DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." His name is and he worked for on the floor in WTC1. He only lived to be 25 years old. His career prospects could not have been any brighter and the scope for promotions and earnings potential was phenomenal, but that was before September 11. I am writing to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private fund available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actual suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive nothing from the fund under the interim final regulations. DOJ's formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range of non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent. In a wide variety of air crash and terrorism cases, however, judges, juries, and mediators commonly have provided non-economic damage awards well into the seven-figure range. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable worklife and life-cycle earnings data. DOJ greatly underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. The interim final regulations also arbitrarily cap a victim's income at $231,000 a year. Combined with the faulty methodology described above, the income cap would result in some families receiving compensation for less than 25% of their actual economic losses. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits. We do not believe these are the outcomes Congress intended. Please contact Attorney General John D. Ashcroft and Special Master Kenneth R. Feinberg and tell them of your concern that the interim final regulations fail to conform to the language and intent of the act. With the regulations soon to become final, I believe that only the swift and strong support of Congress can avert unnecessary financial and emotional damage. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I read in a national news magazine that the deadline was November 30th but went to your website and read that it was November 26, 2001 for submission of comments. I would appreciate your consideration should I be late in sending this and am available to discuss my thoughts should you desire. I wish to offer suggestions as to how the billions of dollars in charitable and government grant monies should be disbursed. I have tried to consider as many of the constituencies I could identify as well as taking into consideration the obligations that we as citizens, both living and deceased, have to the American society (i.e. U.S. Government). The stakeholders I have considered are the donors, the recipients, the uniformed personnel, the state, local and federal governments as well as what I believe to be humankinds sense of fairness. I have contemplated the secondary and tertiary effects of the promises made in the wrath of tragedy, researched the financial payments made already, committed to and deliverable to the most high profile victims (i.e. uniformed personnel). Furthermore, I feel with frustration the burden of inequality that some families will be forced to bear should high-impact victims be compensated at a higher rate at the expense of those non-uniformed personnel (i.e. like the chefs/cooks at who worked for a subcontractor and have no medical benefits as of today). In this letter, I offer policy recommendations and methods to implement solutions that I believe will support the following: An American belief of being indivisible, just, and equal; A sense of offering compassion and consideration to the stakeholders; Expecting an accountable ?grant? process, and; Moderating the future economic obligations to the victims and the next generation of Americans. I begin by offering the questions that lead to my soul searching which motivated me write to you. Is it fair that some of the survivors of the terrorist attacks of 11-September become millionaires while others struggle to find medical care to replace that lost when the family breadwinner was murdered? How, you ask, are millionaires being created? Please follow along: One-time payments: $155,000 from Federal Law Enforcement grant $100,000 commitment from Mayor Giuliani from WTC Fund (due by Christmas) $40,000 estimated value of tuition (per child) to send victims children to college $295,000 Recurring Payments $50,000 (est.) Tax free Annual Pension for Life to spouse of Police and Firefighters based on prior years wages including overtime $18,000 (est.) Social Security payment to spouse (survivor annuity) $6,000 (est.) Social Security payment to each child (survivor annuity) $7,500 estimated value of annual health insurance premiums for family $81,500 annual annuity 40 years (estimated remaining lifetime of 38 year old female spouse) $1,026,444 Present value of $81,500 annuity payment at 7.5% for 40 years Please note that the numbers do not include United Way, Red Cross, NY City 9-11 Funds or any of the numerous other charitable funds set up for the benefit of the victims but which often target the uniformed personnel, which press reports have totaled to be over One Billion dollars. For instance, the NY Stock Exchange has a Nine million dollar fund just for the families of the emergency service personnel numbering about 400. This will be an additional $22,500 onetime payment that the cook, security guards and window washers will not be even considered for. I wish to depart from the cold, callous numbers above and ask you to consider this point: the survivors of a New York City UNIFORMED victim will collect more than $1 Million, while the cook/chef at might collect $25,000 and their family medical benefits ended today (November 30, 2001). Any onetime payments payable are yet to be determined. These non-uniformed victims who were not