Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist Michelangelo Signorile, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping Signorile accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Sunday, January 06, 2002 11:29 PM Is $1.5 million in line with military death benefits I wish to provide a comment on the proposed level of compensation for victims of Osama bin Laden's attacks on Americans. On January 4, 2002, a Green Beret serving in Afghanistan was killed by forces supporting Osama bin Laden. In 2000, sailors aboard the USS Cole were murdered by supporters of bin Laden. In 1993, bin Laden sponsored the attack on U.S. military forces in Mogadishu. I'm wondering about the total compensation package for the families of those military members. As a veteran, I know it did not nearly approach the average $1.5 million, tax-free, currently extended by the federal government to families of victims of the September 11 attacks, in addition to any insurance, pension and charity they may receive. The maximum amount for Servicemembers Group Life Insurance is $200,000. Even the families of those who earn the Medal of Honor receive far less than $1.5 million. I wonder now whether this compensation package will be offered to the survivors of military members killed at the Pentagon on September 11, even though military members surrender their right to sue for injury incurred during active duty. It seems to me that those who serve and sacrifice for the nation deserve the greatest rememberance. In establishing a level of compensation, I would recommend that the government apply to WTC victims the same standard applied to members of our Armed Forces. If anyone doubts that servicemembers endure substantial pain and suffering in combat, they need only view the movie "Black Hawk Down" to remove such doubt. Remember that the dying servicemembers in Mogadishu or aboard the USS Cole never had a chance to phone home to say goodbye. Maybe we should consider the value of their sacrifice, their bravery, their honor to this country before we try to assess the value of the pain and suffering of an innocent bystander. Do we place a greater value on a victim of circumstances than we do the brave servicemembers who intentionally put themselves in harm's way to preserve our peace, our freedom and our nation? To do so would indeed be, to quote one of the WTC widows, "a sick joke." When reading the news and some of the comments here I am disheartened to see how many people do not understand the underling reason for this legislation: to protect the airlines, port authorities, city and state governments and the WTC Building Management from actually being held liable for their own actions. There is a lot of misinformation in the public realm and the Department of Justice should step to the plate and clarify things. It should be made clear to the public that the amount of net compensation to be received by the victim's families is much less than the gross amounts that the DOJ has used ($1.6 million per victim). It also must be made clear what the victims were forced to give up in return for this fund. There are a lot of comments that pointed out that people die tragically in America every day. The families of these decedents are not awarded any money from the US government (other than social security). Many posters are particularly upset that the members of the United States military who are killed in action do not receive this kind of financial payment from the government. Let me address these concerns. 1. The federal government is not giving the September 11 victims a "handout" or a "free lunch". Before implementing the Victims Compensation Fund legislation, Congress first decided to pay $15 billion dollars to the airline industry and to limit the amount of their potential liability to the amount of insurance they carried. There are approximately 3,000 victims who perished in the attacks and many times that number of people who sustained serious physical and psychological injuries and well as economic damages, all caused by the negligence of the airlines, the security firms and the government's gross negligence. The amount of insurance carried by the airlines would be a pittance when divided by this many plaintiffs. Congress, at the behest of an airline lobbying effort that began on September 12, decided that the airlines were "too big to fail" and so placed severe liability limits on any potential lawsuit. Because of this, the corporations who were negligent will not pay penny one out of their own pockets. In addition, participants in the fund are required to give up all rights to sue anyone over their actions or inactions that led up to the September 11 attacks. Congresss apparently viewed these lawsuits as a threat to the aviation industry and moreover a threat to the US economy and to future tax revenues. Giving up these rights is a large concession and anyone doing so should be adequately compensated. In other situations where Americans have died tragically the surviving family members have had the recourse available to sue for damages. For instance the families of the victims who suffered tragic deaths recently in Queens when the jet destined for the Dominican Republic crashed, have the ability to sue the airlines for negligence and will likely be awarded adequate damages through the lawsuit or through a settlement. They will not be required to deduct life insurance, pension or any other benefits from those awards. The victims of September 11 had this option taken away from them in all material respects by the Airline Bailout statute. They did not ask to have this law passed, the airlines did. 2. In the case of members of the US military being killed in action, that too undoubtedly is a tragic event. The difference is that the members of the US military volunteered to do what they are doing. They dies as armed combatants fully aware that they are the targets of their enemies. The people who lost their lives on September 11 for the most part were civilians who merely went to work as if it was an average day. They were killed because they embodied American success. It was a strike against all of America that resulted in their death. They were innocent of anything other than being Americans. That said, I would be the first one to support a law that awarded the families of military that were killed in the line of duty a higher amount than the $250,000 life insurance policy that they have. I would, however, not wish upon them the convoluted rules for deducting life insurance, pension payments, workers compensation and other payments. Thank you for your consideration.
