Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. There was so much pain, and still is, during the 11th as I first listened on the radio, on my way home from work, as it was reported that the building that my brother worked in collapsed, and later, as I sat with my parents and watched in horror the events that unfolded on television. My brother has a wife and two children, that were less than three years old in September. They must be taken care of. However, my parents raised my brother, cared for him as a child, relished in his victories of later years, encouraged him through his defeats. As a sister, we shared, family vacations, cheering for each other during sporting events, encouraging each other towards success, double dating, and discussing everything from relationship of the moment, which skis were the coolest, how far we would run tonight, where to go out that evening and what time we would meet, and how to select a school for our children. Because of all of this, although there is an expediency issue in dealing with multiple representatives of any family, I believe that it is important for the Department to consider the significance of the loss of a husband, wife, father, mother. However, the Department should not ignore the significance of the loss to a mother, father, brother, or, in my case, sister. I understand that there must be a systematic manner in which to administer this fund. However, in choosing to deal with a single representative of a victim, it is evident that the Department has already foreseen the potential for conflict. This has been an emotional time for every survivor. Why not avoid further distress, keep all survivors involved in the process, not just a single family representative. Although this event has worked to make many families pull together, supporting each other. The potential of a single family representative may push many families apart. As to drawing distinctions regarding the location of the death, I do not understand the significance. My brother was located on the floor of wtc tower 2. He worked for . Although I try not to imagine what happened to him following the impact of the United Airline flight, it is impossible for me not to try to imagine. It is probably better for there to be no distinction, preventing those survivors from further imagining the circumstances of death. And does it really matter, dead is dead. As to where the location of the death occurred, is that really important. Collateral sources should have no direct impact on the amount of compensation received. My brother worked very hard in life. In his death, should his survivors be penalized. Do you think that people made contributions to his family, knowing that this may reduce the amount of compensation that his family may eventually receive. I know that this document has been moved forward quickly in order to help the survivors of this terrible, tragic event. I hope that in continuing to move this process forward, the Department will continue to be diligent in your efforts. However, I also hope that the Department will be cognizant of the need to be sensitive to the families of the victims, limiting the amount of stress that they must continue to undergo throughout the duration of this process. I have personally contributed several hundred dollars to a charity for the victim's families. Employees in our company contributed several thousands. We did so out of compassion. We wanted to ease at least some of the financial impact of the losses suffered. It made those of us who gave to charity feel good to help in any small way. Now many of the victim's families are complaining about the amount of money they will get. People who will be getting a $1,000,000 insurance payment complain that this reduces what they will receive from the government. The concern of many seems to have shifted to money. In many cases it sounds like greed. It makes those of us who gave to charity sad. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Wednesday, November 07, 2001 1:44 PM Comments concerning the Victims Compensation Fund Please accept the following comments concerning the Victims Compensation Fund. I have read several news articles concerning the Victims Compensation Fund (the "Fund"), many of which indicate that this Fund will be difficult at best to administer, and which, when looking at how funds could be doled out, would ensure that many families would actually receive nothing from opting into the Fund. I lost my oldest brother in the WTC terrorist attacks. He was a trader with Keefe, Bruyette and Woods. He left behind a wife and three teenage children who we anticipate will attend college. As a result, our family has been advising my sister-in-law to seek that recovery which can best provide for the well-being and financial security of her and her children. I have several comments concerning how I believe the Fund should operate to ensure this. According to some of the initial information on the Fund, the government will be subtracting any collateral sources from any amount which the special master would award. My brother acted responsibly and purchased life insurance (paying premiums) for his family which the government now would like to penalize him for and reduce any Fund award accordingly. As for charity funding, this will not be an issue since my sister-in-law has received virtually nothing. However, once you subtract any insurance proceeds, the government is practically ensuring that my brother's will get nothing. I do NOT believe that any collateral sources should be applied to reduce the amount that the victims' families should get. I believe the government should also promulgate a scheme which is similar to that which a litigant would be afforded in a civil personal injury or wrongful death claim. The amount awarded as damages should encompass all funeral, burial and estate administration expenses incurred, as well as an amount that will fairly and adequately compensate my brother's family for contributions they would have received between the time of his death and the end of his life expectancy such as future lost wages. My brother's gross earnings, including all fringe benefits between the date of his death and his life expectancy, must be factored in. Additionally, all moneys that my brother would have spent for or given to his family for such items as shelter, food, clothing, medical care, education, entertainment, gifts and recreation, taking into account his salary and age, must also be considered. The amount awarded should also consider the comfort and friendship that he would have given to his family had he lived and such other elements as work around the home and provisions of society and comfort. Additionally, a component should be added for the physical pain and suffering endured by my brother at the time of his death as a result of the wrongful conduct of numerous parties and/or potential defendants. Furthermore, the amount awarded by the Fund should be intended to restore my brother's family's loss and thus should not be considered as "Income" which is taxable by the federal government or the states. At present, the government is also demanding that families who opt into the Fund forego the right to sue without giving them any kind of idea what they can anticipate at the other end. Without a skeleton scheme in place concerning what factors will be looked at when reaching a settlement, the amounts awarded could be completely arbitrary based on the special master's whims on a particular day. I have read the the Fund provisions would also make such award decisions unappealable. Would you