members of NYPD, FDNY will not be getting a tax-free income for life, most probably have lost their primary bread-winner and family medical care and, since they are disproportionately minorities, most often do not possess the ?spin? or personal fortitude to get on television with Bill O?Reilly or Larry King which would put them closer to the top of the charity list. What should be done Treat all equally by taking into consideration the time value of money, the economic value of all gifts (like tuition), the public defined benefit obligations (OASDI) already in place and the tax-free income lifetime income to firefighters spouses. The end result should be that all compensation to survivors should result in all deaths being valued equally. The final US government grant monies should be distributed regardless of the victim?s income, marital status or employment status at time of death and when totaled with all the charitable donations received by the Victim?s family, should be very near equal. For purpose of my proposal, this will be called and should be considered the maximum compensation offered to everyone, be they the dishwasher at making $7 per hour, a career civil servant at the Pentagon making $7,000 per week or the Bond trader at making $700,000 per year. For discussion purposes, I will call this monetary award the ?Victims of Terror Equality Reimbursement (VOTER) Grant?. What types of compensation comprise the Victim Equality grant? Tuition & other Non-cash Grants Offers have been made to pay the college tuition for children of victims. This offer should only be made available to direct and legally adopted children of the deceased, or those born by June 30, 2001 (to account for conception on the morning of September 11, 2001 and a 44 week pregnancy!) and should be payable only for the children to go to an accredited college of their choosing and ability. The maximum amount payable should be the average annual State University Resident tuition, including room and board, for all State universities in the US and should not be based on the annual tuition and board for Yale or Harvard. Structuring the tuition grant in this manner will not penalize those students that are not able to gain entrance into a Yale or Harvard by compensating them less and should provide comfort to those that do gain entrance into a private university, such as Yale, when a large portion of their tuition is paid for. Additional terms of the any tuition grant should be that it is renewable annually for a maximum of five years and should cease upon the attainment of 120 credit hours or completion of a Bachelor?s degree or equivalent, whichever comes sooner. All students should be held to a standard of fairness and no student should be allowed to take advantage of this tuition grant by delaying their studies or taking credit hours towards a post-bachelor?s degree. Furthermore, all students should be required to maintain an average of C or better in order for any funding to continue. The student should also be protected as regards other college funding that may be available such as Pell Grants, Student Loans and Work Study by not having this tuition grant offset the awarding of these college-funding sources. Cash This should be paid only after the considering and valuing of all non-economic gifts to the victims families and should include the economic value of all non-current commitments that have been offered to the survivors and the children of survivors. How do we strive for acting as one and being fair when your dealing with the memories of the victims of the terror acts of 11-September? I suggest that all grant monies be delivered to the victim?s family in the aggregate, taking an all-in approach and payable only to the dependents of the victims at the time of the victims death or to their estate if no spouse or children exist or survive them. A grant should not be paid based on the number of children dependent that were dependent on the victim. This need is met by the Old Age, Survivors and Disability Insurance program; commonly referred to as Social Security and to do otherwise would value the family circumstances of one victim greater than another. To base grants on the number of children would penalize those without children and equally to pay only those victims with spouses would penalize those without a significant other. The grant should be payable to a domestic partner equally as if they were a spouse but should not be increased to compensate for an employer not recognizing a domestic partner. All grant monies should be applied first to outstanding income and estate tax delinquencies, any outstanding Federally guaranteed student loans, payment of all delinquent child support payments and alimony in arrears and then any remainder to the surviving family/dependents. We should remember that others may have relied on the income of the victims of September 11th and address those needs on an equal footing with the surviving family. In the case of victims who may have had alimony obligations to prior spouses and those who may have had support obligations to children (from prior marriages or court ordered support obligations in the case of paternity), these obligations should be honored and defeased as part of this VOTER grant. However, no alimony payments should be made to a divorced spouse if the survivor was employed on the date of the tragedy; that is what life insurance is for. By these examples I wish to suggest that no economic incentives should exist in the grant administration process to expand the pool of applicants just because they have a feeling and sense of entitlement. To address the needs of