I am not against illegal or legal aliens of this country being compensated for their losses. I am however very against the fact that our country will not help compensate the life partners of those who died because they are homosexual. Even though there isn't gay marriage in the United States doesn't mean that the loved one of the homosexuals shouldn't be helped in some way. I refer your to the encouraging material you published explaining the intent of this fund and ponder these extracts: "Unprecedented expression of compassion on the part of the American people" As one of the seriously wounded survivors of the terrorist-related attack on the Pentagon, I'm so sorry that this relief didn't start with the Oklahoma City victims, the victims of the flood in Houston in June, 2001 and others. It is misleading to the taxpayer that the average family will receive $1.6 million dollars or be made rich from our taxpayer funds when most of the families in our areas will receive nothing! I hope that the relief becomes retroactive to them and their representatives take that honorable lead. I don't know one of those victims however I would like to share, and for now just help locally. From 11 Sep 01, one wounded survivor received reimbursements, from personal items destroyed, and made initial repayments to caretakers, then quietly donated the remainder to a local widow that lost her husband suddenly to cancer and was left with no resources to bury him Don't think the worst of the victims and start TRUSTING that they will "do unto others" with exponential acts of kindness, in the memory of the American people. This is healing the communities as well. "objectives: (to provide fair, predictable and consistent compensation to the victims of September 11 and their familiesâ?¦.." As a seriously wounded survivor I have two simpler and obvious distinctions for any presumed award for non-economic loss; those that were in the crash site and those that sat safely on the bench. The experience is imponderable yet you blindly penalize the survivors. I invite you to ponder how to stay the course and respect the demonstrable risk of those survivors that crawled away from the plane's dead bodies that rested in the burning/ collapsing conference room, with the landing gear within sight. You don't need the physical wound to stick fingers into (evidence), it is directly verifiable to the plane's destructive path though Wedge 1 of the Pentagon and surviving witnesses. There may be comparable places at the World Trade Center. Don't short change those few surviving souls, trapped in a collapsing inferno building, from a presumed award that will help them discreetly find their own private resolutions for their families, sanity, support networks and jobs to "provide them with a strong economic foundation from which to rebuild their lives". Being the head of household and sole provider for my family, it is a challenge to do my part for my family. Some of the seriously wounded believe it would have been easier it they didn't come out injured and had just died. I respect that the OK City victims are still going through counseling and the government continues to help buy-out their homes. Personal experience has proven that Worker's Compensation and insurance will wear them down with "red tape" requiring them to constantly prove their need for labor rejected prescriptions and to relive the terrors of 11 Sep 01â?¦, while everyone else sleeps. "Advance Benefits in the case of severely injured individuals who required hospitalization for one week or more." Why did you segregate "severely injured individuals" under 7 days? Why weren't you consistent with severely injured individuals supported by certified contemporaneous medical records? Surely the hospitals weren't polled to single out the few severely injured individuals that escaped from the hospital/media setting before 7 days? "In evaluating claims of disability, the Special Master willâ?¦. make a determination regarding whether the claimant is capable of performing his or her usual profession in light of injuries" With all due respect, these individuals will never perform up to their "usual profession" or "usual daily activities" they are forever changed, consider it "replacement services loss" for their families. Bless you Mr. Feinberg and your staff, for admitting you don't understand military retirements and that the tragic experience is imponderable. Stick to your resolution for fairness, as you ponder the imponderable. Rest with the dignity that the presumed award for non-economic loss is also appropriate for survivors/victims witnessed in the destructive geographic path. In reference to the victim compensation plan in place for the Sept 11th tragedy, I firmly support the manner in which the plan is taking effect. I feel that the potential beneficiaries of the compensation are receiving in excess of a fair settlement. I do not recall our government being this generous with victims of any mass tragedy. If the government tries to use means tests then it really doesn't save money. It diverts the monies that could be going to the victims to the government workers and private consulting companies. Because as a marginalized gay citizen of the United States, the "United" means everyone except me or people like me. The recent news coming from the Victims Compensation Fund proposing to exclude gay partners from compensation solidifies my repugnance for the superficial brand of nationalism that now permeates our country. Excluding gay partners from compensation is just another instance of the deep-seated bigotry that runs rampant here. Why should I pay taxes? Why should I fight for this country? Those that gave their lives and continue to do so, were not asked or considered their sexual orientation in death, but die bravely for the USA. