This importantly should include the partners and children of same sex unions. Tuesday, November 20, 2001 3:46 PM Sept.11 Victim Comp.Program Dear Mr. Zwick, As a parent of a deceased victim of the World Trade Center terrorist attack, the American Trial Lawyers Association has urged us to respond to the Notice of Inquiry and Advance Notice of Rulemaking. My concern would be that the emotional damages done to the victims' loved ones not be minimized. Not only did we lose our son, brother, husband etc. to this horrendous mass murder, we were subjected to watching it over and over again in the media. The only way to avoid the constant stab of pain was to not watch television at all; for you never knew when the crumbling towers were going to pop up on your screen. My husband left my two daughters and me in February 2001. When he left, we were devastated emotionally. My son stepped right in and filled the roll left by his father. He provided emotional support, did all of the heavy work around the house and yard and made us feel secure. He was there for us in every way. We loved him dearly and were going to be just fine. When he died, it ripped a hole wide open in our hearts and plunged my youngest daughter into a depression. Please ask the Special Master not to evaluate pain and suffering on a sliding scale. There are no offsets for this. It hurts just as much for a mother, father, sister or wife to lose someone this way. Thank you for your support in this program. We truly appreciate everyone's efforts. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. We acknowledge the difficulties you are facing in your efforts to move quickly and comprehensively to ensure that the victims of this tragedy receive much-needed assistance as soon as possible. We will be submitting formal comments in due course, but write today to express our hope that these regulations--when drafted--ensure that the September 11th Victim's Compensation Fund will provide equitable compensation to all victims of this tragedy without regard to their sexual orientation. As we mourn every life lost in the tragic events of September 11th, we note we have lost members of our own community as well. A number of gay people, including members of the Human Rights Campagin, perished in these terrible tragedies. They include an &nbsp&nbsp&nbsp&nbsp on the flight that crashed into the Pentagon, who left behind his life partner of 14 years; a nurse from New Hampshire on her way to a west coast business meeting who left behind her logtime partner; and a civilian Department of Defense employee stationed at the Pentagon who is survived by her life partner of 18 years. As you know, for an individual who was killed in the September 11th attacks, the statute, PL 107-42, provides for compensation claims to be made by "the personal respresentative" of the decedent. We write to share two broad-based concerns that we have with the statute as drafted. First, the statute does not make clear that domestic partners in same-sex relationships or non-biological children are eligible to receive compensation from the Fund. We strongly support the inclusion of language in the regulations that would allow a personal representative to seek compensation for any relative who relied on the decedent for support. And second, we are concerned that the statute does not clearly state that it is the duty of the personal representative to distribute the compensation awarded to family members and relatives in proportion to their losses. To achieve the state purpose of this Fund - "to provide compensation to any individual (or relatives of a deceased individual)" - it is critical that these regulations reflect the reality of relationships and families in today's society. We know that you share our concerns and look forward to working together in an effort to achieve this goal. Doing so would complement what other signitifant private relief efforts, including the American Red Cross and the Sallie Mae 911 Education Fund, have already done by recognizing domestic partners of victims when disbursing survivor benefits. We want to thank you again for seeking public comment and input at this early stage of the regulation-writing process. The ACLU urges the Attorney General to make the Fund available to same-sex partners of deceased victims. Unless the Attorney General takes that step, same-sex partners will have no choice but to have the courts apply the authorizing statutes choice of law rule to order relief under the laws of states that recognize the right of a same-sex partner to recover for the death of his or her partner. The purpose of the September 11th Fund is to provide victims of the September 11th terrorist attacks with the ability to recover relatively quick and certain compensation from the government in exchange for a waiver of claims they might otherwise have against the airlines or other entities that may have been negligent or otherwise culpable in the hours, days, or weeks leading up to the attacks. To encourage the maximum number of potential claimants to elect compensation through the Fund instead of through the courts, the Fund must be designed to ensure that all potential claimants who could recover in court could also recover through the Fund. One action the Department can take to encourage the maximum number of potential claimants to elect compensation through the Fund rather than through the courts is to ensure that the regulations implementing the Fund recognize same-sex partners of decedents or injured parties as potential beneficiaries of the Fund. Failure to do this could have far-reaching ripple effects: For every individual who cannot recover for his or her loss through the Fund, at least one more piece of litigation will likely result in the courts. Same-sex partners, if excluded from the scope of the Fund, could pursue litigation based on the laws of many states, including states whose laws already do or are likely to recognize same-sex relationships. The Funds authorizing legislation provides that anyone electing to seek compensation in court, as opposed to through the Fund, must bring suit in the United States District Court for the Southern District of New York. See Section 408(b)(3). However, the legislation also provides that the "substantive law for decision in any such suit shall be derived from the law, including choice of law principles, of the State in which the crash occurred ... ." Section 408(b)(2) (emphasis added). While the crashes occurred in New York, Pennsylvania, and Virginia, the choice of law rules of those states could easily result in the application of other states law to the disputes. For example, the law of Massachusetts or New Jersey could apply, since the planes took off from Boston and Newark as well as Dulles. The law of Washington state could apply, since some of the planes were manufactured and fitted with inadequate cockpit doors there. And the law of a variety of other states, including California, could apply, since machines such as the x-ray machines used to examine luggage or metal detectors used to screen people prior to boarding the planes were likely manufactured in many different locales. Thus the law of at least five states, but most likely that of many more states, may ultimately determine who can sue to recover for the losses occurring on September 11th. These states include New Jersey, whose law would allow a same-sex partner to recover for the death of his or her partner, and California, which has provided the same rights through case law and statute. In addition, if same-sex partners are excluded from recovery through the Fund, they will have no choice but to pursue what we believe will be powerful state and federal constitutional attacks on any state laws that would exclude them from recovery by failing to recognize their committed relationships with the deceased. For the foregoing reasons, the ACLU urges the Attorney General to reduce the likelihood of what could be a new flood of litigation by ensuring that same-sex partners of victims of September 11th be eligible for recovery through the Fund. You are willing to offer compensation to those partners of illegal aliens that were killed who are heterosexual, and ignore those who are gay partners of Americans. Are you discounting the support that gay's offer to their partners? Are you discounting the fact that these gay persons put their lives on the line to save YOUR life? And, in doing so, put the lives and hearts of their partners into mourning? Ones sexuality does not negate the sacrifice to ones country. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association.
