim rules:
1. Remove arbitrary income limits
The arbitrary income limits imposed by the Special Master are not only
unfair but also inconsistent with the letter and the spirit of the law.
Those victims from the financial industry are specifically harmed by
this limit. They were targeted and murdered precisely because of the
jobs they held and where they worked - the World Trade Center, the
Financial capital of the world, the embodiment of financial success.
Those who achieved such success should see that reflected in their
awards. They personified American Business and commerce, democracy and
freedom. We ask that you demand that Mr. Feinberg lift the arbitrary
income limits so that each family can be treated fairly; commensurate
with the support they provided their families before their death.
2. Increase non-economic rewards.
Mr. Feinberg has arbitrarily restricted the non-economic awards for pain
and suffering, no matter what the extent of the pain and suffering.
This is unacceptable. In the words of Congressman Peter King,"...every
death is tragic. A murder is particularly tragic. But to have your
loved one murdered in a burning building in full view of the world - in
a scene which will be repeated in the media for decades to come is a
horror these families will never escape from... The Special Master
cannot take it upon himself to restrict the rights of the families."
Therefore, we request that the interim rules be amended to more
appropriately compensate the victims' families' for the immeasurable
pain and suffering endured by our loved ones. As Mayor Giuliani stated
in his farewell address: "we have an obligation to the people who did
die...Their families need to be protected just as if they had been
alive, financially and every other way that we can help and assist their
families...There should be no compromise about that ever..." We request
that the interim rules be amended and that compensation for pain and
suffering more accurately reflect that horror which was suffered.
Justice demands no less.

Dear Mr. Zwick,
Thank you for considering public input regarding distribution of funds for victims of the terrorist attacks of September 11. I am in agreement with Assembly Woman Margaret M. Markey's comments in her email of Nov. 26 on this matter. My further comments are as follows:
Every soul who lost a loved one on Sept.11 suffered unimaginable loss and grief, regardless of age, citizenship, race, religion, or sexual orientation. Discrimination on the basis of these small differences would only add to everyones' grief and send a message dividing, rather than uniting the people of this country.
The U.S. has invited gay men and women to fight in the "War Against Terrorism". It would be hippocritical and unamerican to discriminate against any of those who have lost loved ones or financial stability.
Therefore, it is imperative to include among relatives eligible for compensation those who lost their life partners or de facto parents or children, regardless of sexual orientation or marital status.

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

partners of the WTC victims

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

I am writing to urge you to ensure fair treatment of all surviving families of the September 11th
tragedy,
including the children and families of gay and lesbian Americans who perished.
That you recognize the sanctity and legitimacy of gay and lesbian relationships and families as
you make
these crucial decisions is imperative. Gay and lesbian families are especially vulnerable when
one partner is killed. Because the option of marriage is largely unavailable, these families often
find themselves in the traumatic predicament of having to prove the legitimacy of their union.
Both the
Red Cross and the State of New York have already announced that they will not discriminate
against
gay and lesbian families. Our United States Department of Justice must follow suit.
As an American, I ask you to keep in mind the gay and lesbian citizens who serve heroically as
police,
firefighters, soldiers, medical personnel and in other critical occupations. We also must keep in
mind
the gay and lesbian citizens who donated to the compensation fund trusting that their gift would
be
distributed without prejudice. It would be unconscionable to dispense their monies while
denying the

want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.

Victim's Compensation Fund
I was just notified by a friend who watched the "Meet the Press" program on Sunday the 10th of March. This is one day before this country was to Honor the Six Month Anniversary of 9/11 when 2,830 human beings gave their life to their country, and Thousands upon Thousands lost a LOVED ONE.
As an American born in this United States who watched the Twin Towers burn and crumble on the morning of 9/11 in absolute horror and grief. Please explain to me how, Kenneth Feinberg, or the Attorney General or Congress, can make a distinction, or imply a marked contrast or suggest some element between individuals or classes, when compensation from the Victim Fund is disbursed.
This was a catastrophe of unknown proportion and I send this note
in disagreement, disbelief and disgust: That not ONE person who LOST a loved one on 9/11/01 at the World Trade Center, the Pentagon, Flight 11, Flight 175, Flight 93;
suffer in a discriminating manner.

