This importantly should include the partners and children of same sex unions. Saturday, March 16, 2002 6:22 PM 911 Fund Discrimination To whom it may concern: I am outraged over the recent decision to deny beneifts to American and Non-American citizen's affected by the unmentionable acts of September 11, 2001 based upon the sexual orientation of deceased individuals. Let it be known that millions of people and organizations that sent money did so with the idea of assisting those that were in need as a result of the attacks on our nation. I do NOT believe that when they wrote out those checks, pledged money via credit cards, etc. that they were concerned with what individuals were doing in the bedroom and in their personal lives as they sealed their pledges. If the 911 Fund begins determining rank of life based upon one's sexual orientation for compensation purposes, how much differ are they than the malicious killers that took so many lives on the 11 day of September in 2001? When you think about it...there isn't much difference. These are human lives, and yes, even fetuses, that died that day. If one is compensated, then all should be equallyed viewed as having lost something that day. Sexual orienatation does not determine one's years of guilt, grief, saddness, and agony of those that lost loved one's that day, why should the federal government. I, for one, can honestly say that if I had foreknowledge that the "fund" was going to discriminate dispersing monies to various victims based upon one's sexual orientation and look past their needs, I would have kept my dollars. As you've already known that the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I hope you will apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. My mother &nbsp&nbsp&nbsp&nbsp was one of &nbsp&nbsp&nbsp&nbsp most dedicated employees. She worked for &nbsp&nbsp&nbsp&nbsp for more than 18 years. &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp The minimal salary she received kept us afloat for many years as she struggled to keep her head above water. This woman raised me all by herself from the age of sixteen to my mid twenties. We had a wonderful relationship and I refused to leave her all by herself to live alone until I got married. She was an extraordinary woman who was admired by all who knew her, for her inner strength and sense of humor. She taught all her children how to respect and love ourselves above all. For we could never love others until we truly loved ourselves. She was the true matriarch of our family and the center of everything we planned. So without hesitation, my eldest sister &nbsp&nbsp&nbsp&nbsp quit her six-figure job in Manhattan to take care of my sister and her children. &nbsp&nbsp&nbsp&nbsp has three children of her own and she has had a very difficult time dealing with this horror. &nbsp&nbsp&nbsp&nbsp and my mother were more than just mother and daughter, they were great friends. We all have been scarred by this event. I myself, witnessed the fire and collapse right in front of my own eyes from my office building in Manhattan. When the buildings collapsed I dropped to my knees in front of all my co-workers and balled my eyes out. That image of the building collapsing is burned in my memory and appears whenever I close my eyes. I recall walking aimlessly through Manhattan that day, walking downtown as thousands walked past me going uptown. I was scanning every face that passed me, hoping to see her beautiful face. But I never did and I know I will never see it again in this life. We still have not received any remains either. My sister's and I speak on almost a daily basis and try to help each other through the sheer insanity. On September 11th my family members were victims to one of the most heinous crimes in the history of the world. Then on December 20th we became victims for a second time. This time, by our own government that I love so much. The mere pittance that the government thinks my mother's life is worth, is an insult to our family and should be, to all of the caring and thoughtful Americans who emptied their pockets to help the victims families. With regard to the unbelievable outpouring of monetary support, I just want that thank the American people from the bottom of my heart for caring so much. But I also would like to apologize to them, and tell them that their good wishes may not have reached the people they intended to reach. From what I hear in the media approximately $1.4 billion has been collected from the public so far, my family to date has received approximately ??$20,000. Seems to be a little problem with the math here huh? Let's see?$1.4 billion, 3,500 or so victims should be about $400,000 per family right? Seems as if the charities use the same mathematical calculations that the government used in figuring out the "Victim Compensation Fund". The presumed payouts from the Government's Victims Compensation Fund are an utter insult and I take major offense. I keep hearing about the average payout being $ 1.6 million per family. Well let me give you the actual figures. According to the charts provided yesterday, our government feels that our mother's life is worth $250,000. The other thing I think that needs clarification is the fact that the government is not giving a "gift" to the victim's families. The government knows that the airlines were negligent. The airlines did not provide the proper security to prevent these animals from boarding the planes with knives in the first place. They did not provide a cock pit door that was impenetrable. Have you ever seen those cockpit doors? I had a stronger door on my tree house as a kid. If they can't get in the cockpit, they can't crash the planes into