As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Tuesday, November 06, 2001 12:19 PM Please Reduce Payouts from the Victims' Fund based on Charitable Donations I am a US citizen who, in addition to paying taxes as required, makes regular generous contributions to multiple social and religious charities. (As a characteristic example, last year my charitable contributions exceeded $26,000, representing more than 19% of my 2000 income.) In the wake of the September 11th tragedies, I have given to several victims'-related causes, but those contributions have been made with some amount of trepidation due to my concerns about how the funds will be administered and coordinated. Though it would be impossible for any amount of money to make up for the human loss endured less than two months ago, I am concerned that it is VERY LIKELY that inequities will prevail and that some will end up much worse off than others. It seems that the only way to attempt to ensure some type of justice in financially compensating the victims of this tragedy is to tally ALL sources of remuneration, including charitable contributions, that the victims receive. I fear the outcome otherwise. For example, has received tremendous publicity and sizeable contributions to its Relief Fund based on the enormity of their loss, their CEO's notoriety, and their connections to well-heeled individuals and institutions -- this in the midst of most of these employees' having had decent incomes, life insurance policies, homes in the suburbs, and the like. (For example, , their CEO, is currently paying $46,000 PER MONTH in rent while awaiting completion of the restoration of his multi-million dollar home in Manhatten.) In contrast, the grieving relatives of the janitors, cooks, and bus boys who worked the WTC complex, Windows of the World restaurant, and even the kitchen, have not had the same advocates, resources, nor publicity to very successfully generate Relief Fund contributions for their lost. And their families are likely in much tighter -- or even desparate -- circumstances. My point is that, without considering ALL sources of compensation in the wake of September 11, there will likely be great disparities and inequities that occur in the administration of the Victims' Fund. Sunday, March 17, 2002 10:43 PM 911 fund exclusion of Gay and Lesbian Americans It appears that according to recent articles about the rules of the 911 Fund, that Gay and Lesbian people, who have suffered just as great a loss in the 911 tragedy as anyone, are being excluded from the benefits because our relationships are not acknowledged under state laws. Even moreso, Kenneth Feinberg appears to be willing to ignore US law regarding illegal aliens who lost a loved one and compensate them (IF they are heterosexual) as well as ignore their illegal status in this country. "The attorney general, in consultation with Immigration, etc., undocumented aliens who come forward, the families will not suffer any consequences. They are covered by this program. They will get a check. The employer, where we need the economic information about the undocumented alien, will not be penalized," Feinberg told "Meet the Press." However, Feinberg also said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones. Feinberg was further quoted, "[Gays and lesbians are] left out of my program to the extent that their own state doesn't include them. I cannot get into a position in this program, which has a one-and-a-half or two-year life start second-guessing what the state of New York or the Commonwealth of Massachusetts or the state of Virginia or New Jersey, how they treat same-sex partners, domestic live-ins, etc. I simply say this: What does your state law say about who is eligible? If your state law makes you eligible, I will honor state law. If it doesn't, I go with the state. Washington, D.C. 20530-0001 Re: CFR Part 104, Interim Final Rule for the September 11th Victim Compensation Fund of 2001 Dear Mr. Zwick:            Hotel Employees & Restaurant Employees International Union, Local 100 (the â??Unionâ??) represented 43 workers who perished in the tragic events of September 11th. These individuals all worked for Windows on the World, a restaurant located in the World Trade Center. Since September 11th the surviving family members of these 43 workers have looked to our Union for assistance and advice in attempting to put their lives back together. In response to the concerns of the families and based on the Unionâ??s analysis we submit the following comments with respect to the regulations promulgated by the Department of Justice on December 20, 2001, concerning the administration of the September 11th Victims Compensation Fund of 2001 (the â??Fundâ??).            Many of the Unionâ??s concerns arise from the fact that the majority of the families are immigrants and had incomes on the lower end of the economic scale. In general, we fear that the administration of the Fund as contemplated by the regulations will punish those most in need because it proposes a regressive model for determining economic losses.            Below we have outlined the regulations that we believe require significant alteration before our survivorsâ?? families could consider opting into the Fund:            The first concept that needs to be changed is the provision that survivorsâ?? families must waive their rights to proceed in Federal or State Court before opting into the Fund. It is fundamentally unfair to force survivors to waive their rights before they are aware of the amount of compensation they will receive and when they will receive it. There needs to be a mechanism for claimants to receive an advisory opinion from an independent, non-political evaluator regarding the valuation of the award before they are forced to waive their rights to litigate. As it is now drafted, 28 CFR § 104.31 proposes two separate tracks to process claims. A third track should be added in order to provide for such an advisory opinion.            