This importantly should include the partners and children of same sex unions. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. It was a very brief second... America seems to back to its old self. While I should not be surprised, I do feel a profound sense of loss in that it appears we have not learned much or anything from such a horrific event. We are all in this together regardless of our views and yet there are those persistant individuals and groups with fear and loathing in their hearts that will go to the ends of the earth to deny the most basic of liberties, rights and dignity to even those American's directly involed in the tragety. Gay and lesbian American's are being denied the same benefits of their heterosexual counterparts; how can we begin to justify such blatant discriminitory practices in 2002 and in America of all places. The Land of the Free...for who? With Liberty and Justice for ALL.....with exceptions! Seems that theses basic American values that we are all raised to cherish have never been and continue to be denied to the population as a whole for various misguided reasons, usually masked under the name GOD or RELIGION. Friday, January 18, 2002 12:20 PM Changes to Interim Rules Attachment 1, January 18, 2002 To Our Elected Officials: In the immediate aftermath of the tragic attack on The United States, on September 11, Congress enacted the Victims' Compensation Fund of 2001, to compensate the relatives of the victims of that brutal attack. As you know, this fund was enacted as part of a comprehensive package that bailed out the airline industry and imposed restrictions on the rights of the victims' relatives to recover damages from court. We implore you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and spirit of the law. Those victims from the financial industry are specifically harmed by these limits. They were targeted and murdered precisely because of the jobs they held and where they worked - the World Trade Center, the financial capital of the world, the embodiment of financial success. The families of those who achieved such success should see that reflected in their awards. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support the victims provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. My sister watched, along with the rest of the world, on television while her husband was trapped in a burning building and then as this building collapsed. She and her children are a part of tragic history and will always be linked to these events as they are replayed throughout the course of their lifetimes. My sister now lives in fear of the unknown -- how will this tragedy effect her children as they grow up. How can the Special Master take it upon himself to restrict the rights of families such as my sister's family? We request that the interim rules be amended to more appropriately compensate the victims' families for their immeasurable pain and suffering. We request that the interim rules be amended and that compensation for pain and suffering more accurately reflect that horror of September 11, 2001. Justice demands no less. I'm sure that people are hurting and very angry because what happened is not fair. No amount of money can ever compensate for the loss of a loved one. Families will never "be made whole" again and should not confuse the unfairness of life with the rules of the victims fund. The airlines should hardly be held liable for this type of terrorism that no one even dreamed of. To receive $1.6million tax free (whether from the fund, life insurance proceeds or other source) seems like a pretty good effort on the part of our government to provide for the victims families. Many high-salaried people worked in the WTC and presumably would have had large insurance policies. If the family has been provided for with life insurance, it is fair that the government reduces the payment. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families.
