Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. We happily lived together as husband as wife, however, we were not legally married and our chance to due so was taken from us on which is now the most tragic day in history. I only ask for your consideration as a fiance/domestic partner and for your consideration for all domestic partners and couples who lived together and who's lives have been shattered at the loss of their spouses. We that lived together were family and the compensation fund should be given to those that the deceased would have intended and financially supported while they were alive. Friday, January 18, 2002 11:08 PM Comments on September 11th Victim Compensation Fund of 2001 Interim Rule, 28 CFR I am working closely with a family that lost their father on September 11th. The Interim Rule still leaves significant uncertainty regarding the rules for the compensation fund, and the potential compensation from the fund. As a result, the objective stated by the Special Master "...that claimants be able to enter the program - or choose not to enter the program - with an understanding of how their claims will be treated" has not yet been achieved. Clarifying the open issues and removing the ambiguities is critical to the ability of claimants to make an informed decision on participation. I have organized my comments on the Statement by the Special Master and on the Interim Rule by the appropriate paragraph of the Interim Rule. My comments are: 104.43 Determination of presumed economic loss for decedents. It is clear that a formula was used to generate the presumed loss tables. However, only partial information on the elements of the formula has been provided. Further, the assumed location of domicile, and corresponding tax rates, has not been identified. Also, the factors for estimating consumption have not been defined. The result is that the potential claimant is left to guess at a presumed amount that could vary significantly from what the fund will calculate. Providing explicit information on the underlying formula in an updated version of the presumed loss tables is key. 104.44 Determination of presumed non-economic losses for decedents. The Statement by the Special Master indicates that the most rational and just approach for non-economic losses is to base them on categories of claimants. He further continues "The most obvious distinction is between those who died and those who suffered physical injury but survived." That distinction is the only one recognized by the Interim Rule. However, there are also distinctions based on the circumstances of death for the decedents. In particular, those trapped in the area above the floors destroyed by the plane in WTC Tower One and below the locked Emergency Exit doors to the roof were subjected to extraordinary suffering for an extended period of time (many even choosing to jump from the building). These people account for a significant portion of the overall fatalities, and would seem to constitute a distinct category of decedents. Knowing the circumstances of their suffering has also exacerbated the suffering of their family members. As a further comment, the values assigned to the non-economic loss seem very low compared to what might reasonably be expected from a successful tort action with facts as in this case (e.g. the locked Exit doors). Since the non-economic loss amounts are not defined by the statute, one approach might be to simply increase them significantly, e.g. by a factor of 2 or 3 for everyone. This would have the further benefit of reducing the spread of the overall awards resulting from differences in income of the decedents, and would reduce the number of claimants receiving minimal or no awards due to collateral offsets. 104.47 Collateral Sources. While the language of the statute provides a list of items that are to be considered offsets, the meaning of each item is not clear. It would be most helpful if there were a clear statement of the specific items that are to be offset, and their treatment, together with a commitment that those items will be the only ones. Questions on the current language include: - Pension funds. Is this limited to employer-provided pension benefits, or does it include 401K funds and IRAs? If 401K funds and IRAs are included, are employee contributions and the associated appreciation deducted from the value of the account before considering it to be an offset? If not, aren't you basically offsetting the award with the amount in a savings account? Considering investment assets as offsets would not seem to be consistent with the intent of the statute. - Payments by federal, state, or local governmentsâ?¦ At a meeting with families on December 17, 2001 the Special Master said that Social Security Survivor Benefits and Worker's Compensation payments would not be collateral offsets. Please confirm that these are not included in the definition, or if they are, how the present value is to be determined. Also, are payments by Victim Compensation Funds included in the definition? - Charitable donations. Subparagraph (b) (2) first says that charitable donations are not offsets, but then goes on to say that the Special Master may determine that they are. Which will it be? There have been many complaints about the inclusion of life insurance as a collateral source offset. While the statute requires it to be a collateral source, it does not define how the offset is to be calculated. Since these are funds that the family would normally receive upon the person's eventual death, it would be reasonable to take the decedent's life expectancy into account and assume that the life insurance payments would have been paid at that time. The present value of the payments would then be used as the offset. Premiums paid by the decedent should also be deducted from the value of the policy. Adopting this approach would increase the probability that families will participate in the fund, while preserving the intent of the statute. Thank you for your consideration of these comments. This should not be a "gift" to the families of highly paid people. If someone worked for a financial firm and their family will be receiving several millions in insurance, they do not need taxpayers' help. This should be limited to people who NEED help. I am thinking of the cafeteria workers, janitors, police, etc., whose families may very well be destitute. The comments