Thursday, March 21, 2002 5:11 PM Equal Compensation For All It has come to our attention that there is an inequality in the law governing the benefits of the 9/11 fund. We support the fund and it's use, but we are very upset that spouses (i.e., partners) and households of same-gender families are not entitled to equal compensation under the law. We in same-gender households live as families, just as surely as those in heterosexual homes. We love, care for, and depend on one another. Many in same-gender unions are as dependant on one another's income as their heterosexual counterparts. Unfortunately, we are unable to engage in any form of officially recognized union (i.e., marriage). Please understand that this is not our choice, and we do not feel that those who lost loved ones should be penalized for this. It is impossible for us to accept that fetuses and illegal aliens are recognized in the plans for compensation, yet we within an American community are not. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Tuesday, January 15, 2002 9:29 PM to the Special Master Dear Mr. Feinberg: I lost my beloved husband when he was murdered at the World Trade Center on September 11th. I am writing to express serious concerns re the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." The "airline bailout" act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private Fund available to compensate victims and their families. Thus, for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the Fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has apparently discarded this mandate, instead creating regulations that will result in compensation levels far below the losses actual suffered by the victims and their families. In fact, many families' total compensation from the Fund COMBINED with all collateral sources combined will not fully replace lost income as the Fund regulations now stand. In effect, these families will not receive ANY of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive NOTHING from the Fund under the interim final regulations, despite news reports that would have the public believe otherwise. DOJ's formula for non-economic damages of $250,000 for the person killed and $50,000 for the spouse and each dependent is about 1/10 of the minimum awarded in a variety of air crash and terrorism cases. Further, independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable worklife and lifecycle earnings data. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof puts the onus on the grieving families and creates, intentionally or not, an adversarial situation with families "competing" for monies. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the Fund was designed to replace. DOJ continues to resist the victims' and families' requests for significant changes. If the proposed regulations are not changed meaningfully, many families, anticipating little relief from the Fund, will be forced into the legal system, suing despite the handicap of the liability limits. I cannot believe this is the outcome Congress intended. Because it was important for us to act speedily, the legislation of necessity sets our broad guidelines and leaves to you and your department the job of providing specificity so that these funds can be distributed fairly and expeditiously. We write to express our view on one aspect of this important set of questions which is before you-namely, we urge that in creating the category of those who qualify as "survivors of someone lost in the crashes", (Topic 5, Notice of Inquiry), we can best carry out the intent and spirit of the law by compensating all of those who suffered both grievous emotional loss from these murders and significant financial loss as well. That is, we believe that the federal government should provide such compensation as is appropriate to all of those who had a close relationship with the murdered victim and whose own financial position will be seriously adversely affected by the death. Relevant indicia of such a relationship include a shared residence, shared bank accounts for other financial instruments, joint membership in a health plan a significant sharing of living expenses, etc. Obviously a wide range of different personal relationships will be covered by this, and we believe that this coverage is wholly appropriate in this instance. We note that this is the approach taken by Governor George Patalo of New York, where so many of the victims live. The act we passed was not an effort by the Congress to regulate any set of personal relationships nor to encourage or discourage people from following any particular pattern in their living arrangements. It was simply a prompt response by the Congress to the terrible murders inflicted on America on September 11, in particular by doing what we can to come to the aid of those who were particularly victimized by the deaths of people close to them. Aiding all of this latter category of victims seems to us the appropriate response. As I understand this law, it is intended to provide FULL ECONOMIC and NON- ECONOMIC COMPENSATION TO ALL THE FAMILIES of those killed September 11th, 2001. The statute requires the Special Master to make an award based upon the individual circumstances of each claimant. I also understand that Mr. Feinberg arbitrarily established a system of guidelines that would determine the award each family would receive under the Fund without listening to any evidence and/or hearing how the tragic events of September 11th have affected individual families. He has already determined how much each family will receive by placing a salary cap and reducing the award if the family receives monies from collateral sources. Those families, who were well provided for, like my brother family, will receive nothing. I think it outrageous. Our government was grossly negligent in its duty to protect its citizens and now wants to add insult to injury by placing caps and restrictions on the monies awarded to the victims' families. This tragedy could have been avoided had the CIA, FBI, FAA and the airlines been more diligent in their duties. I am very angry that ALL the victims' families will not be treated on an individual basis as per the statute. As an American taxpayer and conscientious voter, I expect our government to put the citizens of the United States FIRST before pouring millions of dollars into Afghanistan (or any other country); to take the time, however long, to compensate these families according to the law. I urge you to remove Mr. Feinberg's guidelines, to provide hearings with an independent non-political, unbiased hearing officer and to compensate each family fairly by removing the salary caps and reductions from all collateral sources. I cannot help but think what a disgrace it would be to the families and a dishonor it would be to all those who died, especially to those who sacrificed their lives (in the air and on the ground) to save others.
