As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Friday, March 15, 2002 9:36 AM Victim Compensation for Gays and Lesbians I wish to voice my complaint about the comments from Meet the Press this past Sunday that I have been reading about. For the head of the fund to say that violations of our own immigration laws will be overlooked to provide for compensation to victims and families of victims and then to say that the hands of the funds will be tied by state law as far as compensation to families and domestic partners of gays and lesbians goes is outrageous and clearly demonstrates the discrimatory intent of the compensation plan. This needs to be addressed and changed. One of the victims from the restaurant located at the top of the world trade center was a gay man with a domestic partner. He and his partner had lived together for many years. He worked that job so that he could support his domestic partner in a new business. Because of his death, his partner has lost his home and has had to declare bankruptcy, forfeiting his business. If this were a married straight couple, or even an engaged straight couple, I am sure that compensation would be provided for. This discrimination is outrageous and wrong. I know that I am far from alone in this view. It is a shame that you have marred such good intentions with prejudice and hatred. Stating that benefits will only be provided in accordance with state law is ridiculous, as only one state, Vermont, legally recognizes homosexual domestic partners. Surely this is known to the Fund and is a lame excuse to promote discrimination. Especially when federal immigration laws are being overlooked in the exact same circumstances. Sunday, January 13, 2002 3:23 PM (no subject) I have been very disappointed in the manner in which the United States Government has been portraying the Victim's Fund as a kind gesture by a caring government. Immediately after the atrocity on September 11th, our government passed legislation to bail the airline industry out. They recognized that the massive amounts of lawsuits would cripple the industry. This fund is to save them and not to compensate the victims who were killed because of the airline's and the government's negligence. To further penalize these victims the government has decided to deduct private insurance payout and social security payments. Both of these plans were self-funded and should have no bearing on a settlement. The United States Government has let us down terribly. I have just finished reading an article where Kenneth Feinberg stated that he will follow each states individual laws on homosexuality when it comes to distribution of September 11th Funds. At a time when we are all pulling together to comfort and reassure each other while workng to rebuild and revitalize an already divided nation, the September 11th Fund should be leading the way with equal distribution of benefits despite the controversy of gay unions. I understand that there is currently a proposal to allow common law spouses to collect compensation from the September 11th Victim Compensation Fund of 2001. I am writing to voice my opposition to those proposed changes. I oppose the proposed changes for two reasons. First, while marriage is a big step, it is a simple procedure. That a legal marriage did not occur should suggest that at least one of the two did not want to get married. My second reason for opposing this is that my father lived for his children. Should this woman be able to collect as a wife, that would significantly reduce the compensation my fathers children would receive. I know in my heart that my father would not want his children to suffer further. Please do what is best for the children of the victims of this painful event. Keep in mind that we can never replace our father or mother, sister or brother, son or daughter. But we can change husbands or wives or people we choose to live with and consciously decide not to marry. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Adding to, or creating another inept/bloated and self-serving government bureaucracy to administer this fund, would be ludicrous. Turn the money over to a non-profit private service group. One with integrity that is in business to serve the public, instead of itself. Like anything government, the Red Cross and United Way have proven themselves unworthy of the public trust. These two large private groups should administer none of the money. It is nice to know that there is a real person on the other end of this note, who cares. I read in USATODAY that congress is likely to pass a bill which allows for a larger estate tax exclusion for the victim's families. We are all VERY grateful for that recognition. In our case there were credit card benefits which were mandated by the insurance company to be paid to the estate of both our parents. This caused us to be exposed to estate taxes. Normally, we would of had the benefits paid to a beneficiary directly avoiding these taxes. However, this estate planning issue was missed in my parents estate planning process. These things are so rare that it was just overlooked. So we are glad that congress is recognizing this. Additionally, You may want to realize that by reducing our benefit under the "Fund" by the amount our parents had in their estate or was received by insurance would only force us to go another direction in compensating our family for the loss we had. Thereby defeating the main role of the fund i.e. creating a system to expediate the legal process and get this whole thing behind our nation. I extend my thoughts to you openly.
