Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The victims and their loved ones suffered greatly due to the attacks on September 11. Please help to ensure that they do not suffer more by being denied relief benefits. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. If anyone wants to change places with me and my family for the $0 we will receive from the federal government, please be my guest. Because my family had the foresight to have insurance, the government will deduct many these "collateral" offsets, award my family a sum of $0 and therefore say that my father's pain and suffering was worthless. Til this day we don't know what his pain and suffering entailed because our wonderful NYC medical examiners' office failed to tell us that DNA samples must be provided in paper bags, not plastic bags; this resulted in thousands of DNA samples yielding no successful DNA material. So more than 5 months later, the families are being victimized again, and have to provide mouth samples of the deceased person's children, parents or siblings. For all those critics who think their tax money shouldn't go to 9/11 victims, would you want this to be you? As our government has told us, these terrorist attacks aren't over yet, and the next attack could potentially be worse than 9/11. So, how would you like to be attacked as "money-hungry" and "greedy" if your loved ones are the next to be inflicted by terrorist attacks? Please don't judge any of use until you have walked in our shoes. In the days after 9/11, my family and I prayed and hoped for days, answered the telephone for days, searched in hospitals for days and were even given a false sense of hope by some distasteful list on the internet listing names of "survivors" who in fact weren't survivors. While my family was experiencing this, Congress, in the middle of the night, took away my fundamental rights as a taxpaying CITIZEN to sue the airlines, Silverstein properties, the INS, FBI and CIA - all whom are responsible for allowing these perpetrators If taxpayers complain about giving the victims' families their tax money, then I hope you express your disappointment with how our federal government took your taxes but yet failed to protect 3,000 innocent people who went to work on 9/11. Do you express concern how your tax money is spent on welfare recipients or on US-funded scholarships for IMMIGRANTS? The government didn't give me a dime for my education. My father worked 38 years to pay for my education and pay his taxes so in the end the government could turn around and kill him and then take fundamental rights away from his family. Let me discuss the non-economic award of $250,000 under this compensation fund. This amount is added to life insurance, pensions, 401K, SS benefits, etc. And if a victim worked long enough and saved enough in any of these plans, then our government says "sorry, you made too much money for your pain and suffering to be recognized by us". What about the pain and suffering of the families left behind? CBS will be airing a tape on March 10th. This tape isn't just of buildings crumbling. It shows the faces and the screams of the people in terror as they escaped or helped others escape. It provides the sounds of bodies hitting the pavement. Once again, the families of the perished will be victimized. Do you still think that $250,000 for pain and suffering (which could end up being $0) is enough? I wish Congress could take CBS's right to free speech and freedom of the press away, just like they took away my rights to sue by capping the airlines liability. My son, , was tragically killed on September 11th while an employee of on the floor. As I understand it, this fund was established to compensate the families of the victims and to expeditiously assist them in that process. While this is a very noble endeavor, I feel that in your effort to complete the drafting of regulations in a speedy manner, there may be some vital points overlooked. I would greatly appreciate your considering the following: 1. PROCEDURES TO ASSIST CLAIMANTS: Topic 234 Only attorneys licensed to practice should be permitted to assist or represent claimants for obvious reasons. There are a number of experienced attorneys who are volunteering their services to assist and represent these claimants so that there should be no need to enlist the services of non-lawyers who lack the training, knowledge, experience and skills necessary to properly carry out their obligation to the claimants. Furthermore, non-lawyers would not be governed by the Disciplinary Rules and not covered by liability insurance. To protect the claimants, only lawyers should be permitted to assist and represent them. 2. NATURE AND AMOUNT OF COMPENSATION: Topic 236 Schedules should not be used. Each claimant should be treated individually and not as a statistic. Since the Department wishes to avoid the claimants' presenting economic expert evidence, then independent experts should be available to the Special Master whose reports should be made available to the claimants for review and comment before a decision is reached. The claimant should be allowed to offer evidence of Government statistics studies and tables to aid the independent economic experts. 3. NON-ECONOMIC LOSS: Topic 236 Again, each case should be considered and evaluated separately. Many of the cases will involve "pre-death terror", claims which should not be lumped together, but should be evaluated independently of each other. May I especially draw your attention to the issue of "collateral sources" as I feel that the intent of the many generous individuals was not to aid the federal government. 4. COLLATERAL SOURCES: Topic 236 Charitable contributions should not be included in the definition of collateral sources. The generous people who contributed to the various victims' funds would be quite upset to learn that their gifts were in effect, going to the federal government instead of the victims. This is actually what would happen if the charitable contributions were used to offset the government's liability. Such a rule would also discourage charitable giving to these victims funds. For policy reasons, therefore, such a rule should not be adopted. In kind/or other material contributions should also not be considered as a collateral sources. