He was a young man who was full of promises and dedicated to providing for our parents. In determining economic loss, the interim rule for the federal Fund states that determination of economic loss requires a prediction about each claimant's future. The rule states that income between 1998 and 2000 will be used to determine this loss. However, if there is evidence that serve as better indicator of lost income, the rules should allow it to be used. In my brother's case, he had a two year employment contract from April 2001 to April 2003 for a minimum compensation that is significantly higher than his average income from 1998 to 2000. It was an indication of his promoted status as a bond broker. Moreover, a large portion of his income was paid in January of the year after he earned his bonus. Therefore, the average income from 1998 to 2000 would not include bonus earned in 2000. As you can see, a strict application of 98-2000 tax returns would mask the evidence of true economic loss for my brother and those like him. Also, my parents were financially dependent on my brother, but this would not show up in tax returns in 98-2000. My parents relocated to New Jersey from their previous home in the summer of 2001 to be closer to the rest of the immediate family. As evidence would show, he was fully intent on providing for them financially and would have claimed them his dependents in 2001 tax return. Again, we request that this type of circumstances be considered in determining economic loss for my family and other victims' families. Wednesday, January 09, 2002 10:43 AM September 11th Victim Compensation Fund January 9, 2002 Director, Office of Management Programs Kenneth Zwick USDoJ, Main Building, Room 3140 950 Pennsylvania Avenue Washington, DC 20530 Director, Office of Management Programs Zwick: as someone who lost my father in the world trade center along with many peole that my family knew that worked in the upper floors of 1 world trade center, i feel that the proposed details and stipulations of the fund are extremely unfair to many. my mother, brother and I were very disssapointed when we heard the results. my father was 54 years old, was planning on working for many more years, he loved his job, had worked there for about 20 years and was very successful at what he did. he made much more that the cap of $225,000. i do not see how one can cap someone's earnings at that rate. then to take out what someone's family has received in life insurance and donations from the many charities. one would think that at a time like this, that the government would give some kind of payback to those people that have been paying the majority of the taxes over the years. basically as it works out, we would not see any such beneifts from the fund, we might even end up paying the government money. if the government could spend all those billions of dollars to bail out the airlines after the weeks of sept. 11, you would think that it could assist those people better. i could see if my father had died of natural causes, but this was an act or terrorism. there should be some kind of better solution to this fund to make it equitable to those on the higher end of the scale who have been eliminated from the scale or capped out at $225,000. some may think that if someone made all that money that they dont need any more assistance from the fund, but guess what , my mom has mortgages, she has cars, she pays taxes and she does have normal expenses like everyone else. they may be proportionately higher, but they are still expenses. it should be interesting to see what eventually happens, i know many peole that have lost their spouse, and they are extremly unhappy. thank you for allowing me to express a small portion of my opinion. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Just want you to know where the public stands relating to the people that are not satisfied unless the get more money. I am sick and tired of the families that are not appreciative of what our government is trying to do. Notice, I said our government... my tax dollars and your tax dollars. Our money!. I am not talking about all of the families, just the ones that appear on TV constantly with their "constant asking looking for more money". Early on, the some people in the public came out and attacked some these people personally; calling them names and making personal attacks. I am not going to call them names or make personal attacks. However, I want these select people (they know who they are) how they really look to me, the average person. These people that keep asking for more money always say, "it is not about the money." OK, if that is the case... Say no to the money and go away. The way I see it... "IT IS ALL ABOUT THE MONEY". Other people in America lose family members to death daily. The only difference is that most people cannot take advantage of the outrage and sympathy of the American people due to 9/11. Example: Take someone that is killed by a person driving an old Ford Escort, with the minimum insurance coverage and an income of $20,000. Think about how much money will be received to loss, in a settlement or lawsuit. Take this same example and change the car to a Mercedes and the income to $200,000. Get it? To get back to the 9/11 tragedy; replace the car with jumbo jets and the income with a multi-billion dollar airline industry. Get it? The purpose of the government's relief package is not just for the "Families of 9/11." But for the American Economy... To give relief to the 20% drop in business affecting this very important transportation industry/sector. Oh, by the way... For those that are threatening to sue the government or airlines, think of who will sit on the jury. It will be someone that feels the same way as I feel. REMEMBER, it is my tax dollars. The people affected by 9/11 are not just the "Families of 9/11', but America. America, the people that work for the Airlines, Hotels, Restaurants,... etc. Again, do you get it?
