Friday, January 18, 2002 1:45 PM Interim Final Regulations January 17, 2001 Dear President Bush, My Husband, was murdered along with his co-workers on the September 11, 2001 terrorist attacks on the World Trade Center. The interim final regulations written by the Dept. of Justice have not followed the intent of the Congress when they passed and the President signed the "September 11 Victim Compensation Fund of 2001" into law as Title IV of Public Law 107-42 ("Air Transportation Safety and System Stabilization Act"). Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actually suffered by the victims and their families. In fact, many families total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the regulation, some families would receive nothing from the fund under the interim final regulations. DOJs formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range on non-economic damages than could be recovered in any single jurisdiction. DOJs formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent, In a wide variety of air crash and terrorism cases, judges, juries and mediators commonly have provided non-economic damage awards well into the seven-figure range. My children have to go through the rest of their life without the man that was helping to shape them into productive, honest citizens of this country. Hes no longer here to laugh and play with them, swim and vacation with them, be their soccer and softball coach. Is their pain only worth $50,000? The method that DOJ used to calculate economic damages has serious flaws also. Using outdated and inapplicable work life and life-cycle earnings data and data that tracks federal worker incomes and doesnt take into consideration the higher paying private sector career paths followed by the vast majority of the victims is just plain wrong. These employees were of above average intelligence and productivity and the calculations should reflect this. These points have been brought to your attention on several occasions by economists, attorneys and of . These employees are part of the reason why America has enjoyed the prosperity we do and these calculations should reflect this. I implore you to rewrite these regulations in accordance with the original intent of Congress and the President. Please dont victimize us again. My children and I have suffered so much more than you can ever imagine at the hands of terrorists and a government that didnt fully require preventative safety and security measures of our airlines. I am a New Yorker, a gay man, and one of the thousands right there in NYC on 9/11 during the attacks. The horror felt by all New Yorkers as we walked through a city with a decimated skyline, billowing smoke, and the sounds of fighter planes above our heads that day is probably incomporehensible to those of you who only witnessed the media coverage. Many GLBT people were killed that day, leaving behind loved ones, who were every bit members of their families in every way except in legal definitions. The survivors' losses are all the same. Because our country still exists in an unenlightened past concerning glbt issues, many survivors will only have insult and anguish added to their suffering. Friday, March 15, 2002 9:05 AM concerns To Whom It May Concern: I wanted to relay my concerns regarding the attached article and decision that has been made with regards to exclusion of benefits for gay/lesbian partners of those who died in the Sept. 11th tragedy. This is a massive atrocity and sickens, as well as saddens me. The article clearly identifies and hails several people as heros form this tragedy, who also were homosexual. However, because of their sexual orientation, their partners are not given the same benefits as others. It is especially concerning to me that the partners of gay/lesbian victims will not receive benefits stemming from the loss of their loved ones, gut that victims benefits will be given to survivors of Sept. 11th who are illegal aliens. Not that I do not agree that they (illegal aliens) should, however it is greatly concerning to me that they are given priority and rights that citizens of our own country are not. The article talks that they cannot go against state law and provide benefits to those that states would not normally distribute benefits to, however in this instance they will to illegal aliens. Is this not an inconsistency in policy and decision making? Please help me understand if I am mistaken. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Tuesday, January 22, 2002 9:54 AM victim's compensation plan Dear Mr. Feinberg, This letter is to inform you that I am the wife of a man who died in the terrorist attack on our nation on September 11, 2001. When I first heard about the Victim's Compensation Fund, I felt great relief. It seemed to be a reasonable and fair way to help the families avoid litigation and protect the airlines. Mr Feinberg, this fund will virtually exclude me and my children. My husband and I planned for our future and took care to protect ourselves. We bought Life Insurance and paid high premiums for that insurance. My husband was vested and paid into a pension. We will be penalized for careful and responsible fiscal planning by having those amounts off-set any award (strange term) that we might have received. This would not be allowed in a court of law. I realize that this component of the fund was voted in by congress but it is flawed. That is just one small area of the fund that is defective. I refer you to the letter sent to you on 1/14/02 by my Congressman, Marty Meehan, for a full text of the inadequacies of this fund. Perhaps I am not fully understanding the purpose of the fund. My husband suffered a wrongful death, most likely in hand-to-hand combat with terrorists who . , I cannot even imagine the horror of that situation. I do not know when I will be able to step on an aircraft again knowing that to be the place where my good husband was murdered. He will not finish his last 10 years of employment with so there is still a loss of income and his pension was reduced by half of what it would have accrued. Because of these events, I cannot return to my job as a for for quite some time. Because of the way this fund is set up, I will receive basically the same benefits I would have received if my husband had died in a car crash. However, his death was certainly very different than a car crash. Those facts simply address some of the financial aspects of my life and do not even touch on the personal loss of my family. My husband, , was a victim of terrorism. I decided early on that I would stand proud as an American and not allow those heinous deeds to make me a victim also. The terrorists could not do that to me. Please do not allow my own government and the DOJ to succeed where the terrorists failed.
