In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. They penalize some families and not others. Furthermore, offsets for life insurance paid for by an individual and offsets for 401Ks have no counterpart in the tort system. Certain rights under the tort system were taken away from us by the "Airline Bailout" bill. Ken Feinberg himself has stated that the statute "stacks the deck" against litigating. It is completely unjust that we should be deprived of our full constitutional rights as potential litigants, and also be deprived of the full amount of our damages when forced to submit to the supposedly equitable alternative-the 'Victims Compensation Fund'. If we as a society are agreeing that the survivors of those who lost their lives are due acknowledgement of the loss, in the form of generous financial support, then we take on the possibly onerous task of finding equitable means of reaching out to all of those immediately affected by this unique cricumstance. We love the same and are as devastated as other Americans who have suffered as loss due to 9/11 WTC disaster. imagine if you lost the person you love and share you life and finances directly as a result of this vicious attack. Friday, December 21, 2001 3:01 PM Comments Regarding the Victim Compensation Fund To Whom it May Concern: I would like to comment on my personal feelings in regard to the recently publicized Victim Compensation Fund. In general I am appalled that the Federal Government would provide any compensation to these victims unless the United States government itself is legally liable and directly responsible for their deaths or injuries. I fail to see why the deaths of a group of people who are distinguished merely by being at work in an attacked building merits such compensation. The people who deserve compensation or reward are those who knowingly put their lives at risk to aid those who were attacked. Assuming that the families of these victims are somehow more worthy of compensation than anyone else in the country who has had a family member murdered, I fail to comprehend why those who had the foresight and personal responsibility to provide life insurance for their families against such an occurrence should be punished by not receiving an equivalent amount of "compensation" as those who could not or would not be bothered to do so themselves. The compensation that these families are receiving is our troops and resources are being put into action to find and punish those who are responsible for the deaths. None of this should in any way diminish the extent of the outrage or sadness for the acts which cost so many their lives. However, by paying off the families, the United States government seems to be saying that they are responsible somehow for the loss. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families.
