However, I am tired of hearing them complain about how much or how little money they will be getting. They are getting a gift, a gift that those in Oklahoma City did not get , nor anyone else. Tonight on TV I heard a mother of a victim, who was a grown, independent son, complaining that she would "only" get $250,000. She was not financially dependent on her son for anything. He was only financially responsible for himself. Yet she feels that $250,000 was not enough. I am 53 years old and if I were left a widow I would be happy for any amount of money that was given to me from a fund that I did not contribute to. Failure of local and state authorities to devise an organized, equitable means of disbursing donations is lamentable. NO GOV'T FUNDS should be released until the private contributions have been unified and qualified survivors made fiscally whole with private funds, insurance policies, public servants' killed in action benefits, etc.. This has turned into a money grab. I realize it is our own fault since we started calling them victims since day one. They are not victims -- they are survivors. Sunday, January 20, 2002 12:40 PM Funds dispersal I believe that most Americans feel that all each life lost in the WTC attacks was equally precious and valuable, and I would like to see the funds dispersed equally, minus insurance (but not pension) payments. This was a tragic but unanticipated event--much like the KC bombing or any accident. I do not feel that those who were financially better off merit lifelong support for the lifestyle to which they had become accustomed any more than the families of others killed in similar events. Inequal distribution unfairly disadvantages the families of the younger worker who may have just begun a career, the lower-level employee who may yet have risen above his or her station, and those lower paid workers who were closer to retirement age. It advantages those who were fortunate enough to have put money away, invested well, paid off their house, etc. Please deduct insurance payments over a reasonable amount and divide the funds equally. It is the only fair way. Specifically, I would like to comment on the area that relates to "Physical Harm". I worked in 2 world trade center along with my Brother and Sister-in-law. We all worked for . On September 11, I severely hurt my back (2 herniated disks) and my neck running from tower 2 as the plane hit the building. Needless to say I did not get home until late the evening, only to learn that my Brother and Sister-in-law were missing. My next day was spent working the telephones; calling various city agancies looking for and . Sadly, they were both killed. For this reason, I did not see my physician until September 13. According to the interim rules of the fund, I would not qualify because I did not see a Doctor within 24 hours. I feel that this criteria is too restrictive and unjust. I have never suffered any prior back or neck injuries and have been out of work on Workmans Compensation since September 11. I request that the Special Master, Mr. Feinberg, change this rule so that honest injured victims like myself can use the September 11 victim Compensation Fund. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. But let's not selectively choose which laws we're going to bend when it comes to the September 11 relief fund. Bending the rules for unborn fetuses and illegal immigrants is all well and good, but to then turn around and hide behind laws and "states rights" to deny gay and lesbian people the same relief as EVERY OTHER AMERICAN is more distasteful than a mouth full of embalming fluid. (Isn't it interesting how conservatives love to tout the "gay agenda" as being all about "special" laws? Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The deaths on September 11th were the result of an attack on America and all of its citizens. Please do not discriminate against any of those citizens. The unmarried partners of September 11th victims are particularly at risk. In today's world, there are many definitions of relationships - especially in a city as crucial to the US as New York. Also in a city such as New York, the cost of living dictates a sharing of expenses. With one of those partners suddenly taken by the tragic events of September 11, many many people in such relationships are facing severe hardships. Wednesday, January 30, 2002 12:35 AM Victim Compensation I feel that it is entirely appropriate that any payments from this fund first be adjusted for any insurance, pension or other payments that a victim's family may be entitled to. There should be no reason for anyone to get compensation from this fund, other that expenses for burial etc., for any minor that may have perished as a result of this attack. The families of any government workers who lost their lives will be compensated by the agency they worked for, any union affiliation insurance program, the State of New York and the federal government.
