Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. If a natural disaster came in and wiped out an entire block or city, they aren't given this kind of compensation. Yes, it is sad and unfortunate of the circumstances of September 11 but every day people die for no reason and not be compensated. You can't bring them back so the victims of September 11 will go on with their life as many other countless people have to after a love one dies, without huge monetary compensation. It is not the nations or our government's fault but the cruelty of a select few. While this has affected numerous people besides the loved ones and families of the tragedy, it has also caused massive layoffs and slow growth to companies that are hurting and they are not getting help from the government. How can an unemployed person survive on less than $250 a week for a family of 4 in order to pay all expenses? Is the government helping these people? No, they are not, so $250,000 is at least a boost to help these people to survive for a few years where the unemployed will be bankrupted and lose everything until they find another job. $1.4 million for a death is unbelievable. I can't believe that a woman was complaining she wasn't getting anything considering she was fortunate enough to have life insurance, pension plans in place that still exceeded $250,000. Let's put things in prospective. Some of us don't have the money for life insurance or to provide for our kids and $250,000 would certainly allow for any person to get back on their feet either through training to get another job or to help with college funds for children. Let's spread the funds so everyone can eventually get back on their feet, not to profit for a loved ones death. They should be grateful that there is a fund that will give them that kind of money. Money shouldn't be used to measure a person's death because no matter what, nothing can bring them back so let's stop this excessive compensation to victims. Otherwise, how can companies survive or grow to keep our population employed. Some people can not afford higher prices or premiums so that the greedy can be compensated. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. I am writng to say that I am tired of fighting for everything. For funds from the various sources of donated relief and all the time consuming energy it has taken since day one.We are being called greedy because we want to be able to stay where we live ,where our support system is and survive while taking care of our children and dealing with the grief that this tragedy has brought. I am tired of seeing the visual reminders on a day to day basis of how my husband was murdered. We are reminded on a daily basis by what we lost, from pictures in the media and papers and what we are surrounded by in our own homes. There is no time or space for us to grieve for we are constantly filling out forms, talking to lawyers, and dealing with government issues that we would never have had to deal with if this had not happpened and for which we are inexperienced at. But since it did happen and that is our reality we have had to research and learn more than I could ever have imagined in such a short period of time while still having to deal with the what is left of our lives. There is no "unprecedented expression of compassion", just more beurocratic misinformation . My husbands life and all he worked for has come down to what the government deems he is worth according to a monetary formula that leaves no room for us to be treated fairly by our own country. I lost my husband, an unborn child, my financial stability all within a one month period. It is shameful ! Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, January 02, 2002 3:25 PM Airline Bailout Settlement Fund The Airline bailout bill was not passed by Congress to provide for the families of the victims. It was created to protect the airlines from litigation. The fund that will award damages to families of victims was included as an incentive to accept a settlement and not sue the airlines. If the airlines are found to be negligent in protecting their passengers, they will not face punitive damages. The US Congress has limited the liability of these airlines to the extent of their insurance coverage. In doing so, they have removed the possibility of punitive damages. It actually states that the families cannot sue anybody if they accept the settlement. The dollar figures that have been cited as an "average" are grossly misrepresented. It is sensationalism to come about with an "average" without knowing what types of money will be counted against the settlement. If the deceased victim made any sort of plans for his or her family, they will not receive much at all from this fund. If someone paid life insurance premiums for their entire life, they are essentially being penalized for planning. If, instead, someone decided to invest this money rather than buy life insurance, this will not be subtracted from any settlement award. The fund discriminates on the basis of their investment choices. If life insurance and pension benefits were not counted against the settlement, then the fund would actually provide an incentive to avoid the courtroom. The rules should be changed and changed quickly. Right now, those less fortunate may be forced into signing because of financial need. Protecting the airlines may be necessary, but not at the expense of the families of the victims. If this tragedy involved three people instead of 3500, then each family would be looking at settlements from the airlines' insurance companies. Just because this event was of such a large scope, that does not make the loss of a loved one any easier. If the rules are not changed, then many people will be encouraged to take this matter to court. If we are trying to avoid lengthy court battles, then make the settlement more equitable. We don't owe fellow Americans anything for an untimely death. When did we become responsible for the financial well being of any victim? Where do we draw the line? Dear Mr. Zwick: Please do everything you can to see that the Department administers the September 11 Victim Compensation Fund fairly. Gay people were killed in the 9-11 attacks and leave partners and children in need of funds. Gay people DONATED to the fund. It is only fair that these people be treated the same as other survivors. Respect ALL families. To me, that is American Family Values. I implore you not to compound the grief of this tragedy with prejudice and discrimination.
