As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I would add that "all types of families" should include the families of undocumented immigrants. It would be hypocritical to deny help to survivors of people who chopped vegetables and cleaned floors for the better-off documented people whom came to the WTC. They unfairly penalize those who provided for their families by paying premiums for life insurance protection and for savings under 401(k). There is absolutely no incentive for them to opt for the settlement since they receive nothing. Yet under the legislation they are limited in what they can do if they choose to sue. It seems so terribly unfair. In addition, the non-economic compensation is ridiculously low. $250,000 is nowhere near the value of this type of compensation under normal circumstances. It seems if this legislation was designed to protect the airlines from being bankrupted by numerous lawsuits it is sorely off the mark. L Zwick, I realize the comment period for Final Rule has ended, and after reviewing the comments posted on the DOJ website, I wish to submit a comment for later consideration. The entire issue of the Government compensating the victims of the horrible 9/11 is clearly WRONG! Everyone feels sincere sympathy for those killed or injured in such a tragedy, but to provide a pay out to their survivors using taxpayers funds is just plain wrong, and without precedent. Many, many millions were given to charities and funds set up for the victims through individual and corporate donations. But the government is not responsible for the terrorists actions, and neither are the airlines, and certainly not the American taxpayers! The victims had the same opportunity to insure against untimely death as the rest of us do. Additionally, after reading many of the submissions posted during the comment period, I am appalled at the greed evident, and at the opportunistic reasoning that subsidies should be given to parents, siblings, homosexual friends of the victims, and even to "undocumented immigrants"(which I read to be illegal aliens) and foreign visitors! It is simply sickening! To think so many donated so much to aid the victims and surviving dependent family! After seeing the attitudes expressed, I will certainly not be donating to any "victim's funds" in the future! Such greed and lack of appreciation is pathetic and shameful. I, like all Americans, feel great remorse about the events that happened on 9-11. I ,however, do have concerns about the message that is being sent by compensating victims of the event. I am also concerned that this is setting in motion future problems for this country for which we will not be able to respond. I have watched as numerous people have lined up and said that they should get a large sum of money due to the events of that day. I have also seen others go as far as to put a value on the lives of the victims and suggest that the amount should be based on the amount of income the person was making. This, in itself, says that if you were a cook for a cafe, your life was not worth as much as the executive. I hope that you would ask the family of the cook if they think that is true. I have lived in Oklahoma all of my life and can only relate this to what happened here several years ago at the time of the bombing of the federal building in OKC. After that event which claimed almost 200 victims, Oklahoma received the warmth of the nation. However, not one fund was set up to make the victims' families wealthy. I can only go back to the sayings that I grew up with....(There are no guarantees in life). That said, I think that while the events were as bad as it gets, I hope, it is no worse for the families of the event than it is for the families of the Marines who have died since that time. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Monday, January 14, 2002 8:34 PM Help all victims of terrorist attack Dear Mr. Zwick: The very humane Fund for relatives of victims of the September 11 terrorist attacks must include all relatives of all the victims. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. They are interested in a political victory, not humane assistance. This Fund is intended for humane purposes; it is not a political statement, Mr. Zwick. Wednesday, March 13, 2002 7:49 AM GLBT Issues It has been brough to my attention that the partners of Gay and Lesbians might not in many instances be eligible to receive any benefits from the 9/11 fund. I find this to be a terrible injustice, and a highly discriminitory practice. I believe as an American citizen that this is a time for our country to unite. Treat everyone that was affected by the 9/11 tragedy, equally without predjudice. Therefore I am appalled by this practice. Is it fair, right and equal that the compensation money will not include gay partners or loved ones of the gay heros and victims of 9/11/01? The gay hero that died a hero is no less a hero because he was gay.