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This is because (1) the projected economic and non-economic loss figures are unrealistically low; and (2) the Fund reduces any award by the amount of money a victim family receives from a "collateral source." When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted September 11 victims' right to sue the airlines, which bear ultimate responsibility for the tragedy because of lax security procedures. In exchange for denying victims the right to sue, Congress provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit, but without the burden and delay of litigation. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft highjackings and crashes on September 11, 2001" { Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without necessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims' families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congress's goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional $50,000 for the spouse and each dependent is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and military personnel, they choose to go into harm's way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are victims of negligent airline security. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. A more reasonable projection of non-economic loss is probably somewhere between the current proposal and the historical litigation result. The Interim Final Rule reduces any compensation awards by the amount of any funds received from collateral sources, including life insurance. The Interim Final Rule does this because Congress included such a provision in the Air Transportation Safety and System Stabilization Act. That does not make it fair; that does not make it right. In many states, the law on "the collateral source rule" has been well settled for over one hundred years. Under that rule, damages recoverable for personal injury or death, caused by negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airlines and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. The Interim Final Rule needs to be adjusted to provide fair, balanced and acceptable economic and non-economic loss projections. The economic loss charts need to be increased and expanded depending upon the deceased's job field. The non-economic loss amounts also need to be increased into a range that accounts for the tragic way in which these innocent victims died and the shattered lives they left behind. Collateral source recoveries need to be excluded from consideration by the Fund. Without these changes, the intent of Congress will not be fulfilled because there will be no reason for many of the September 11 victim families to participate in the Fund. Without these changes, it will be better for many victim families to take a chance at litigation rather than sign on to a Fund through which they will receive nothing but a waiver of their right to sue. Please rectify these inequities. Give the victim families a reason to participate in this Fund rather than litigate. Change the Interim Final Rule to provide economic and non-economic amounts at fair, balanced and acceptable levels; do not offset Fund awards by collateral source recoveries; establish a fair appeal process. Finally, please include the specific calculation formulas, statistics and assumptions within the rule or the explanatory materials. In the course of reviewing the final regulations on economic loss I note that there is no explicit discussion of serivce loss. The only reference is contained on page 11 of 27 where it states that "It is relevant to note comments suggesting that the economic loss calculations fail to incorporate sufficiently replacement servies loss. The Special Master recognizes that such losses are variable, and thus claimants may present at a hearing indivualized data to support a departure from the presumed award". It would appear to me that this does not provide for appropriate standards of review for submission of such data. The regulations should explicitly recognize service loss and commit to compensating for it. This is an element of pecuniary loss in wrongful death cases in virtually every jurisdiction. It should not be relegated in the regulations to a possible category of damages that would depart from a "presumed award". Service loss is not an element of consortium or pain and suffering. Service loss is seperate and distinct from wage losss. It is a real element of pecuniary loss under wrongful death statutes and is capable of valuation under standard accepted principles of economics. The loss of a husband, wife , father or mother always involves as an element of economic loss the services the surviving family members lost. The failure to recognize this element of damages suggests that the Special Master can ignore it or fail to factor it in as an element of economic damages. Leaving it as a vague reference in the regulations will cause unfair results. Many victims who do not have assistance of counsel may not understand that this is an aspect of damages to submit information on. Lay people do not understand damages in wrongful death cases and would have no idea that service loss is compensable. Lay people would not understand how to present the loss. Compensation for service loss should not hinge on the sophistication of the victim or the imagination of their lawyer. Why should some receive compensation and others not? Why should awarding any damages for service loss be left up to the discretion of the Special Master? What factors will guide his decisionmaking process? It would also be helpful to provide for the range of services that the Special Master will recognize as compensable and to provide recognized valuation figures to be utilized in computing it. This would assure uniformity of awards. Over what period of time will the Special Master recognize these awards? Who is eligible? All of these issues should be addressed so that victims can understand what moneys they are eligible for. This element of damages is especially important to families with children that lost a parent. If the Special Master is going to deduct the economic value of collateral source benefits from an award because of statutory mandates, it should also prescribe inclusion of all elements of economic loss in an award to make sure the victim is made whole.
