Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I served our country in a very unpopular war. 50,000 americans died in that war and don't remember any "Headlines" about any families receiving compensation, just headlines about POW's and MIA's. Not one God damn person from the government or other charitable organization offered me their condolences or financial assistance. Saturday, January 12, 2002 10:46 AM Issues regarding Public Law 107-42 To the Special Master, Several issues published in the newspapers give a false representation of the law and the monies that uniformed personnel survivor families would recover if they were to participate in the program: 1) The law was originally devised to compensate survivors because Congress took away their basic right to sue the Airlines, the city of New York, the State of New York, the Port Authority, the security agencies hired by the airlines, Logan Airport and probably some others that do not come to mind at this time. 2) The Congress enacted this law on September 22nd, 11 days after the attack on the World Trade Center and gave the Airline industry $ 15 Billion to bail them out, and it may be that this was necessary, but it is interesting that their first thought was towards bolstering a big industry, not the support of the families devastated by the greatest tragedy to ever befall America. 3) When Congress enacted Public Law 107-42 they believed that the number of victims numbered over 6000. Recently the number has been established at 2893 or about 48% of the original count. The decrease in numbers should factor into the process of amending the rules and regulations. 4) Firefighters in New York are paid a very low wage and receive benefits like pensions and life insurances, as their job is so dangerous, to care for their families in the event of their demise fighting fires. The offset of pensions and life insurances could mean that these families would receive very little or maybe no compensation at all if the rules and regulations presently in place are not amended to discount these offsets. 5) The greatest discouragement to the survivor families is the cap of $ 250,000 on pain and suffering. We know that any amount of monetary recompense will decrease our anguish, but to think that our Government thinks that the worth of these heroes lives mean so little is heartbreaking. 6) The rules and regulations remove from the survivors a basic freedom under the law, they penalize our uniformed service heroes with offsets. and finally they finally, the greatest slap in the face of all, they tell us that our lost loved have a paltry monetary value. I don't think any one but the survivors families can really comprehend the magnitude of what occurred on 9-11-01 and the outpouring of love and generosity from our fellow American citizens and the support we have received from them is so very greatly appreciated that we cannot find the words to adequately express our gratitude. If only Congress reflected their concern. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. It felt like the country was pulling together to heal. Terrorism can only take place when one person or group views another person or group as less significant than the ideology that rules the terrorist's groups beliefs. It was seeming for a brief time that terrorism by any group was going to be addressed and condemned. Now I am not sure. The concept of "Family" is now being defined and my concern is that many families that don't fall into the restricted concept of the Judeo-Christian family will be left out of the mix. It would be a sad mistake to define family by what it is not, instead of what it is. To use the "traditional heterosexual family" as the absolute and Gay headed families as the antithesis would deprive and marginalize the essence of "Family" being a supported collection of individuals that share a common bond emotionally and financially out of love and survival. We live in a country that has denied, and later marginalized same gender love; a love that has been with us all through history. In fact its history is long and impressive. To be singled out and hated at worst, and shunned is a form of terrorism also. Gay people are singled out for political discrimination, singled out for execution, and singled out for verbal abuse. It would be a crime if the government would continue with this practice. The biggest push behind the hatred of same sex love is from the religious right. Their basis for this campaign stems from the same fear of difference as that of other fundamentalist religious or political groups. How can we condemn a situation in the Middle East and condone it here in our country. Please break this long held prejudice and acknowledge the needs of all victims of this awful terrorist attack. It's an outrageous decision that is made even worse by the fact that you WILL be compensating the families of illegal aliens. How can that possibly make sense? This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great.
