Zwick, Director, Office of Management Progrom RE: September 11 Victim Compensation Fund of 2001, Interim Final Rule Dear Sirs: The primary stated objective of the Interim Final Ruling is ?to provide fair, predictable, and consistent compensation to the victims of September 11 and their families throughout the life of the program?? The Interim Final Ruling fails to meet the ?fair? and ?predictable? components of its objective. The determination of award levels is nowhere near fair. I have been unable to find past examples in our American legal system where limitations on federal compensation awards included life insurance and pensions. The regulations set a ?presumed award for noneconomic losses sustained.? The figure of this amount is set such that it is consistent with existing federal programs for public officials and military who are killed in the line of duty. It is my understanding that these federal programs are not subject to collateral offsets. The Sept. 11 victims federal program is subject to collateral offsets. Thus, the presumed award for noneconomic loss is inconsistent with existing federal programs for public officials and military. Furthermore, it is unacceptable that victims are offered no recourse should the system, under Kenneth Feinberg, treat them unfairly. Why must families make a leap of faith and place all of their trust in Mr. Feinberg? This is a man who recently described himself to attendants at a January 16 New Jersey meeting for family members of victims of September 11 as their ?only game in town? for compensation. Not only is the award level determination unfair, it is also unpredictable. Mr. Feinberg, at the previously mentioned January 16 meeting, assured Sept 11 widows that they will all receive some level of compensation. However, due to collateral offsets, it is theoretically possible for many families to get nothing. When pressed about this, Mr. Feinberg was evasive and refused to elaborate on his assurances. Families cannot reasonably be expected to forfeit their right to participate in litigation if they cannot first determine the amounts set forth in the federal alternative. Moreover, if the presumed award amount is minimal victims are given no alternative but to pursue a course of litigation to be reasonably compensated for their loss. Creating a situation where the victims must litigate is the antithesis of the legislative intent. Recommendations:  Families need to be told exactly what they will receive prior to agreeing to accept the settlement.  If there is indeed a minimum settlement after offsets it must be specified in writing.  Various scenarios should be developed, and put into writing, which illustrate what participants can rely on should they accept the settlement. As my family and I struggled with the loss of my uncle, , we found comfort in the appropriate and compassionate response of the White House, Congress, and other elected officials in the days following the September 11 attacks. The implementation of the Victims Compensation Fund proposed in the Interim Final Rule is starkly at odds with the initial, comforting reaction of our leaders. The deductions of many benefits (life insurance, pensions,?etc) effectively penalizes many families who planned in advance for the tragic loss of a loved one. The end result is families receive compensation that is below their level of economic loss, while airlines are sheltered from civil liability. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The interim final regulations written by the Dept. of Justice have not followed the intent of the Congress when they passed and the President signed the "September 11 Victim Compensation Fund of 2001" into law as Title IV of Public Law 107-42 ("Air Transportation Safety and System Stabilization Act"). Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actually suffered by the victims and their families. In fact, many families total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the regulation, some families would receive nothing from the fund under the interim final regulations. DOJs formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range on non-economic damages than could be recovered in any single jurisdiction. DOJs formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent, In a wide variety of air crash and terrorism cases, judges, juries and mediators commonly have provided non-economic damage awards well into the seven-figure range. My children have to go through the rest of their life without the man that was helping to shape them into productive, honest citizens of this country. Hes no longer here to laugh and play with them, swim and vacation with them, be their soccer and softball coach. Is their pain only worth $50,000? The method that DOJ used to calculate economic damages has serious flaws also. Using outdated and inapplicable work life and life-cycle earnings data and data that tracks federal worker incomes and doesnt take into consideration the higher paying private sector career paths followed by the vast majority of the victims is just plain wrong. These employees were of above average intelligence and productivity and the calculations should reflect this. These points have been brought to your attention on several occasions by economists, attorneys and of . These employees are part of the reason why America has enjoyed the prosperity we do and these calculations should reflect this. I implore you to rewrite these regulations in accordance with the original intent of Congress and the President. Please dont victimize us again. I am a New Yorker, a gay man, and one of the thousands right there in NYC on 9/11 during the attacks. The horror felt by all New Yorkers as we walked through a city with a decimated skyline, billowing smoke, and the sounds of fighter planes above our heads that day is probably incomporehensible to those of you who only witnessed the media coverage.