set forth herein address the failure of the regulations to meet their stated objective of treating victims of the terrorist attacks fairly, predictably and consistently. Since the Air Transportation Safety and System Stabilization Act provides that the mere submission of a claim under the Fund operates as a waiver of the right to file a civil action for damages, Sec, 405(c)(3)(B)(i), it is critically important that the unfair and inconsistent provisions discussed below be revised so that all individuals injured in the terrorist attacks will be able to seek compensation from the Fund. The regulations as presently promulgated exclude from Fund compensation those whose primary injuries are post-traumatic stress disorder and those who, for good reason, did not receive treatment for more than twenty- four hours. If such individuals submitted claims to the Fund and were found to be ineligible, they would be deemed to have waived their right to seek damages in a civil action. Thus, any individual whose eligibility is uncertain will be forced to choose litigation and forego a claim for Fund compensation. 1. The 24-Hour Rule. The Act provides that compensation under the Fund is limited to those who were at the site of the crashes at the time or in the immediate aftermath of the crashes and "suffered physical harm or death as a result of such an air crash." Sec. 405(c)(2)(A). The regulations further restrict eligibility by defining physical harm as "physical injury to the body that was treated by a medical professional within 24 hours of the injury having been sustained or within 24 hours of rescue." §104.2(c)(1). This artificial restriction fails to account for the chaos and confusion in the aftermath of the attacks which prevented many injured individuals from seeking medical treatment for several days. Indeed, the Center for Disease Control and Prevention's Morbidity and Mortality Weekly Report of January 11, 2002 published a study which showed that fewer than 800 people were treated at hospitals nearest to the World Trade Center over the two days following September 11. There are many legitimate reasons why victims of the September 11 terrorist attacks may not have received medical treatment within 24 hours of injury or rescue. During the first 24 hours after the attack, many victims who were able to stumble away from the scene may have been suffering from shock rendering them incapable of seeking appropriate medical care or even identifying medical problems until they eventually received assistance from others to do so. There were probably many victims in New York City who tried to seek prompt medical care, but were unable to obtain it due to the overburdened emergency medical system and the disruption of telephone communications during those initial hours of crisis. It would be unfair to deny eligibility for compensation through the Fund to victims who did not obtain immediate medical care for any of these types of reasons. Therefore, we propose that this provision of the regulation be amended to require that claimants sought treatment by a medical professional within a week of the injury having been sustained or identified or within a week of rescue. 2. Exclusion of Compensation for Damages Related to Post-Traumatic Stress Disorder. The regulation's definition of the statutory term "physical harm" excludes Fund compensation for those suffering from post-traumatic stress disorder(PTSD) who have no "physical injury to the body" meeting the requirements of 104.2(c), although PTSD sufferers may experience physiological symptoms 1 which would reasonably be deemed to constitute "physical harm." This exclusion drastically undermines the regulation's stated purpose of providing fair and consistent compensation to the victims of September 11. The eligibility regulations include individuals who sustained relatively minor physical injuries while excluding individuals suffering sever emotional and mental trauma whose actual damages may be much more significant. For example, a person who was on the street near the World Trade Center at 1 See the American Psychiatric Association's Diagnostic and Statistical Manual of Mental Disorders, Fourth Edition("DSM IV")309.81. the time of the attacks, but before the collapse of the buildings, began running, tripped and sprained his ankle, and was taken to the hospital would be eligible for compensation, while a person who was on a high floor of the North Tower of the World Trade Center when it was hit, struggled for over an hour to descend the stairway, exited the building as the South Tower collapsed around him, witnessed the horrific scene of carnage at the site, and (while not sustaining any "physical injury to the body" as defined by §104.2(c)), developed a severe, protracted, and totally disabling case of post-traumatic stress disorder would not be eligible for any compensation. Moreover, it seems(although it is somewhat ambiguous) that, for those who have both a "physical injury to the body" and post-traumatic stress, only those economic losses(including medical expenses and lost earnings) and non-economic losses which were caused by the physical injury are compensable. §§104.45(a) and (b) and 104.46. These provisions of the regulations thwart the statutory provision that "emotional pain" and "mental anguish" are compensable, losses. Sec. 402(7). Therefore we propose that post-traumatic stress disorder be included within the regulation's definition of "physical harm". Alternatively, the regulation should be amended to make it clear that, for those who meet the physical injury eligibility requirement of 104.2(c), all economic and non-economic losses caused to them by the airline crashes be compensable, including damages resulting from post-traumatic stress rather than from physical injury. September 11 Email September 11 Email: Body The basic content, as unstructured text; sometimes containing a signature block at the end. 9 January 2002 To our Elected Officials: In the immediate aftermath of the tragic attack of September 11th upon our nation, Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape form... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die... Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise account that ever..."We request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that compensation for pain and suffering more accurately reflect that horror which was suffered.