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, November 21, 2001 3:45 PM comments Dear Mr. Zwick, It is with great concern, and hope of preventing what may be a grave injustice to all the families who lost loved ones during the tragic events of September 11th, 2001 that I am compelled to contact you. On September 11, the very fabric that symbolized the American family was torn with such finality as to eliminate any possibility of mending with "monetary thread." Despite that realization, I understand that the only compensation available to the families of those lost on that horrific day is monetary in nature. Subsequently, the establishment of the "Victims Compensation Fund" (the fund) is logical. However, while the establishment of the fund is logical, I fear that the guiding principals and mechanics of the fund are not. After all, it is commonly stated that "the distance between thought and deed is often far." Having said that, and having reviewed the parameters of the fund, I felt it was imperative to share with you the many reservations associated with the fund's ability to accomplish its single purpose - economic equity for those now painfully suffering from the lose of their loved ones. Below, you will find those reservations. First and foremost, it is imperative that each and every claimant be given the opportunity to share their unique circumstances with the individuals who will be instrumental in determining an award. In doing so, each claimant should be afforded both the opportunity to present evidence through their own personal testimony and enlist the assistance of experts, if desired, in order to provide a clear and concise depiction of their position. Allowing such an opportunity will ensure fairness and objectivity as each case will be heard separately and awards will be based on the circumstances associated with each case. On a personal note, the ability for an individual to share their pain and suffering is instrumental to the long journey associated with the healing process that every individual must now embark upon. Second, I am alarmed by the fact that the government, who will ultimately pay the awards, will be "appointing" one individual (The Special Master) to determine the "extent of harm to the claimant," the amount of compensation to be awarded based on "the harm to the claimant," "the facts of the claim" and "the individual circumstances of the claimant." While I understand that the "Special Master" will be designating individuals (hearing officers) to hear each case independently, that knowledge does not instill the confidence or peace of mind that I require to participate in the fund. Instead, I would prefer an independent panel, perhaps three (3) to five (5) individuals, who demonstrate expertise in areas such as "human life value," "wrongful death" and "taxation." I believe that these Individuals along with a "hearing officer" are more likely to determine an award that is commensurate based on the unique circumstances of each individual. Additionally, I believe by maintaining a panel of "hearing officers," the decision making process would demonstrate a greater degree of objectivity. Equally alarming is the fact that the determinations made by the "Special Master" and "hearing officers" are "final" and "not subject to judicial review." It is imperative that the option to appeal such a determination be made available to the claimants. Again, fairness and objectivity should be the guiding principals of the fund. In the event an award is not viewed as equitable, an individual should, as in any hearing, maintain their right to appeal a decision. The right to appeal a decision is often a cornerstone of legal defenses. If appeal is available to a criminal, why then should an innocent person not be afforded that same courtesy? Next, the method used to compute "economic loss" is of paramount importance. A "cap" with regard to recovery associated with "economic losses" is simply not acceptable. In fact, we believe an approach such as the one commonly utilized in personal injury cases is most applicable. Pursuant to such a method, the deceased's retirement date should be set to coincide with the date that the deceased would have been eligible to receive full Social Security benefits. Also, the deceased's income should be averaged over the last three (3) years given the fact that "economic losses of many of these individuals are associated with future income streams that would have been highly contingent, variable, or unpredictable " With that in mind, an approach that utilizes an "average income" is obviously the most appropriate method for determining an individuals income. Also, be sure to keep in mind that it is imperative that "income" include wages, bonus', stock options, partnership earnings etc. Finally, in an effort to fully reflect the earning potential of those lost on September 11th, inflation, historical wage increases, merit and opportunity for advancement must be considered. The final result of such an exercise would represent the individual's "base income." The "base income" could then be multiplied by the number of years that the deceased individual would have worked had he/she been eligible to receive full Social Security benefits. Furthermore, with regard to reducing the amount of the compensation by the amount of the "collateral source compensation," Life insurance proceeds (private and/or group) associated with premiums paid by the deceased, should not be considered as a "collateral source." After all, the deceased, in an effort to ensure financial support for his/her family, made a prudent decision to dedicate a portion of his/her after tax income to that financial security. To consider life insurance proceeds associated with premiums paid by the deceased as a "collateral source" would be akin to punishing the deceased for loving & caring enough about his/her family to ensure their financial future in the event a tragedy were to occur. Also, Social Security benefits should not be considered as a "collateral source." After all, the deceased paid into the system in an effort to ensure "social security." Unfortunately his/her family now represent the members of society that are in need of the very "security" that the system was designed to provide. The deceased was not give a choice of "opting out" of the social security system. On the contrary, an individual has no choice but to contribute to the Social Security system. With that in mind, it is obvious that his/her family should not be punished for receiving such