Wednesday, December 19, 2001 7:57 PM Equal rights for victims December 19, 2001 Dear Mr. Kenneth Zwick, As a member of Amnesty International I strongly support equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. The United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. I therefore ask you to apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Saturday, March 16, 2002 2:11 PM Please include the partners of GLBT victims in the 9/11 fund compensation Dear members of the Victims Compensation Fund, I am writing to urge you to include the partners of Transgendered, Bisexual, Lesbian, and Gay (TBLG) victims of the horrible events of September 11th in your criteria for who qualifies for compensation. , along with other passengers, bravely fought the terrorists aboard one flight, and helped prevent further tragedy in Washington, DC., at the expense of their own lives, was of the plane that was seized by terrorists and crashed into the Pentagon. These two people and many, many others who are TBLG, lost their lives for no other reason than that they were Americans. Many TBLG victims left behind long-term partners who now face the same financial and emotional losses as their Straight (heterosexual) counterparts. A number of people including the president and other national government leaders, state and local leaders, and religious and business leaders have commented that on that day and since, there was a sense in this country that, regardless of our circumstances or how or when we came here, we are all Americans. This importantly should include the partners and children of same sex unions. Wednesday, January 16, 2002 3:37 PM Victim'sCompensation Fund Attachment 1; January 16, 2001 To Our Elected Officials: In the immediate aftermath of the tragic attack of the United States, on September 11, 2001, Congress enacted the Victims Compensation Fund of 2001, P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package to bail out the airline industry and imposed restrictions on the rights of the victims relatives to recover damages from court. We implore you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinbergs self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you demand the following changes to the interim rules: Remove the Arbitrary Income Limits. The arbitrary income limits imposed by the Special Master are not only unfair, but also inconsistent with the letter and spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked, the World Trade Center, the financial capital of the world and the embodiment of financial success. The families of those who achieved such success should see that reflected in their awards or at the very least should not be penalized for it. These victims personified American business, democracy and freedom. We ask that you demand Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support that the victims provided to their families before their untimely deaths. Increase Non-economic Awards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman , Every death is tragic. A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world -- in a scene which will be repeated in the media for decades to come -- is a horror these families will never escape. The Special Master cannot take it upon himself to restrict the rights of the families. Therefore, we request that the interim rules be amended to more appropriately compensate the victims families for the immeasurable pain and suffering endured by their loved ones. As former Mayor Guiliani stated in his farewell address: We have an obligation to the people who died. Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families. There should be no compromise about the every. We request that the interim rules be amended and the compensation for pain and suffering more accurately reflect that horror which was suffered. Justice demands no less. His wife, and his two little girls are left with nothing but memories. I am not the only one to bear such a sorrow, nor am I the only one to protest the administration of the September 11th Victim Compensation Fund of 2001, Title IV, of Public Law 107-42, 115 Stat. 230 (Air Transportation and Safety Act). Special Master Feinberg has promulgated a set of regulations contrary to law which artificially cap the compensation awarded to victims of this attack. There was no provision in the law for such a thing. Nowhere was it stated that the financial security of the victims was to be the prime factor in determining the amount of compensation due. For example: the New York firefighters who died trying to save those in the building have what are considered to be generous pensions. There is no provision in the law for reducing the compensation by the amount of such pensions. In fact there is no such provision for a reduction of any type. To penalize those who lost their lives by fiat as it were is not only unlawful, it is completely discriminatory, insensitive and immoral. Later discoveries make this sort of discrimination even less palatable. Surely someone could have at least considered the possibility that some sort of attack would occur, since there was a warning at least two days before. "At dawn we slept" As we did at Pearl Harbor. Our investigatory agencies, the FBI, the CIA, FELL DOWN ON THE JOB HERE, EVEN THOUGH THEY HAD FAIR WARNING NOT ONLY ON SEPTEMBER 9TH BUT ALSO BACK IN 1993. The FAA, has never had much experience in security issues and has always fallen down here. The ludicrous restrictions imposed by Special Master Feinberg are tantamount to punishing the victims of this attack for the failure of their duly elected and appointed officials. This is also contrary to law. I ask for nothing special here. Just to do your duty as duly elected and appointed representatives of the people of the United States of America. Remove Mr. Feinberg's guidelines, provide hearings with an unbiased, non-political officer, and remove the unlawful caps and reductions from collateral sources.
