The idea is to be made whole, not rewarded. And the recipients of government payments should pay any attorney fees. Paying attorney fees is for a party at fault. AG Order No. RIN:1105-AA79 COMMENT ON THE INTERIM FINAL RULE The undersigned submits the following comments concerning the Interim Final Rule issued on December 21, 2001. I am hopeful that these comments will be helpful in assisting the Department in making the process fair and equitable for all the victims' families. Introduction In the immediate aftermath of the tragic attack upon our nation on September 11th Congress enacted the above referenced legislation to compensate the relatives of the victims of that brutal attack. The interim rules issued by the Special Master on December 20th fail to satisfy the letter or the spirit of the legislation which was enacted. It is my understanding that Congress encacted this unprecedented legislation as a means of aiding the families of the murdered victims by, in some small way, compensating them for the tremendous losses of their loved ones; as well as protecting the airline industry from huge losses and bankruptcy, thereby insuring their very survival. The legislation authorized payment for economic and non-economic loss. Economic loss was defined as "any pecuniary loss...including the loss of earnings..to the extent recovery for such loss is allowed under applicable State law."(Sec. 401(5)). Non-economic loss was defined to include among other things "physical and emotional pain, suffering...metal anguish...and loss of consortium." (Sec.402(5)). The sole offsets to the payment for economic and non-economic loss were the "collateral sources" specified in Sec 402(4). These included "life insurance, pension funds ... and payments by Federal State or local governments related to the attacks of September 11th."These were clearly intended to be the only offsets. PAIN AND SUFFERING In his proposed rules, however, the Special Master has imposed offsets which are in no way authorized by the statue. Specifically, he imposes arbitrary income limits and restricts pain and suffering awards to $250,000-no matter what the extent of the pain and suffering may have been. Such a cap is unrealistically low when compared with awards in cases involving airplane accidents, which awards are usually at least ten times that amount A review of the "911" tapes of calls coming from the top floors of Tower One would certainly indicate that those victims were surely aware of their hopeless situation and suffered a horrible death. Thus, the award for actual pain and suffering must be increased to recognize this fact. These victims did not knowingly put themselves at risk and in harms' way and to treat their pain and suffering differently from other airplane accident cases is patently unfair and unreasonable. Therefore, at the outset, the Rule should follow Congress' clear intent in enacting the Law providing for the Victims' Compensation Fund. As presented the Rule creates inconsistencies and results which were not envisioned or intended by Congress. For example, collateral source payment deductions from the stated minimum payments could, in effect, wipe out even such minimum. Furthermore, the proposed Rule provides that the value of education programs for victims' children and spouses would be deductible, as collateral source payments, the present value of the stream of payments to spouses from Workers' Compensation is deductible based upon the age of the surviving spouse even though such spouse may not receive the entire compensation award if he or she remarries. This coupled with the ability for the Worker's Compensation carriers to seek reimbursement from recipients who have been paid from the fund leads to an utterly inconsistent result. I believe that a fairer and more just and realistic award for pain and suffering across the board with NO deductions would clearly be more consistent with the Act and congressional intent. Perhaps the easiest and most just and equitable procedure would be to calculate the awards utilizing for pain and suffering for each victim without any deductions for collateral source payment and a sum for economic losses with deductions for collateral source payments reducing this portion of the award. INCOME The starting income increment under the interim rule ignores the most current years' income, 2001. This is awfully harsh to ignore the income level(on an annualized basis) of the victim in the year in which he/she was murdered. The omission of 2001 annualized income(particularly of younger workers) has the effect of reducing the income projection dramatically, thus penalizing those who had demonstrated clear evidence of significant career advancement. Thus, earnings for 2001 on an annualized basis should be included in any computations. For example, if a person had earnings of $100,000 as of August 31, 2001, his/her earnings on an annualized basis would be $150,000 for 2001, which would then be the earnings figure to use when calculating an award for economic. CONCLUSION When an already unrealistically low value attributed to pain and suffering is considered with the low starting point for the economic loss category of the proposed compensation, and after the calculated award is reduced by the collateral source payments received by many families, the published average award of $1,600,000 becomes a sham. Thus the practical effect of these caps is to drastically reduce the award from what the statute intended. Relatives of the victims who were in the financial services sector or in the public service sector-such as police officers and firefighters-will suffer a particularly adverse effect. This is not only contrary to the legislation but also entirely unfair. The financial services victims were killed precisely because of the jobs they held. They personified American business and commerce. That is why they worked in the World Trade Center and that is why our enemies targeted them. The police and firefighters were killed carrying out the most successful rescue operation in the history of the united States. It is bad enough that these good people were victimized by bin Laden. We cannot allow their relatives to be victimized again. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die...Their families need to be protected just as if they had been alive, financially and in every other way that we can help assist their families...There should be no compromise about that ever..." The Victims Compensation Fund was created as a part of a comprehensive legislative package which bailed out the airline industry and imposed restrictions on the right of the victims' relatives to recover from the airlines in court. The Fund was established to protect the rights of the victims' relatives. The Special Master cannot take it on himself restrict those rights. Additionally, at the time the legislation was enacted, the amount of fatalities was expected to be between 6,000 and 10,000. The final number will be less than 3,5000. This will result in a significant reduction in the expected expenditures and makes the Special Master's false economies even less defensible. Consequently, the interim rules must be amended and redefined to the extent that income caps be removed when computing economic loss and that each victim's case be addressed separately when computing the non-economic loss attributable to pain and suffering. Justice demands no less. The Special Master is urged to revise the Rule accordingly. Very truly yours. