This importantly should include the partners and children of same sex unions. Over the years, many people have died in government service, and nothing like this has occurred. It is only that this time, it was so many ordinary people who died, and were not in government service. It could have been anyone in the U. S. ("LDF") is a non-profit corporation established under the law of the State of New York. It was formed to assist black persons in securing their constitutional rights through the prosecution of lawsuits and to provide legal services to those suffering injustice by reason of racial discrimination. LDF's first Director-Counsel was Justice Thurgood Marshall. For six decades, LDF attorneys have represented parties in litigation in federal and state courts, including the seminal case of Brown v. Board of Education, 347 U.S. 483 (1954). We urge you to consider carefully the detailed analysis submitted to you on this date by the NOW Legal Defense and Education Fund but write separately to express our deep concerns regarding published reports that the Special Master of the September 11 Victim Compensation Fund, through implementation of the Interim Final Rules, intends to use life expectancy tables1 that discriminate against minority and female victims of the September 11 terrorist attacks. It is simply incomprehensible to us that an agency of the United States government would sanction the use of race-based and gender-based calculations to disadvantage people of color and women in the determination of compensation to victims. Published reports indicate that the Special Master intends to use the separate "work life expectancy" tables to generated by the Bureau of Labor Standards from 1979-80 data2. By using these tables (and any other race or gender-based tables) the federal government endorses the concept that minority and female victims of the attack, had they lived, would have faced the same discrimination in the workplace and elsewhere as existed in this country during the last fifty years. The 1979-80 data, if it is to be used, will inevitably reflect the effects of racial discrimination in this country. This is utterly at odds with the federal government's commitment to end race and gender discrimination. Use of race and gender-based classifications in this context is also unconstitutional. The federal government has, for the past fifty years, treated the struggle to end invidious discrimination on the basis of race and gender as among its highest priorities. Pursuant to the statutory prohibitions against discrimination contained in the Civil Rights Act of 1964, the United States Supreme Court struck down as unlawful the use of gender-based annuity tables in Los Angeles Dept. of Water and Power v. Manhart, 435 U.S. 702 (1978). The Supreme Court has, only recently concluded that even "benign" classifications designed to remove the effects of this Nation's history of racial discrimination are subject to strict scrutiny. Adarand Constructors v. Pena, 515 U.S. 200 (1995). There is no compelling national interest in calculating the value of an African-American life, or a woman's life, at an amount lower than that of their white or male contemporaries. Race-neutral means for making those calculations exist and should be used. The Constitution requires nothing less. We ask the Special Master to disavow publicly and forcefully the use of race-based and gender-based tables for any purpose connected with the administration of the Fund. The Special Master should also publish a detailed explanation of how award calculations will be made and what data sources will be used. The public should be given an opportunity for comment. The use of race and gender-based tables to calculate compensation to families of victims of the September 11th terrorist attacks will surely be divisive, will lead to litigation and by any measure, will be a serious mistake. I am currently unemployed and have been since early this year. I am a baby-boomer professional and have not been able to find a job with proper compensation for my profession since September 11th. Many people are the unseen victims of this terrorist attack. So, at my expense, some people will now be getting almost a million dollars or more ( not taxable for two years) so they will not have to worry about money. Well, this is absolutely ridiculous ! They should not be given anything! People are killed all of the time for good causes and their families do not receive this. What about other terrorist attacks in the USA or in foreign countries? What about those who have given their lives for their country? Families lose loved ones all of the time. These people do not deserve this money. This money could be well spent in this country taking care of the homeless, the elderly, or given for other causes. I do not blame the people in Oklahoma City for example for being angry about this decision. These people should be given the monies that were raised for this cause - - - no more!!!!! Zwick Department of Justice January 15, 2002 Dear Mr. Zwick In the immediate aftermath of the tragic attack of The United States, on September 11, Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims' relatives to recover damages from court. I implore upon you, as my elected official, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master, As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, I request that you act on my behalf and demand the following changes to the interim rules: 1. Remove arbitrary Income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King, "Every death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape from. The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, I request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by their loved ones. As Mayor Guiliani stated in his farewell address: "We have an obligation to the people who did die. Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families, There should be no compromise about that ever." I request that the interim rules be amended and that compensation for pain and suffering more accurately reflect that horror which was suffered. Justice demands no less. We are grateful for your tireless efforts since September 11 to prosecute terrorists and to ensure our nation's security. As you and other officials defend our freedom, we urge you to continue protecting the family as a source of strength within that freedom. This attention to the integrity of the family is especially important within the September 11th Victim Compensation Fund. Now that a Special Master has been appointed, we would like to express concerns about the administration of the fund. You have expressed confidence that "under [Special Master Kenneth R. Feinberg's] leadership, the program will be administered in a manner that is sensitive and fair to the needs of those who have suffered as a result of the events of September 11th." Our hearts and prayers are with all of the victims of September 11th, including their family, friends and loved ones. We trust that Special Master Feinberg will administer the fund in a manner that is sensitive and fair, and, most importantly, consistent with the laws of the United States. The language of the legislation creating the Victim Compensation fund is unmistakably clear in setting the parameters for who is eligible to receive compensation from this fund: SEC. 403 PURPOSE It is the purpose of this title to provide compensation to any individual (or relatives of a deceased individual) who was physically injured or killed as a result of the terrorist-related aircraft crashes of September 11, 2001. In the United States Code, the term "relative" is usually defined to include parents, children and spouses, sometimes grandparents, but always some variation within blood, marriage, or adoption. Nowhere in federal law does "relative" include "domestic partners," civil unions, roommates, or close personal friends. In fact, the term "domestic partner" is nowhere to be found in the United States Code. Furthermore, the Defense of Marriage Act makes clear that ephemeral state law developments have no bearing on the federal law regarding marriage: Title 1, Chapter 1 § 7. Definition of "marriage" and "spouse" In determining the meaning of any Act of Congress, or of any ruling, regulation, or interpretation of the various administrative bureaus and agencies of the Untied States, the word "marriage" means only a legal union between one man and one woman as husband and wife, and the word "spouse" refers to a person of the opposite sex who is a husband or a wife. To disregard the law and extend compensation to domestic partners opens the door to unending complaints and criticism, from both the relatives and unrelated intimates of the victims. Dilution of the fund by including those who do not qualify as relatives is neither fair nor sensitive to the intended claimants. Whether homosexual or heterosexual, the concept of compensating a "domestic partner" is one that directly undermines the important institutions of marriage and family. As you well know, not every loss is cognizable under the law. The tragic events of September 11 should not be used as a pretext for expanding the gay agenda at the expense of marriage and the family. We support you in your role as Attorney General of the Untied States of America as you seek to uphold the laws and Constitution of this country. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other.