Dear Mr. Zwick:
On September 11, 2001, we lost      , age 40, in the attack on the World Trade Center.      was an employee of      attending a meeting oat the      held on the      floor of Tower II.      is survived by his wife,      , age 38, his two daughters,      , age 5, and      , age 3, his parents,      and      ; his siblings,      ,      ,      and      ; and his niece and nephew,      , age 11, and      , age 9. There are no words to describe the intense emotional pain and suffering this has inflicted on us all. We will walk bearing the pain of this tragedy for the rest of our own natural lives.
With this said, we write this letter in protest over the regulations promulgated by Special Master Feinberg under the provisions of the September 11th Victim Compensation Fund of 2001, Title IV, of Public Law 107-42, 115 Stat. 230 (Air Transportation and Safety Act), which was intended to provide full economic and non-economic compensation to the families of those killed on September 11, 2001. These regulations contradict the intent and mandate of the statue by pre-determining the awards and placing arbitrary limits on the awarded amounts. Specifically, the pre-determined cap on earnings; the nominal, pre-determined amount awarded for non-economic loss; and the reduction of the awards by monies received through life insurance, government programs and/or employer benefits are contradictory to the language and intent of the statute and constitute a betrayal of trust placed in our government.
Determining the financial security of the victims' families is not why the statute was passed and should not be the basis of the ensuing regulations. The intent was and should be to compensate the victims' families for the loss of their loved ones regardless of age, race, religion, or socioeconomic status. Capping the award for economic loss at an annual salary of $231,000.00 is discriminatory. Moreover, there is nothing in the statute, which allows for the limitation or capping of earnings. Similarly, to penalize the families by reducing the overall awards by monies received from life insurance, government programs and employer benefits is discriminatory, insensitive and contradictory to the intent of the law.
The non-economic loss cannot be pre-determined by the special Master. The pain, suffering and emotional ramifications affecting      ,      ,     and      extended family run deep and will have an undetermined effect for many years to come. The daily stress and emotional pain that has and will be endured and the resultant effect it will have on the health, well being and quality of life of his family members may be minimal or catastrophic.
To sanction such a nominal award for the loss of a husband and father to two young children and to deduct all collateral source payments is disgusting and insulting. As time marches on and places more distance between the horrific events and the enormity of September 11, 2001, it will become easy for those who have not been directly affected to forget and become complacent. The discrepancy between the original intent and language of the statute passed into law in September and the regulations promulgated in December bear testimony to this. The American people and its elected officials cannot afford to forget and must take care of these families. To forget will leave us vulnerable to future attacks and destroy our way of life and to fail to fairly compensate these families would be to perpetuate the injustice we have suffered.
As American taxpayers, forgetting that we have suffered a tragic loss, we are outraged that our government, the most respected democracy, governing the most powerful country in the world, fails to take care of its own people while continuing to feed, clothe, and perhaps, even to educate the Afghani people. It is time to put Americans first, to take care of our own at home before spending billions overseas. What type of a message is sent to the American people when Americans killed on our own soil, innocent victims of terrorism are not provided for and are even penalized? We cannot buy the goodwill of the people of Afghanistan, but we must provide equally and without bias to the victims' families.
Finally, as information pertaining to the plotted events of September 11, 2001 becomes available, it is clear that the FBI, CIA, FAA and the airlines all bear responsibility in their failure to prevent, detect, and stop the attacks and in their failure to protect the American people. All of these entities had a duty to be vigilant and must be held accountable.
We urge you to do the right thing, to make us proud and to honor those lives that have been lost, to provide for those innocent children who have lost a parent, to compensate each family fairly by removing the salary cap and the reductions from all collateral sources from the proposed regulations.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families
of the tragedy on September 11th, including the children and families of
low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader
earning millions of dollars per year might receive thousands of times as
much compensation as the survivors of a dishwasher in one of the restaurants
destroyed. Justice requires looking far beyond the last paycheck to the
inherent worth of all those killed, so that a high minimum compensation
level is set to lessen the disparities. It would be a double blow to the
survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and
lesbian relationships and families. Gay and lesbian families are especially
vulnerable when one partner is killed. Because the option of marriage is
unavailable, these families may find themselves in the traumatic predicament
of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not
discriminate against gay and lesbian families. The Department of Justice
should do the same.

Sept 11 Federal Compensation Denied to Same Sex Partners of Victims
I am shocked and saddened by the decision to leave
compensation to gay and lesbian partners to the state,
rather than federal, government. What era are we
supposed to be living in?? When will the U.S. drag
itself out of the Dark Ages and stop trying to force a
narrow-minded, unpopular homophobic agenda? I am
disgusted at the cruel and divisive actions of my
government in a time when they should be doing their
job and bringing communities together. This excluding
action will further compound the suffering of people
who have lost those whom they hold most dear. The
authors of this bill should be ashamed of themselves!

I am deeply shocked to discover that Gay-Americans killed on Sept. 11 are being treated any differently than those killed on that tragic day. I think its a disgrace that ANY one group of individuals are being segregated for compensation based on sexual orientation. Is the loss of thier lives ANY LESS insignificant? Evidently so. I thought the Bush Administration would always do the right thing when it came to Sept. 11. I thought the Republican Party was the Party of the "Big Tent." Now it would appear this isn't the case. As a Republican, I'm tired of the Partys' continuing efforts to polorize our country on the issue of Gay America. I won't forget this latest, and sickening, effort in November!