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Guidelines that would not allow me, or my son to tell of how each of us has been devastated in this tragedy, furthers the terror that feeds on us each moment of the day. My husband focused on providing for his family, doing a good job, and enjoying life together. I wish that he had been less conscientious so that he might still be with us today. My story is no more unique or heart-rending than that of any other young family whose center has been taken from them. The country's urge, to return to "normal" might seem to promote the quick shunting aside of overwhelming tasks, in an effort to get pass the tragedy. However, for those of us specifically affected by this event, "normal" is forever changed. The length of time needed to set up equitable guidelines is daunting, but it is also necessary. I would ask that the Fund err on the side of forethought to ensure equitable disbursement to each family. Therefore, I would ask that you consider the following points: 1. Economic Loss - Individual reviews, based on a variety of differing guidelines, need to be used to calculate accurately specific and individual loss. 2. Non-Economic Loss - Every effort should be made to devise, fairly and equitably, a method of ascertaining this level of loss, so that it is not delineated only by status codes of class or standing of the decedents and their families. 3. Burden of Proof - The additional stress of the burden of proof of extraordinary circumstances would be removed from the lives of many families if each claim were individually reviewed. 4. Processing of Claims - , has included in their comments, a proposal for an additional track, "C," of processing claims which would remove the burden of "waiving rights" on the submission of claims. I wholeheartedly support their proposal. 5. Hearings/Recordings of Hearing - "Due process of Law" should be ensured for each family, whether or not, the decedents were American citizens. 6. Distribution of Award - Should be specifically handled by the office of the Special Master. The Personal Representative of the decedent should not be required to distribute individual awards to all claimants as this would further add to the burden on the families. 7. Finally, under no circumstance, should the situation arise where a claimant is entitled to receive nothing form the Fund. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. An example has already been set by New York's Republican Governor George Pataki. He has granted compensation benefits on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and emotional bonds of family, needs and deserves this kind of help during their time of loss. A cap would serve to cause people to shy away from the program and only be a source of strife. And more importantly it's not fair. There should be consistency in the application of the rules of the program. And in those instances where extraordinary circumstsnces are demostrated they should also be applied in a consistent manner so that decesions are made on an equitable basis for all families. People should be given the opportunity to know the award they would be getting based on discussions with your staff before they opt into the program. A minimum guaranteed award should be established that is equitable so everyone would know what amount they would be guaranteed if all else fails. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Zwick, Director, Office of Management Progrom RE: September 11 Victim Compensation Fund of 2001, Interim Final Rule Dear Sirs: The primary stated objective of the Interim Final Ruling is ?to provide fair, predictable, and consistent compensation to the victims of September 11 and their families throughout the life of the program?? The Interim Final Ruling fails to meet the ?fair? and ?predictable? components of its objective. The determination of award levels is nowhere near fair. I have been unable to find past examples in our American legal system where limitations on federal compensation awards included life insurance and pensions. The regulations set a ?presumed award for noneconomic losses sustained.? The figure of this amount is set such that it is consistent with existing federal programs for public officials and military who are killed in the line of duty. It is my understanding that these federal programs are not subject to collateral offsets. The Sept. 11 victims federal program is subject to collateral offsets. Thus, the presumed award for noneconomic loss is inconsistent with existing federal programs for public officials and military. Furthermore, it is unacceptable that victims are offered no recourse should the system, under Kenneth Feinberg, treat them unfairly. Why must families make a leap of faith and place all of their trust in Mr. Feinberg? This is a man who recently described himself to attendants at a January 16 New Jersey meeting for family members of victims of September 11 as their ?only game in town? for compensation. Not only is the award level determination unfair, it is also unpredictable. Mr. Feinberg, at the previously mentioned January 16 meeting, assured Sept 11 widows that they will all receive some level of compensation. However, due to collateral offsets, it is theoretically possible for many families to get nothing. When pressed about this, Mr. Feinberg was evasive and refused to elaborate on his assurances. Families cannot reasonably be expected to forfeit their right to participate in litigation if they cannot first determine the amounts set forth in the federal alternative. Moreover, if the presumed award amount is minimal victims are given no alternative but to pursue a course of litigation to be reasonably compensated for their loss. Creating a situation where the victims must litigate is the antithesis of the legislative intent. Recommendations:  Families need to be told exactly what they will receive prior to agreeing to accept the settlement.  If there is indeed a minimum settlement after offsets it must be specified in writing.  Various scenarios should be developed, and put into writing, which illustrate what participants can rely on should they accept the settlement. As my family and I struggled with the loss of my uncle, , we found comfort in the appropriate and compassionate response of the White House, Congress, and other elected officials in the days following the September 11 attacks. The implementation of the Victims Compensation Fund proposed in the Interim Final Rule is starkly at odds with the initial, comforting reaction of our leaders. The deductions of many benefits (life insurance, pensions,?etc) effectively penalizes many families who planned in advance for the tragic loss of a loved one. The end result is families receive compensation that is below their level of economic loss, while airlines are sheltered from civil liability.
