In both cases, the law is being used to justify these actions. In WWII black men fought for our country and were treated as though they had done nothing when they returned to their homes in the United States. Are we now behaving so differently when we allow our government to treat gay and lesbian families different than any other family members who died in the 9/11 events? Saturday, November 10, 2001 8:10 AM Fw: September 11 Victim Compensation Act Collateral Source Rule May Penalizes Diligence Dear Mr. Zwick: Please carefully cosider the following comment: September 11 Victim Compensation Act Collateral Source Rule Shouldn't Penalizes Diligence The VCA collateral source rule requires that any award under the Act must be reduced by the amount of any "collateral source compensation" that "the claimant has received or is entitled to". VCA Section 405(b)(6). The Act does not state that amounts received by VCF claimants from charities constitute "compensation", nor that a VCF claimant shall deemed "entitled to" any such amoumt, both within the meaning of VCA Section 405(b)(6). Therefore the Special Master should not reduce any compensation awarded under the Act, by the amount of any charity payment received by a VCF claimant regardless of whether or not actually received before application for or award under the Act. There are also practical reasons for the Special Master not to treat charity receipts as collateral source compensation to be deducted from awards under the Act. Despite the best intentions, anyone who has diligently applied to any 9/11 charity for help well knows the uncertainty of many charities' criteria for making grants; seeming inconsistency in grant amounts among comparably situated applicants; and vast discrepancies between published grant criteria and the amounts of charity awards. In this enviroment, how can the Special Master possibly determine the amount of charitable awards to which a VCA claimant is "entitled" but which the claimant has not received or for which the claimant has not even applied at the time of filing a VCA claim or determination under the Act? Such a deduction would penalize the claimant who diligently applies for and receives charitable grants before filiing a VCA claim, as compared to a claimant who perhaps intentionally delays applying to any charity until after receiving payment from the Special Master. If a major purpose of the Act is to encourage 9/11 victims to eschew the court system and rely upon the Special Master fairly to determine the amount of VCA compensation that a VCA claimant should receive, the amount of any charity receipt should be ignored in determining the compensation to which a VCA claimant is entitled. For all these reasons, charity receipts should not be considered "collateral source compensation" under the VCA. Wed 01/16/2002 12:13 AM To Our Elected Officials: In the immediate aftermath of the tragic attack of The United States, on September 11, Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack.  As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims' relatives to recover damages from court.  We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master.  As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law.  Those victims from the financial industry are specifically harmed by this limit.  They were targeted and murdered precisely because of the jobs they held and where they worked - the World Trade Center, the Financial capital of the world, the embodiment of financial success.  Those who achieved such success should see that reflected in their awards.  They personified American Business and commerce, democracy and freedom.  We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering.  This is unacceptable.  In the words of Congressman ,"...every death is tragic.  A murder is particularly tragic.  But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families."  Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones.  As Mayor Giuliani stated in his farewell address:  "we have an obligation to the people who did die...Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise about that ever..."  We request that the interim rules be amended and that compensation for pain and suffering more accurately reflect that horror which was suffered.  Justice demands no less. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families--and all types of families--impacted by the human rights tragedy of September 11 are treated with dignity and equality. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Friday, December 21, 2001 9:05 AM compensation high Dear Sirs, I am appalled at the comments by some of the Sept 11 victims' families that was the result of the governments plans for compensation being released. I was also surprised that some of the packages could be in the millions of dollars for some of the families. I think that as a society we are in the habit of continually bargaining to relieve the grief of surviving members. Loss is part of life and perhaps the government should not be so willing to hand out absorbent amounts of money to some of the families. Our very dear friends and were lost in this horrific tragedy. To cope and to try to deal with their absence from this life is sometimes so overwhelming for me I can hardly breath, and I am only a friend and neighbor. To try to comprehend what my friends and their families are experiencing is unimaginable. The nature of the fund, If I understand correctly would be to provide financial security for spouses and their children. If it is the governments intent to ask the families who opt into the Fund to forego the right to sue, then I think in order to expedite this Fund the following should be considered: The amount awarded as damages should encompass all funeral, burial and estate administration expenses incurred. It should be an amount that would "fairly and adequately" compensate family for wages lost from the time of his death until his retirement date. It should also emcompass mortgage, education, medical expenses. I also believe the physical pain and suffering endured by at the time of this tragedy should be a factor of consideration along with the fact that these monies are intended to help restore the family's loss and the money therefore should not be considered "taxable". was a diligent father, husband, friend and neighbor. He provided for his children, loved them and was their biggest advocate. His presence is so painfully missed. The grieving and sorrow that the families are trying to work through now doesnot need to be interupted by the continuous amount of paperwork and correpondence that has monopolized their time to date. I went to a Grief Support Meeting with my neighbors on Wednesday evening and the families are overwhelmed by the red tape, paperwork, correspondence and the continuous "uncertainty" their future holds. Please consider their feelings, and the fact that the more time they have to spend on the uncertainty of their future, the less time they have to spend with their children and dealing with their sorrow. They are all trying to get their lives back into some kind of order, if and whenever that is possible. Therefore, I feel at this time it is extremely important for the government of the United States to make the families fully aware of its intent with reference to the fund and its provisions, only then can the government ensure that there will be an incentive for the families to sign onto the Victims Compensation Fund.
