As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims' relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked - the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King,"...every death is tragic. A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die...Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise about that ever..." We request that the interim rules be amended and that compensation for pain and suffering more accurately reflect that horror which was suffered. Justice demands no less. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. This is one day before this country was to Honor the Six Month Anniversary of 9/11 when 2,830 human beings gave their life to their country, and Thousands upon Thousands lost a LOVED ONE. With this said, we write this letter in protest over the regulations promulgated by Special Master Feinberg under the provisions of the September 11th Victim Compensation Fund of 2001, Title IV, of Public Law 107-42, 115 Stat. 230 (Air Transportation and Safety Act), which was intended to provide full economic and non-economic compensation to the families of those killed on September 11, 2001. These regulations contradict the intent and mandate of the statue by pre-determining the awards and placing arbitrary limits on the awarded amounts. Specifically, the pre-determined cap on earnings; the nominal, pre-determined amount awarded for non-economic loss; and the reduction of the awards by monies received through life insurance, government programs and/or employer benefits are contradictory to the language and intent of the statute and constitute a betrayal of trust placed in our government. Determining the financial security of the victims' families is not why the statute was passed and should not be the basis of the ensuing regulations. The intent was and should be to compensate the victims' families for the loss of their loved ones regardless of age, race, religion, or socioeconomic status. Capping the award for economic loss at an annual salary of $231,000.00 is discriminatory. Moreover, there is nothing in the statute, which allows for the limitation or capping of earnings. Similarly, to penalize the families by reducing the overall awards by monies received from life insurance, government programs and employer benefits is discriminatory, insensitive and contradictory to the intent of the law. The non-economic loss cannot be pre-determined by the special Master. The pain, suffering and emotional ramifications affecting &nbsp&nbsp&nbsp&nbsp , &nbsp&nbsp&nbsp&nbsp , &nbsp&nbsp&nbsp and &nbsp&nbsp&nbsp&nbsp extended family run deep and will have an undetermined effect for many years to come. The daily stress and emotional pain that has and will be endured and the resultant effect it will have on the health, well being and quality of life of his family members may be minimal or catastrophic. To sanction such a nominal award for the loss of a husband and father to two young children and to deduct all collateral source payments is disgusting and insulting. As time marches on and places more distance between the horrific events and the enormity of September 11, 2001, it will become easy for those who have not been directly affected to forget and become complacent. The discrepancy between the original intent and language of the statute passed into law in September and the regulations promulgated in December bear testimony to this. The American people and its elected officials cannot afford to forget and must take care of these families. To forget will leave us vulnerable to future attacks and destroy our way of life and to fail to fairly compensate these families would be to perpetuate the injustice we have suffered. As American taxpayers, forgetting that we have suffered a tragic loss, we are outraged that our government, the most respected democracy, governing the most powerful country in the world, fails to take care of its own people while continuing to feed, clothe, and perhaps, even to educate the Afghani people. It is time to put Americans first, to take care of our own at home before spending billions overseas. What type of a message is sent to the American people when Americans killed on our own soil, innocent victims of terrorism are not provided for and are even penalized? We cannot buy the goodwill of the people of Afghanistan, but we must provide equally and without bias to the victims' families. Finally, as information pertaining to the plotted events of September 11, 2001 becomes available, it is clear that the FBI, CIA, FAA and the airlines all bear responsibility in their failure to prevent, detect, and stop the attacks and in their failure to protect the American people. All of these entities had a duty to be vigilant and must be held accountable. We urge you to do the right thing, to make us proud and to honor those lives that have been lost, to provide for those innocent children who have lost a parent, to compensate each family fairly by removing the salary cap and the reductions from all collateral sources from the proposed regulations. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The purpose of the fund was to equitably compensate the victims' families and deter them from suing the airlines. At a meeting I attended about a week ago the special master of the fund led us to believe that economic loss, plus a 250,000 amount for non-economic loss would be used in the calculation.Economic loss would be annual earnings over a period of the persons working life [to age 62] Our son was 38 and earning approximately 30,000. Assuming he worked until age 62 he would have earned approximately 720,000 before any earnings adjustments for increases, etc. Based on the published tables figures, including 250,000 non-economic loss, we would get approximately 411,000 before any collateral offset.That would make his earnings loss worth 161,000 for 24 years-6400 peryear. That seems to be totally absured and unfair. In addition if he had one dependent child his award would be 594,000 instead of 411,000. The difference in the award should only be the non economic amount of 50,000. Since he did not have a child he is being penalized on his economic earnings. In addition, the total of this award must be reduced by any insurance proceeds. My son had a 50,000 policy provided by his company and 50,000 from workmens compensation. Reducing the award by that amount would net approximately 310,000. Is that amount what a 38 year old persons life is worth ? This award amount is totally inadequate and unfair. In our time of grief when the government is supposed to be helping us reach a quick settlement they are doing nothing but creating more aggrevation. for us. Wednesday, December 19, 2001 7:20 AM Benefits December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