A second crucial area that needs to be addressed relates to immigrant, non-citizen claimants. The Union has grave concerns that the residency status of the claimant will disqualify or delay the distribution of awards to families who are non-citizens. For example, the requirement under 28 CFR § 104.4 that a Personal Administrator must be installed according to the laws of the decedentâ??s domicile will, in New York, preclude an undocumented spouse of a victim to assume the role of Personal Administrator. We believe that this could potentially delay the distribution of funds from the Award months or even years. The regulations should be amended to state explicitly that no regulation therein will cause the disqualification or delay in the payment of awards to undocumented claimants.            Also with regard to this issue of undocumented claimants, the regulations should prohibit the Justice Department from using the data provided in making claims to the Fund as a basis for legal action against the claimants or their families based on citizenship status.            A third key area of concern is the cap on non-economic losses of $250,000 per decedent and $50,000 for each dependent. Because many of the workers our Union represented were low wage workers, their familiesâ?? recovery for economic losses will be significantly smaller than other families. One method to provide a more equitable system would be to increase the amount of non-economic recovery available to all families.            We would also like to take this opportunity to relay to you some individual comments about the Fund from survivorsâ?? families that we would also like to be addressed. First, the definition of dependent as defined in 28 CFR § 104.3(b) is too limited, and should be expanded to include anyone who was financially or emotionally dependent upon the decedent, such as domestic partners.            Another concern is that the manner in which the regulations determine economic losses punishes families in which the decedent was an older worker. If the decedent was a low wage earner the disparity is compounded. It is the Unionâ??s position that this approach discriminates against older workers and the regulations should be rewritten to make for more equitable awards.            Finally, with respect Collateral Sources, 28 CFR § 104.47, many of the victimsâ?? Thursday, December 20, 2001 11:03 AM September 11 Victims Relief Fund December 20, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. By following state law regarding the lack of recognition of same-sex partnerships, he makes a statement that it is alright for states to descriminate against people simply because of who they choose to spend the rest of their lives with. Monday, January 21, 2002 11:06 PM (no subject) After much thought, I have decided to voice my opinion concerning the September 11th Victim Compensation Fund. My husband was killed on September 11th. He was employed by &nbsp&nbsp&nbsp&nbsp . I disagree with the collateral source deductions. I believe as a matter of public policy it is wrong to penalize the victims by deducting life insurance benefits, death benefits, pension plans etc. from any award as set forth in the Special Master's statement. Moreover, I believe the interpretation of the statute by the Special Master is incorrect. While Section 104.47 does require reduction of an award by the above mentioned collateral source compensation it further requires that the compensation be "related to the terrorist-related aircraft crashes of September 11, 2001.". Websters New World Dictionary, 2nd Edition defines "related" as "...2. connected or associated, as by origin or kind...". I believe that if the payment could have been made under any other circumstances other than the terrorist attacks then it cannot be considered a collateral source compensation. Additionally, the origin of these payments is from responsible planning on the part of the decedents and their families and not from the terrorist attacks. If Congress had truly wanted all those items to be deducted they would have ended the sentence without the additional above quoted language. Any other interpretation would render the additional language superfluous. In the interest of justice it should be interpreted in a light most favorable to the victims' families. Thursday, November 29, 2001 3:34 PM Compensation for "nontraditional" families To whom it may concern, I wanted to write and express my concern over the possibility that the Department of Justice may not be justly awarding compensation to the loved ones of victims who were gay, lesbian, bisexual, or transgendered. In this time of national grieving, we must not only express our deepest sympathies towards the victims and their families but must also understand that to narrow a definition to exclude gay and lesbian people from compensation is propagating a climate of intolerance, discrimination, and exclusion. Thousands lost people they love, partners they had built lives with, families who they cherished. The issue of including gay and lesbian people into compensation to the partners of gay victims is so important to the many who are learning to live with lost loves. I do hope that compensation is awarded not to the "next of kin" (as this would likely exclude many surviving same-sex partners), but is instead handed over to the state which would then award compensation based upon what was left in wills. I am only 21, I am from a small town in rural Nebraska. I realize the bigotry and discrimination that exists against people who have same-gender orientation. However, I also know that love has no limits, that God has established this sovereignty, and that the only fear of same-sex partnerships is a fear of love and tolerance. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: It has come to my attention that the families of the many victims of the September 11th attack may be compensated in unjustly different amounts, due to the way the rules of compensation are written. I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
