I just heard this from a source I usually consider very good, but this is hard to believe. Allegedly the justification was that if state law discriminates against gays, the the fund should follow suit. This makes no sense - the fund is not administrated by, funded by, or in any way connected to state government, and should be free to be handled BETTER than the states manage. However, the purpose of the giving public was to make those directly affected, that is the victims' families, financially whole and NOT to enrich them at the expense of the American taxpayer or those making donations. I understand that the law as it now stands clearly requires that fund awards must be reduced by any collateral sources of compensation received by the victims' families. And while the law specifies life insurance and pension benefits as collateral sources it makes no specific mention of charitable funds. I would suggest that it is implied and charitable funds like any other source of benevolent financial assistance that is meant to offset and protect taxpayers and charitable givers from "double dipping" by families, seeking additional reimbursement for expenses or awards already covered, received or to be received in the future. I would also propose that a small commission be established consisting of an odd number of members, no less than five (5) and no more than nine(9), to oversee the fund. Any award would require the approval of the majority of the entire commission and that commission would have the responsibility for interpreting and enforcing the fund's rules and deciding final awards, without any appeal process. Sunday, December 22, 2001 5:27 PM Equal Access for All Victims December 23, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. December 22, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I am a the parnet of a lesbian and KNOW for sure that if my daughters partner was lost that the household income would be cut by at least half, how could my daughter support the house she lives in. Wednesday, January 16, 2002 11:16 AM dissatisfaction with fund My husband died on 9/11 in the north tower of the world trade center. I consider his death to be the fault of the airlines, the airline security companies, the FAA, etc. (I'm sure a good lawyer could come up with a dozen more). Under normal circumstances, I would have the right to sue those responsible agencies. However, on September 22, Congress passed airline bailout legislation that effectively took away my right to obtain compensation in a court of law. The victims compensation fund was established to placate victims families for the loss of this right. Many people have expressed outrage that the american taxpayers are going to foot the bill for compensation of the victims families. They should be made to understand that the american government themselves offered - so that they could save the airlines. This fund is a payday for anyone who earned a low wage and did not have life insurance. However, the majority of the people in those buildings were earning well above the national average and were well educated enough to understand the benefits of life insurance. The present rules make this fund nearly useless for the majority of families. The deduction of collateral sources, combined with the stingy amounts being considered for economic loss, mean that I would get NOTHING from this fund. Surely that cannot have been the intention of this legislation. Please change the rule so that it fairly compensates families who have already had to endure unimaginable emotional trauma. Nothing can bring back my husband and the father of my children, but I beg you not to make me spend the rest of my life wondering how to provide for my family. Thursday, December 27, 2001 1:56 AM Victims Compensation Fund After seeing several family members of the victims of 9/11 and their lawyers on Fox News I am further convinced that this fund is a mistake. I am appalled that apparently this fund was established and funded with tax dollars. Of all the tragic deaths that occur every day why was this group of people chosen to receive tax payer "welfare". My dad died tragically when I was thirteen and my mother got a job. We weren't aware that the government "owed" us a million or so tax dollars. Is it to late to apply? As to the Airlines going broke. This is the chance we take as shareholders. Will we use tax payer dollars to pay off the shareholders of Enron? This is a terrible inequity to the taxpayers. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families.
