Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. His name is and he worked for on the floor in WTC1. He only lived to be 25 years old. His career prospects could not have been any brighter and the scope for promotions and earnings potential was phenomenal; but that was before September 11. I am writing to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private fund available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actual suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive nothing from the fund under the interim final regulations. DOJ's formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range of non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent. In a wide variety of air crash and terrorism cases, however, judges, juries, and mediators commonly have provided non-economic damage awards well into the seven-figure range. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable worklife and life-cycle earnings data. DOJ greatly underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. The interim final regulations also arbitrarily cap a victim's income at $231,000 a year. Combined with the faulty methodology described above, the income cap would result in some families receiving compensation for less than 25% of their actual economic losses. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits. We do not believe these are the outcomes Congress intended. Please contact Attorney General John D. Ashcroft and Special Master Kenneth R. Feinberg and tell them of your concern that the interim final regulations fail to conform to the language and intent of the act. With the regulations soon to become final, I believe that only the swift and strong support of Congress can avert unnecessary financial and emotional damage. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." I suspect, though can not prove, that a prime motivation behind this decision is political-- awarding compensation to gay people would entail too much risk for the current administration. It is my understanding that no payments are being made to gay and lesbian partners and family members if there is no state law to sanction a payment. My family made contributions to 9/11 funds for ALL of the victims: black, white, janitors and/or CEOs regardless of their sexual orientation. Your discrimination of the distribution of these funds is outrageous. Do you really feel it is right to deny a loved one just compensation (obviously no amount can be just in this situation) because they are not of the "correct" sex? I understand you are "allowing" compensation to illegal aliens and their families who were victimized in the attacks. Why are you willing to overlook federal laws while helping aliens but are standing on state law to avoid paying a select group? This does not make sense. Wednesday, March 20, 2002 7:29 AM Concerning Victim Compensation As a middle class nurse, mother, wife, step-mother, friend and someone who has never missed voting, I am writing to say how upset I am over no compensation for homosexual live-in couples. How is the partnership that they have made together any different than those of hetersexual couples? Couples who have made commitments emotionally and financially need protection upon the death of one partner. If hetersexual couples are to receive compensation from the horrendous loss of September 11th then I feel homosexual couples should be granted the same rights. Sent By Fax to (301) 519-5956 Dated: December 26, 2001 RE: Corrments on the Proposed Regs. on the Definition of Physical Harm in Section 104.2 I would like to pose a question on a particular part of the above proposed regs, suggest a proposed answer to that question and suggest proposed modifications and thoughts on what should be in the final regs for the definition of "Physical Harm" Section 104.2. I am specifically referring to the requirement that a claimant must have sought medical help within 24 hours of the incident. Query-Does that 24 hours requirement operate as an absolute bar to recovery, does it serve as a presumption or to move or burden of proof or is it intended as something else? I would suggest that it definitely not serve as an absolute bar to recovery but, preferably, serve as a so-called positive presumption, i.e., if an otherwise qualifed claimant sought medical help with 24 hours, causation is presumed and not an issue. Moreover, the first 72 hours or so after Sept. 11th were quite chaotic particularly in all of the directly affected locales. All the hospitals here were geared up for emergency aid for what turned out to be a small number of survivors and everyone else was strongly discouraged from going to any emergency facilities. Even in the best of times, it is quite difficult to get to see a physician on very short notice, i.e., on what would have been not much later than between 10:00 and 11:00 A.M. on the next day, Sept. 12th. I cannot conceive that you intend to permanently bar claimants (many of whom did not make it home until quite late on Sept. 11th) who did not seek medical help until the afternoon on Sept. 12th or, perhaps, until say 11:30 A.M. that morning. Given that an absolute 24 hours time requirement would hardly serve the interests of justice, one should ask what time standards, if any, should be used? Let me suggest that there be no absolute time bar at all. Moreover, given the circumstances on the ground at the time, one should use a 72 or perhaps 48 time frame and use it as positive presumption in the manner that that term is used above. Every claimant should have an opportunity to prove direct and proximate causation beyond a reasonable cause. Of course, the greater the time lag between injury and treatment, the harder that will be to prove and the time issue will continue to be quite relevant. However, you should not create any bright line narrow time test, as that will certainly deny justice to those who could not or would not, for whatever reason, seek medical assistance in compliance with that narrow time requirement. In the aftermath of Sept. 11, many people were immoblilized and not functioning well or at all for days. Why penalize them now? Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Sunday, March 17, 2002 4:04 PM Fwd: 9/11 Fund Ousts GLBT Partners I find it atrocious that our government is willing to overlook US Immigration laws so that some survivors may be aided/compensated yet it is UNwilling to aide those who are US residents merely because there is no uniformity amongst the nation/states about what constitutes a gay relationship. It is a disgrace that people like &nbsp died to save the US Capitol yet any relationship he might have had has been deemed 'not worthy' of aide from your fund. People who make decisions to exclude gays from receiving the benefits of the fund don't even deserve to associate themselves with people as honorable as &nbsp . If anyone should have died, I would say it should have been you. At least that way, your heterosexual spouses could get some aide from the fund.