the WTC and kill 3,000 people. It's that simple. It is all about profit, and the airlines did not want to eat into their profit to provide these safety measures that would have prevented this catastrophe. THAT IS WHY THEY ARE NEGLIGENT AND THAT IS WHY THE GOVERNMENT BAILED THEM OUT. The government knew that if they didn't step in, the airlines would go bankrupt. The other little caveat the government snuck in under our noses in the Airline Stabilization Act is a cap on the liability to the airlines. Meaning, if we choose not to accept this "offer" and choose to sue the airlines, then the cost to the airlines would be minimal. This is unprecedented by the way. Now back to the offer by the government. I do not argue with the economic compensation part of the award. Which you see many greedy people on TV challenging. I do not even argue the fact that my mother's portion of that amount is only 50,000 compared to the millions that others will collect. I do not even argue that. What I do find the biggest insult of this offer, is the non-economic portion. The government states that for the pain and suffering this has caused all of us we are entitled to $250,000. Which will be reduced by the amount of my mother life insurance. Correct me if I am wrong but when was the last time a settlement in a negligence lawsuit was reduced by the victims insurance. I'll tell you NEVER!!!! That is money that my mother paid out of her own pocket for. The airlines didn't pay her premiums, the government didn't pay her premiums. The thing that gets me so upset is the fact that I personally know people who have settled lawsuits for minor car accidents that caused them to miss a few weeks of work for more than $250,000. And these settlements were purely for pain and suffering. THESE PEOPLE ARE STILL ALIVE. My mother was a victim of possibly the most hideous crime in the history of man. And the airlines and the government were asleep at the wheel. How can the government possibly compare a minor car accident to this cataclysmic event? I personally, can not even put a figure on the physical and emotional damage that has befallen my family. I am not saying that my mother should receive the same amount as others. After all, most of the people who perished were the sole breadwinner in their homes. These people need to be taken care of first and compensated at a higher level than my family. I know what's right and what's wrong. When someone contacted me from the &nbsp&nbsp&nbsp&nbsp , I stated that I refused to take any money until all the mother's with children were taken care of first. Which is exactly what they did. This is not a matter of greed it is a matter of respect. I think the American public needs to know the truth about how this "offer" insults the families of the older people involved in this tragedy. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I have read many of the comments that have been posted . I have also written letters to The Attorney General of N.Y.,the Governor of N.Y., My State Senators and I have spoken to my attorneys. I am the fiancée/Domestic partner of a victim from the WTC attack. Apparently there are many other people in the same situation as I am ,which is not knowing if we will be part of the claim process. The woman I love was brutally attacked and murdered just as all the rest of the victims were. and I were as much married and dependent on one another as anyone else who actually was married. We supported each other emotionally,financially and spiritually! We cared for each others families without hesitation, We lived life for each other as soul mates . We were inseparable except when we were at work . My pain my grief my loss is something only the other victims families could understand. There is no way to describe what has happened to all of us . Wednesday, January 09, 2002 3:15 PM Interim Final Rule/Economic loss calculation Dear Mr. Feinberg: I believe there may be at least one significant inconsistency between the provisions of the economic loss calculations as set forth in section II(A) (1) and the precise language of the enabling statute. The guidelines apparently utilized by the Justice Department to calculate economic loss in Step One of the section referred to above state "This projected future income is adjusted to account for taxes that would have been paid. This calculation uses the effective state, federal and local income tax rates currently applicable in the state of the victim's domicile for tax purposes." Having evaluated, negotiated and litigated several thousand wrongful death cases in New York and many other jurisdictions over the last thirty years, I am aware that there are several jurisdictions that do not allow for the deduction of federal, state and local taxes from gross income in computing the net economic loss. New York, the last time I looked, is one such state. (See Woodling v. The Garrett Corporation, et. al., 813 F. 2d 543 (2nd Cir., 1987)) The legislation in question directs the Special Master to determine "economic loss" ...to the extent such loss is allowed under applicable law." Decided case law clearly indicates that "applicable law" is applicable state law, not federal law. If that latter phrase is interpreted to apply to the entirety of that paragraph, and the Congress could have been more specific if it were not to apply to the whole paragraph, then the statute requires that taxes not be deducted from gross earnings in determining net pecuniary loss in most of the cases in question. For a 30 year-old decedent, this tax deduction greatly reduces the available award. Dear Mr. Zwick: I am writing in response to the Departments request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other.