benefits. After all, the Social Security system was never intended to be a "needs based" benefit. All individuals, regardless of income and assets, assuming that they secured the appropriate number of "quarters," have always been entitled to benefits regardless of the other type of assets/income that they may or may not have. Interestingly, countless millionaires receive Social Security benefits despite the fact that the income is not needed to ensure their financial well being. With this in mind, why should a benefit that plays an instrumental role with regard to a family's financial security be deducted from an award? Next, retirement plans (IRA's, 401 k, etc.) funded by the actions and sacrifice of the deceased should not be considered as a "collateral source." Again, the deceased, in an effort to ensure financial support for his/her family, made a prudent decision to set aside funds designed to ensure a comfortable retirement. A great deal of legislation (past & present) has been adopted in order to motivate individual's to plan for their financial future. Today represents the first step of that financial future. To consider retirement plans a "collateral source" would again be akin to punishing the deceased for loving and caring enough about his/her family to forgo current enjoyment in order to ensure financial stability in the event of a tragedy. Additionally, A "cap" with regard to recovery associated with "non economic losses" is simply not acceptable. In fact, it is imperative that the assistance of experts in the field of "human life value," be enlisted to determine an appropriate award given the ambiguity associated with valuing the "non economic role" of an individual. After all, the lose of the family unit, enjoyment of life and emotional pain is not easily discernible. However, given that I am both questioning the "fairness" of the fund and taking the position that benefits (life insurance proceeds & social security benefits) associated with payments made by the deceased should not be considered "collateral source compensation," it is understandable that the benefits funded by an employer (i.e. Workers Comp.) may be deducted from an award. After all, the maintaining of "Workers Compensation" is mandatory for employers and the premium associated with such coverage is an expense of the employer. This in turn may make this benefit similar in nature to the employer provided, noncontributory life insurance coverage - the $100,000 received from . With this in mind, it is easy to understand that the "benefit" is employer provided and may be considered a "collateral source compensation." Tuesday, November 06, 2001 12:39 PM My ideas One consideration could be to use a victims wages and benefit amounts as a basis for compensation. Continue paying the survivors or those who would be heirs, the amount that is now no longer being earned by the victim (victim could also mean those that did not die but were harmed by this event). In addition, expenses that have been incurred due to this tragedy i.e. funeral, medical, etc. should be paid from the fund directly since the intent of giving the money is to help cover such expenses. Future earnings potential over their normal life expectancy would be factored in. Using this method would keep the balance that would have existed had there been no tragedy. This tragedy should not be a means for people to receive a windfall nor should it be a means to have to live on less than you would have had. Any extra compensation should be in the form of paid tuition, paid health care, etc. but not necessarily only in cash except for the "pain and anguish" portion of the settlements. People should still have the right to make decisions affecting their lives without actually receiving cash that may not be used in the spirit in which it is given. This would not eliminate, but could reduce the friction caused because some family members may not agree on how the money should be spent, split, etc. I realize there are so many aspects that need to be considered and I don't envy those making the final decisions. Everyone won't be happy. However, this could be a core method from which to work and I believe it is justifiable to the public. I do favor that charitable donations should be taken into consideration when receiving compensation from the governments fund. However, if the charitable awards do not reduce the amount received from the government fund I would be less unhappy if the above formula were used. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. Monday, March 11, 2002 10:27 AM Kenneth Feinberg Speaks To Whom it May Concern- I was entirely disheartened to hear Mr. Feinberg suggest that there are degrees of victim hood based upon your sexual preference on Sunday's telecast. How does one become less of a victim when they are a homosexual human being? Further, to rationalize it by saying that there would be disagreement because it would not follow state law seems ludicrous when he also says they will compensate illegal aliens and not question the legality of their citizenship, or question their employers for providing them work. I do not have an issue with providing funds to illegal aliens at all. However, I do have an issue with then turning around and singling out a group of people to deprive. That is very upsetting. It's almost as if it was saying it's ok to discriminate. This then sets a precedent for future discrimination using the same rationale. I am sorry for those that will have to claim benefits from your fund. However, I am sorry for everyone, including those that can't claim benefits from your fund as well. I would therefore be unwilling to participiate or help your fund in any way that I normally could. You take something that most all people were proud to contribute towards, and something that helped create a sense of togetherness in America, and you make people feel seperated again by their differences. That is a damn shame. I hope you hang your heads when you think of it. Friday, December 21, 2001 5:59 AM Help all victims of terrorist attack Dear Mr. Zwick: The very humane Fund for relatives of victims of the September 11 terrorist attacks must include all relatives of all the victims. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. They are interested in a political victory, not humane assistance. This Fund is intended for humane purposes; it is not a political statement, Mr. Zwick.