ex-spouses and children that were dependent on the income of the deceased, an inflation-adjusted annuity should be set up to provide an income for these parties for the period defined in the original separation agreement or divorce stipulations. An administrative facility to manage this payment process already exists. For example, in New York State the Support Collection Unit already offers a collection and disbursement process for alimony and child support. This could easily become the administrative facility for the payment of annuity. Additionally, the Support Collection Units have audit processes in place that would prevent payments for alimony and child beyond the terms of the stipulation agreements. If the net present value of the total obligations due under the child support obligations exceeds the maximum of the VOTER Grant as defined above, then no funds should be disbursed to the survivors of the victim. To do so would be unfair to other victims and value one life more than another. We should not politicize our memories of the dead by turning this tragedy into a social reengineering and income redistribution project. I have been quite detailed in suggesting methods to actually implement any grant disbursements and thank you for your patience in time to read this. I hope I have given your agency some thoughts to consider as you implement a policy and guidelines to share the charity given by all Americans: an indivisible bounty of being one. Wednesday, November 07, 2001 12:04 PM a comment or two First of all, let me say that I think it's a very good idea to solicit comments on this very difficult topic. It is unprecedented and since there are no rules, having an open forum is a very reasonable approach. I plan on thinking about this some more but just want to say for now that: A formula should be developed to come up with what would be fair and reasonable for the survivors of the people who were killed and a separate formula for those who survived but who have lost their jobs and their homes and businesses. I think it is reasonable not to have to give out all the moneys that were collected for the 9/11 tragedy because it is very likely there will be further rounds of terrorism to come for which people will not be able to be so generous. I think it would be wise to consolidate all the charities (ex the fire and police) into one - possibly a Red Cross special fund because they are nationwide and that's probably what we'll need. I think the fire and police probably have sufficient funds to take care of their people and if not, can come to the consolidated fund later. I think that the federal government should be the provider of last resort because they need to spend whatever they can on protecting us and helping out in all the future crises. I hope this helps and will write again if I think of more ideas. Thursday, December 06, 2001 8:00 PM To whom it may concern, I am writing to say that I firmly believe compensation and financial relief for vicitims of the Sept. 11th terrorist acts should go to the partners and non-biological children of the gay and lesbian Americans killed in the attacks. Fairness in providing financial relief to survivors of these deceased tax-paying Americans is the right thing to do. Arguments against doing so are divisive and unfair to the memory of all of the victims of Sept. 11. The U.S. political system is based on equal rights for all citizens. Discrimination in death after such a terrible tragedy is not the right message to send to the survivors of the deceased or to Americans at large. It would go against the grain of all tenets of basic fairness and equality. Finally, as has been publicized in the media, at least one of the passengers who rushed the hijackers on the Pennsylvania plane (i.e., ) was a gay man. He gave the last moments of his life to save other Americans. And in this matter, he was successful in preventing an even larger tragedy and even more deaths. It is only fitting that legacy also be honored in such an act of basic fairness as that involved in providing relief to survivors and not discriminating among the survivors. Wednesday, December 19, 2001 8:11 PM Re: Sept. 11th Rules for Distribution of Funds December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Remember: one of the heroes of the flight that crashed in Pennsylvania was , an openly gay man. He wil be remembered as one of the greatest heroes of our nation's history by preseving democracy on the plane (they VOTED to stage a counterattack) and sacrificing his life to save other citizens in our nation's capital. Monday, March 11, 2002 11:21 PM The September 11th Fund Dear President Bush, I was amazed and dismayed at the decision of Kenneth Feinberg relating to how he intends to recommend the administration of funds for the victims of the disaster that befell this country six months ago today. I gather, from some news accounts I've read, that he intends to "follow state law" in terms of recognizing gay and lesbian relationships when deciding whether or not to grant relief to those families. Mr. President, he knows, you know and I know that the State laws to which he refers nearly unanimously declare those relationships void and valueless and, consequently, he's permitting (hoping for?) them to be his 'cover' for not granting benefit to these victims. President Bush, you and I were once distant colleagues - you on the Board of Directors of and me as its Chief Financial Officer of the Southern Division in 1992 to 1995. At that time, I trusted your judgment as a member of our Board of Directors and I hope that I can trust your judgment again today to overturn Mr. Feinberg's decision.
