Thursday, January 10, 2002 9:07 PM Sept. 11 Victims Comp. Fund As part of the Airline Bailout Bill, the above subject fund was created. The purpose of the fund was to equitably compensate the victims' families and deter them from suing the airlines. At a meeting I attended about a week ago the special master of the fund led us to believe that economic loss, plus a 250,000 amount for non-economic loss would be used in the calculation.Economic loss would be annual earnings over a period of the persons working life [to age 62] Our son was 38 and earning approximately 30,000. Assuming he worked until age 62 he would have earned approximately 720,000 before any earnings adjustments for increases, etc. Based on the published tables figures, including 250,000 non-economic loss, we would get approximately 411,000 before any collateral offset.That would make his earnings loss worth 161,000 for 24 years-6400 peryear. That seems to be totally absured and unfair. In addition if he had one dependent child his award would be 594,000 instead of 411,000. The difference in the award should only be the non economic amount of 50,000. Since he did not have a child he is being penalized on his economic earnings. In addition, the total of this award must be reduced by any insurance proceeds. My son had a 50,000 policy provided by his company and 50,000 from workmens compensation. Reducing the award by that amount would net approximately 310,000. Is that amount what a 38 year old persons life is worth ? This award amount is totally inadequate and unfair. In our time of grief when the government is supposed to be helping us reach a quick settlement they are doing nothing but creating more aggrevation. for us. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I just heard this from a source I usually consider very good, but this is hard to believe. Allegedly the justification was that if state law discriminates against gays, the the fund should follow suit. This makes no sense - the fund is not administrated by, funded by, or in any way connected to state government, and should be free to be handled BETTER than the states manage. My daughter in law, , now has monetary pressures and may not be able to finance herself to the level previously shared with my son. As a gay man I can't believe that I am a citizen of lesser importance that any other man, woman, child, fetus or illegal alien yet this is what I am hearing from Mr. Kenneth Feinberg who head the Victim Compensation Fund that was created by our own congress. In an article I just read quoting Mr. Feinberg's remarks to NBC's Meet the Press it clearly states that Mr. Feinberg regards gay and lesbian Americans as something less than others who are not gay or lesbian. I sincerely hope that those of you in a position to revise Mr. Feinberg's concept of humanity and fairness will address this matter with him and his organization. Imagine that donations to the 9/11 Victim Compensation Fund were decreased by 10%. This is the statistical amount that gays and lesbians have donated to this fund. I hope that this matter is quickly addressed fairly and comprehensively. Did Mr Feinberg really appear on national TV and state that both the Attorney General and the 9/11 fund were willing to overlook the status of affected illegal aliens when determining victim compensation yet were not going to extend this leeway to gay victims? How can this possible occur? I have no agenda to advance regarding the status of either an illegal alien or a gay person affected by this tragedy. I am offended that any single human being who lost a life or was injured during the events of September 11 would be denied the compensation that everyone else will receive. If we are not about Freedom and Equality as a result of this horrific act, then we have learned nothing from it. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Thursday, November 08, 2001 8:31 PM New York Times Soliciting public comments First of all nothing will ever replace the loss of a loved one. However, the purpose of the giving public was to make those directly affected, that is the victims' families, financially whole and NOT to enrich them at the expense of the American taxpayer or those making donations. I understand that the law as it now stands clearly requires that fund awards must be reduced by any collateral sources of compensation received by the victims' families. And while the law specifies life insurance and pension benefits as collateral sources it makes no specific mention of charitable funds. I would suggest that it is implied and charitable funds like any other source of benevolent financial assistance that is meant to offset and protect taxpayers and charitable givers from "double dipping" by families, seeking additional reimbursement for expenses or awards already covered, received or to be received in the future. I would also propose that a small commission be established consisting of an odd number of members, no less than five (5) and no more than nine(9), to oversee the fund. Any award would require the approval of the majority of the entire commission and that commission would have the responsibility for interpreting and enforcing the fund's rules and deciding final awards, without any appeal process. Sunday, December 22, 2001 5:27 PM Equal Access for All Victims December 23, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