recommend that your client settle a claim without having any idea what kind of settlement you are actually recommending to him or her? No competent attorney would do any such thing as it would be legal malpractice. The families need to be fully aware in advance what they can approximately expect to receive based on an analysis of the above factors. Only then can the government ensure that there will be an incentive for the families to sign onto the Victims Compensation Fund. It is my hope that the above will aid in your analysis and will echo the sentiments of many families that are in the same tragic situation as my brother's family currently is. Friday, December 21, 2001 11:05 AM Compensation for the 9/11 Victim Families This may sound crass and unpopular in the wake of the tragedies of 9/11, but I am offended by comments in a news article by victims' families who are quoted as saying the payments being offered are "not enough" and insulting. Who do they people think they are? I think this is a most generous gesture on the part of the government and should be appreciated rather than scorned. I can't fathom their loss, but money won't bring anyone back. To think they believe they are entitled to any more than any other victim of a disaster is mystifying and offensive (and I believe they are being offered much more). People all over the country have donated millions of dollars to assist them, millions more man hours of volunteer work has been bestowed upon them, when will they feel like they have been "fairly compensated"? As we speak there are soldiers fighting the war on terrorism, diligently and with great cause. What do these people think the lives of these soldiers are worth? What compensation will the young CIA Agent's family receive other than the "standard" death benefits? Did any of them campaign in support of compensation to the Iran Hostages, the civilians killed and injured at Pearl Harbor and what about compensation for the Okalahoma City bombing vitims and their families? I didn't hear a ground swell of support for the survivors of those tragedies. We are a country and unified by what we are and who we are. The sense of entitlement espoused here is disgusting. Perhaps these people should be more appreciative of the generosity of the American people and less materialistic. I work hard, I invest and I try to make a better life for my family. Somehow, I can't help but to think that the money being offered to the families is more than enough to provide for them comfortably. Perhaps this display should cause us to look more closely at our value system and maybe, just maybe we will better appreciate the principals this country was founded upon. Perhaps contrary to popular opinion, I support the government's position and offer to the victim's families. I think it is most generous and should be viewed as such. I would also note I direct my comments at those categorizing the government's offer as insulting. Thursday, March 21, 2002 11:01 AM anti-gay discrimination is un-American Dear Sir/Madam: In a recent appearance on NBC's "Meet the Press," Kenneth Feinberg, the head of the September 11th Victim Compensation Fund, said that lesbian and gay partners of people killed in the terrorist attacks of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones. This kind of discrimination is un-American. The unfairness of this policy is especially blatant since those administering this fund have decided to award benefits to illegal immigrants, non-citizens who are in the US in violation of federal law. Mr. Feinberg said that the Attorney General has promised not to expel illegal immigrants who come forward to claim benefits, or to penalize their employers. Under the circumstances, this type of generosity is commendable. But if the law can be bent to help illegal immigrants, as it should be, it should also be bent to help lesbian and gay partners who lost a loved one in the terrorist attacks, regardless of what the laws in their places of residence say about domestic partnership or civil unions. We're talking about tax-paying US citizens here. Gay heroes like and died in the attacks. Their bravery demands the change of this outrageous and un-American policy. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die... Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise about that ever..."We request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that compensation for pain and suffering more accurately reflect that horror which was suffered. I have no doubt that the government has good intentions and is motivated for all the right reasons, but this program is not the answer. It is not right. It has no precedent. And it is unfair to all the victims and all the families of victims before the attacks of September 11, 2001. Believe me when I say I grieve deeply for all the families of the victims of the terrorist attacks, which resulted in the deaths of thousands of innocent civilians. I served 21 years in the U.S. military and I know the sorrow and pain these families must be feeling, but consider these points before the government (albeit with good intentions) sets out to make perhaps thousands of next of kin/families millionaires courtesy of the U.S. taxpayers. 1. How much monetary compensation should the government provide to families who may also receive life insurance benefits? 2. How much monetary compensation should the government provide to families who may also have investments and savings at their disposal? 3. How much monetary compensation should the government provide to families who may also receive monetary awards from any of the various non-profit, charitable, philanthropic, or assistance organizations that have raised large sums of money and are distributing it to the victims? families? 4. Is it really the governments responsibility (and is it the fair/right thing to do) to make all these families (potential) millionaires? 5. How much compensation is too much? 6. When has this been done in the past? 7. What is the precedent are we setting? 8. This type of compensation has never been awarded to the families of military personnel who died in the line of duty. Admittedly, military personnel know the risk when they put on the uniform. Innocent civilians died on September 11, 2001. But are the families of military personnel any less worthy? U.S. military personnel are dying right now in the war on terrorism. Their families will get SGLI. Their families won?t be made millionaires. 9. Shouldn?t the American people take care of these families (voluntarily and to the degree they are comfortable with) through their donations to the various philanthropic organizations or through direct assistance to these families? This shouldn?t involve the government. Let the people handle it. If the government wants to help, then do whatever is necessary to ensure this kind of attack never happens again. 10. These families deserve our help, our care, and our assistance. Not a free ride for life (courtesy of the U.S. taxpayers). This program is a slap in the face to all the victims? families before September 11, 2001. It also serves to trivialize the lives of the victims of the terrorist attacks by attempting to assign a monetary value to their lives through the use of a mathematical equation (or worse yet by assigning it an arbitrary monetary value). Don?t let your sympathy and zeal to help the families of the terrorist attacks misguide you into doing something inappropriate. This program is wrong! Saturday, December 22, 2001 11:27 AM September 11 Victims Relief Fund December 22, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
