Tuesday, January 15, 2002 2:51 AM Needed Changes to Victim's Compensation Fund Dear Mr. Feinberg: My husband was killed in the WTC on September 11th, he was on the floor of Tower 2. He was 39 years old and a Vice President in his company. Upon reviewing the current rules associated with the Victim's Compensation Fund I've come to the conclusion that my son (21 months old) and I will receive nothing from the fund. We will be penalized because my husband had the common sense to plan for the future by securing life insurance. There should not be a deduction for life insurance and pensions. My husband's life insurance should not be used to subsidize the airline's negligence. My son and I will also be penalized because my husband's earnings for 2001 exceeded the salary cap and the only earnings that will be considered are those for the 1998 through 2000 year. My husband was promoted in 2001 and also received a substantial increase in salary that year; this should be considered in determining his future earnings. The terrorist attacks occurred in the fourth quarter of 2001; the year was almost over. Earnings for the 2001 year should be considered in the calculations and salary caps should be removed. The government never put a cap on the taxes my husband and I paid therefore, there should be no cap on his salary. Also, my husband's retirement age would have been 67 (he was born in 1962). The victim's families are not looking to profit off their loved ones death, like many people unaffected by this tragedy seem to think. We just want to be made whole financially; we would like to maintain a similar lifestyle to the one we would have had if our loved one was still alive. Instead of penalizing the victim's families our government should be penalizing those responsible for the terrorists attacks. The airlines should be held accountable for their lack of security, something which the public and government has been aware of for many years. It seems like our government is more concerned with protecting the airlines rather than the thousands of people who were victimized by the terrorist attacks. Who is the advocate for the victim's families? Also, why aren't Osama Bin Laden's frozen assets being used to subsidize the Victims Compensation Fund? What happens to these assets? Where do they eventually end up? How much of the taxpayers money is being used to feed the people in Afghanistan, a country we are at war with? These people we are feeding are the same people who were cheering in the streets upon hearing that the WTC towers collapsed killing thousands. These people are also the same people who ambush our soldiers. If the government uses the American people's money for humanitarian efforts in a country we are at war with, then why are they not willing to make whole all these families that have lost their main wage earner? Please revise the rules governing the Victims Compensation Fund so that the Fund becomes a viable option for people like me. Thank you for your attention to this matter. With the hope of realizing a measure of financial security for the &nbsp&nbsp&nbsp&nbsp family, I have been paying close attention to developments concerning the "September 11 Victims Compensation Fund" (Title IV of Public Law 107-42). I have reviewed the regulations for the Fund (28 CFR Part 104) published in the Federal Register on December 21, 2001, as an Interim Final Rule (CIV 104P; AG Order No. 2541-2001; RIN 1105-AA79). We are considering filing a claim under the Fund but, in light of the Interim Final Rule, we hold considerable reservations. I understand that the Department of Justice is seeking further comment on the regulations and I would accordingly like point out certain aspects of the Rule that are inconsistent with intent of the legislation and that are otherwise inequitable to victims' families. The Statute and the Interim Final Rule clearly provide that as a condition to filing a claim under the Fund, a victim's estate and family must waive all rights to sue any parties except the terrorists. Paraphrasing the Interim Final Rule, the Fund is intended to be an alternative to litigation. At the same time (further paraphrasing the Interim Final Rule), the purpose of the Fund is to provide compensation to a victim's spouse and children that is just and appropriate in light of the victim's individual circumstances. If that is true, if the Fund is truly intended to provide just and appropriate compensation in lieu of litigation, it is incumbent upon Special Master Kenneth Feinberg to develop a methodology within the parameters of the Statute that establishes awards under the Fund that are roughly equal to awards that would otherwise be available to victims by way of the litigation process. In order to ensure that any award from the Fund is in fact an equitable alternative to litigation, none of the recoveries to which a victim's estate and family would normally be entitled should be reduced through a restrictive interpretation of the wording or intent of the legislation. To that end, a number of critical issues still need to be resolved and/or clarified in favor of WTC victims in order to convince family members that the September 11 Victims Compensation Fund is indeed an equitable alternative to bringing suit against American or United Airlines, the Port Authority of NY/NJ, the City of New York, Silverstein Properties (the WTC landlord) and/or the other parties protected under Public Law 107-42. One such issue is the "collateral source" deduction set forth in the Interim Final Rule. Traditional tort recoveries to victims are typically "free" from federal income tax. In an attempt to follow suit, the Interim Final Rule seems to indicate that awards issued under the Fund will be "tax-free". That, however, will not necessarily be the case if the current Interim Final Rule requirement that certain collateral sources be deducted from all such awards is applied. For example, the Interim Final Rule provides that the Special Master shall reduce the amount of an award under the Fund by any "pension" that a victim "has received or is entitled to receive". The term "pension" is not clearly defined in either Public Law 107-42 or the Interim Final Rule. All the same, it would appear under Section 104.47 thereof that the Interim Final Rule adopts an all inclusive interpretation of term "pension". Even traditional individual retirement accounts (IRA) would arguably constitute collateral source compensation to be deducted from awards. Unlike traditional tort recoveries, IRA distributions will not be "tax-free" to a victim's family. The new law exempting most victims from federal income and estate taxes does not change that fact. Under that law, individual retirement accounts remain taxable for purposes of federal income taxation (see the Technical Explanation of the "Victims of Terrorism Tax Relief Act" prepared by the Staff of the Joint Committee on Taxation). As a result, for the families of many victims, it cannot be said that an award under the Fund will be equal to a like award under the traditional tort process. An IRA is not a "pension" and should not be considered a "collateral source" under Public Law 107-42. In addition to individual retirement accounts, the collateral source provisions of the Fund should not include any insurance that was paid to a trust that does not grant a power of appointment to any family member, permit a victim's family to independently invade any principal of the trust or otherwise permit a family member to independently direct the disposition of any trust principal or income. Moreover, collateral sources (however defined) should be deducted against economic losses only, not the entire award. As a whole, the Interim Final Rule succeeds in certain respects but substantially fails in others. In the final analysis, unless the above changes are made to the Interim Final Rule, as well as other changes needed to ensure that claims for losses will be handled in an equitable way, victim's families will be unwilling to give up what is, for all intents and purposes, their most important right (i.e., the right to sue any responsible party). Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Zwik, Director Office of Management Programs U.S. Department of Justice, Civil Division Email: victimcom.comments@usdoj.gov November 16, 2001 Dear Mr. Zwik: As a relative of one of the victims of the September 11th terrorist attacks, I trust that the regulations for the Victims Compensation Fund ("the Fund") can be fashioned in such a manner to bring equity and closure this most awful chapter in American history. Towards that end, the Fund must be structured to encourage victims' families to surrender their rights to sue because they believe they will be treated fairly and promptly. To send such a compelling message I respectfully submit that the regulations must contain following elements: 1. Do not reduce the award from any collateral source funds collected, including insurance, pension benefits, death benefits, and governmental payments (which we understand are being considered as offsets). Such offsets should be disallowed for, among other reasons, the same reason the IRS exempts life insurance proceeds from taxation (i.e., to encourage citizens to plan for their heirs). Such offsets would penalize those victims who sacrificed and saved for their families' futures and unjustly transfer these assets, thereby representing a lifetime of work, to insurance companies and other corporate entities that may share the blame for the consequences that resulted from the tragic events of 9/11. In a nutshell, these assets have nothing to do with the damages that flowed from 9/11, and therefore there should be no offset to damages based on the net worth of the victims' families. It would also result in awarding more in damages to those who did not sacrifice and save for their families' futures, which would be an inequitable result. 2. Provide the victims' families with the right to appeal the award, as doing so would undoubtedly increase participation in the Fund. 3. Should the Department of Justice decline to offer victims' families the right to appeal, then at a minimum they should have input regarding the selection of the mediator who would decide the award. The government should provide a list of potential mediators with their background (e.g., educational, work experience, prior award history, etc.), which would allow victims' families to make an informed choice. 4. There should be set parameters for calculating damages (i.e., mathematical formula factoring lost future earnings, pension benefits, number of children, and other pecuniary benefits that would have been earned taking into consideration life expectancy tables), that would provide a floor for calculating damages and provide assurance to victims' families as to what they could expect to receive, at a minimum, if they elected to opt into the Fund. I believe this has been referred to in the press as the development of a "grid." In short, the victims' families should be able to calculate, with some certainty, the minimum amount of money they could expect to be awarded prior to participating in the hearing. That should serve as a powerful inducement to opt into the Fund. 5. Determine pain and suffering at the hearing. 6. If the mediator deviates for the guidelines the victims' families should be able to appeal the decision. 7. The regulations should include a scheme that would afford the victims' families one that is similar to the one they would enjoy in a wrongful death case. The amount awarded as damages should include all funeral, burial, and estate administration expenses incurred. Importantly, the amount should compensate the victims' family for contributions they would have received between the time of his death and the end of this life expectancy, such as future lost wages. His gross earnings, including all fringe benefits between the date of his death and his life expectancy, must be factored in. Additionally, all monies the victim would have spent for or given to his family for such items as shelter, food, clothing, medical car, education, entertainment, gifts and recreation, taking into account his salary and age, must also be considered. The amount awarded should also consider the comfort and friendship that he would have given to his family had he lived and such other elements as work around the home and provision of society and comfort. 8. Since the amount awarded would be intended to restore the victim's family's loss, it should not be considered as "income." Therefore, it should not be taxable by the federal or state taxing authorities. In closing, I understand that the DOJ is suggesting that the victims' families surrender their right to sue without advising them what they can anticipate by way of award and without the ability to appeal such award. This is, to be kind, unacceptable. The above suggestions would encourage attorneys and families alike to opt into the Fund, thereby forgoing their right to sue. This would bring closure to an American Tragedy and reassure victims' families that our government has their best interests at heart. We only want to place them in the financial position they would have been in had their loved ones not been taken away in the worst terrorist attacks in American history?which may have been avoided. They were not American citizens and were visitors in US. As victims' family member, I have two suggestions on the interim regulation of the September 11th Victim Compensation Fund of 2001. First, I think that the compensation for non-economic damages, should be raised from $250,000 to the similar level of the pain and suffering compensation for casualty in other plane crashes in recent years. In that case, most of the victims's families will choose this program rather than sue in the court. Second, this interim regulation did not specify how to calculate the economic loss of those legal foreign victims. Given the living standard , as well as the income and benefit, is quite different in foreign countries from that in the US, it is not fair to compute the economic compensation based on the exact amount of their income. In my opinion it will be more reasonable to analyze the percentile of their income in their own country and calculate the economic loss in the light of the income of the similar percentile in US. That is unacceptable. When it comes to gay and lesbian heroes of the day -- who helped bring down the flight in Pennsylvania, who died in the line of duty when the first tower fell, and who was of the plane that crashed into the (there are many more) -- we are told the law is the law and no exceptions can be made. Wednesday, December 19, 2001 10:09 AM Please help December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Thank you for considering my concerns. I look forward to hearing from you about your efforts to ensure that all surviving victims of the September 11 attacks have equal access to the relief fund.
