Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Tuesday, November 06, 2001 6:11 PM comments on distribution of monies to victims of WTC Help To Whom It may Concern: I would like to preceed my comments with the fact that I have been working at Pier 94 in Manhattan with victims of the WTC disaster. I am involved with the distribution of monies to families of those lost as well as displaced workers. I would first like to say that the definition of "victim" of this disaster applies not only to those hurt or injured but to those who lost their jobs and whose lives are no less severly affected than the families of the dead and injured. I have given a large check to a family whose financial needs are far less than their emotional loss and had to deny the same amount to a displaced worker who cannot even afford a Metrocard. These two groups of people must be treated equitably, each group receiving a share of the monies donated by a very well meaning and eager to help in some way group of people. Even those who were working at the most menial of jobs, and perhaps here in the US illegally, deserve fair treatment and a share of the financial help. I must say that even the treatment of the displace workers is less caring and even demeaning to these workers, especially since FEMA took over the operation at the Pier on Monday Nov 5,2001. It is my opinion that all the monies donated in good faith for these victims should be distrubet in full, without tax, to these victims and families. Even if the amount distributed was $million, which it won't be, the bulk of these victims are young. Even one million dollars will not last forever for a young family with four young children. Just do the math. Do not make these people wait for relief, do not make them pay taxes on this relief, and do not subtract whatever charitable moneys that they have received. It is wrong and not the intent of those who have so generously given. Monday, December 24, 2001 2:34 PM september 11th victims compensation fund 12/24/01 Dear Sir/Madam: I would like to comment on the wording of the fund that relates to physical harm. i severly hurt my back and neck on sept. 11 running away from tower 2 after the second plane hit the building. i worked in tower two along with my brother and sister-in-law, who were both killed. i did not make it to a doctor the next day because i was working the telephones trying to find the where abouts of my brother and sister-in-law. sadly to say we could not locate them anywhere, but this is the reason that i did not make it to my doctor within 24 hours. i saw and was examined by my physician on september 13th. i have been out of work since september 11th on workmans compensation. i have never had any prior neck or back injuries and find it unreasonable, almost unethical, to deny someone like myself access to the fund. i feel that Mr. Feinberg, should consider the circumstances involving my case and amend the rules of the fund so that true physical injury victims can go forward and use the fund. in my case it was impossible to see a doctor with in 24 hours due to the fact that my brother and sister-in-law were both missing and later confirmed dead. i request that the special master change this criteria or at least examine cases like mine that have truly extenuating circumstances. i look forward to a reply. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. If any discrimination is allowed that denigrates or tries to detract from any of the devastating grief and economic losses suffered by any Americans, straight or gay, then it does nothing but enhance the prejudice that we as a people and as a nation should not have, against any group. Gay and lesbian victims deserve no less than that of other families. Discrimination is not allowed under most of our laws, and it does not have a place in determining who gets or who doesn't get just compensation. The terrorists were not selective in choosing their victims, and if we as a nation start being selective as to who we compensate for their suffering from these attacks, then it demeans us all. Further, should this be done, what is the next group you or others might decide to deprive of their rights? Americans lost their lives on September 11, not Jewish or Christian or Muslim or Black or White or Brown or straight or gay Americans, but just Americans, each of whom left behind loved ones. I find it difficult to believe that the Department could even consider a decision other than to decide to find that everyone who was harmed by this tragedy is given the same rights as any other. Not more, not less, but just the same. To do otherwise would be a travesty of justice and against everything that America stands for, equality, meaning equal justice and equal treatment under our laws. Friday, January 25, 2002 4:09 PM Interim Final Rule Mr. Feinberg seems to be fixated on the term "according to economic need". This is not what the law is for. It is not called the September 11 Victim Welfare Fund, but the September 11 COMPENSATION Fund. The purpose of Congress, according to the very Congressmen than passed the bill, was to provide a balance: On one hand to protect the airlines. It does this by giving these companies, many of them on the financial ropes before September 11, $15 Billion in taxpayer money. The theory being that $15 Billion now is less costly to the taxpayer than the effect of the collapse of the industry would be to the economy as a whole. This goes along with total and complete protection for the 2 airlines involved from any actual liability regarding their utter failure to follow the law. The protection was then extended to the port authorities that had to oversee the airlines ground-side security procedures, and the management of the World Trade Center who had the responsibility to protect the people in the building and instead told them to go back to their desks in what was an obviously unstable situation. On the other the victims should not be prevented from getting the compensation that they would be entitled to if they did exercise their rights to file suit against the airlines and others. For this reason the fund was set up. That is all this is, a way for people to be compensated for their loss, not to just take care of some because of some "need". This was the governments promise "we will provide fair and full compensation if you agree not to sue and possibly destroy the airlines." And while the law itself was passed without anyone ever talking to the very people it was designed to compensate and with all its very obvious flaws, the interim rules completely wipe out any reason for the families to bother taking the offer. Why should we not sue the airlines, attack this obviously unconstitutional ex post facto law, and in the process possibly take down 2 airlines if the alternative is to take a leap of faith, sign away our rights on the vague promise that someday it is possible that someone may give you some amount of money for your loss. It would take years to get this through the courts? So what, the possibity of a payout in the future, even at pennies on the dollar in after a bankruptcy court liquidates the assets of American and United, is better than knowing right now that you will not receive dollar one if you sign away your rights. Trust is a very big issue here, and quite frankly the families just don't trust you, Mr. Feinberg. You lied to the families when you said there would be no caps and there are. You continue to tell the same lie of how we will "receive" $1.65 million when you know full well that no one will actually see a check for anything like this amount. You said that the charts were based on statistics created in 1979 to track federal pension funds and then deny it when people are outraged that you did not use more accurate, complete and current formula and statistics. You told families in Washington that the amount for non-economic damages, a number that would actually help the neediest people the most, was forced on you by the OMB and the Republican administration, and then deny it on TV. You have a pattern of refusing every opportunity to meet with any of the families or family group representatives in a public forum. What do you have to hide, Mr. Feinberg? Do what you were hired to do, fulfill the promise made by Congress and follow the intent and letter of the law by actually setting a non-economic damages number that will fit the situation of the victims and their families, clarify the collateral source rules, narrowing their scope as much as possible, recognize that your definition of family and my definition of family may not fit all of the types of famlilies that exist in our nation, and place the waiver of the claimant to exercize thier rights near the end of the process after they have some idea of what the claimant might actually receive net not gross and in the process shore up the already undermined credibily of this fund. If you cannot do that, then please by all means it is time to step down.
