Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Adding to, or creating another inept/bloated and self-serving government bureaucracy to administer this fund, would be ludicrous. Turn the money over to a non-profit private service group. One with integrity that is in business to serve the public, instead of itself. Like anything government, the Red Cross and United Way have proven themselves unworthy of the public trust. These two large private groups should administer none of the money. It is nice to know that there is a real person on the other end of this note, who cares. I read in USATODAY that congress is likely to pass a bill which allows for a larger estate tax exclusion for the victim's families. We are all VERY grateful for that recognition. In our case there were credit card benefits which were mandated by the insurance company to be paid to the estate of both our parents. This caused us to be exposed to estate taxes. Normally, we would of had the benefits paid to a beneficiary directly avoiding these taxes. However, this estate planning issue was missed in my parents estate planning process. These things are so rare that it was just overlooked. So we are glad that congress is recognizing this. Additionally, You may want to realize that by reducing our benefit under the "Fund" by the amount our parents had in their estate or was received by insurance would only force us to go another direction in compensating our family for the loss we had. Thereby defeating the main role of the fund i.e. creating a system to expediate the legal process and get this whole thing behind our nation. I extend my thoughts to you openly. However, I am tired of hearing them complain about how much or how little money they will be getting. They are getting a gift, a gift that those in Oklahoma City did not get , nor anyone else. Tonight on TV I heard a mother of a victim, who was a grown, independent son, complaining that she would "only" get $250,000. She was not financially dependent on her son for anything. He was only financially responsible for himself. Yet she feels that $250,000 was not enough. I am 53 years old and if I were left a widow I would be happy for any amount of money that was given to me from a fund that I did not contribute to. It is appalling that Kenneth Feinberg would state on Meet the Press that the survivors of gay victims of September 11 would not receive comparable benefits to heterosexual families. The generosity of the public contributions was surely far in excess of anyone's conception. Failure of local and state authorities to devise an organized, equitable means of disbursing donations is lamentable. NO GOV'T FUNDS should be released until the private contributions have been unified and qualified survivors made fiscally whole with private funds, insurance policies, public servants' killed in action benefits, etc.. Fiscally whole is neither enrichment nor double dipping. Government funding should be used only if contributions do not meet the established needs of the survivors. The remainder should be used to defray reconstruction costs, which always exceed initial estimates. This has turned into a money grab. I realize it is our own fault since we started calling them victims since day one. They are not victims -- they are survivors. Wednesday, December 19, 2001 1:10 PM A Call for Equal Access December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. Sunday, January 20, 2002 12:40 PM Funds dispersal I believe that most Americans feel that all each life lost in the WTC attacks was equally precious and valuable, and I would like to see the funds dispersed equally, minus insurance (but not pension) payments. This was a tragic but unanticipated event--much like the KC bombing or any accident. I do not feel that those who were financially better off merit lifelong support for the lifestyle to which they had become accustomed any more than the families of others killed in similar events. Inequal distribution unfairly disadvantages the families of the younger worker who may have just begun a career, the lower-level employee who may yet have risen above his or her station, and those lower paid workers who were closer to retirement age. It advantages those who were fortunate enough to have put money away, invested well, paid off their house, etc. Please deduct insurance payments over a reasonable amount and divide the funds equally. It is the only fair way.
