Monday, January 07, 2002 12:05 PM Protect the rights of Domestic Partners Dear Mr. Zwick, I am writing you out of concern for the "domestic partners" of the victims of the tragic events of September 11th. Will fiancees and other domestic partners be eligible for compensation from this fund? Would it not be reasonable to follow the guidelines of international human rights organizations, such as Amnesty International? What about the eligibility requirements already set up by the New York State World Trade Center Relief Fund? Obviously, a person would have to show documentation to prove him or herself as the "domestic partner" of a victim. The documentation permitted would include documents like insurance policies, bank and credit accounts, leases and mortgages, health insurance policies, that is documents that a casual partner would not in a million years be able to produce. This is not the time to impose a political agenda or ideology on the life-styles that a particular victim had chosen. There were plenty of people living together in long-term common-law marriages that lost their life partner on that day, and it would not be right to by-pass them for the benefit of whoever the closest living relative is. To illustrate one of these cases, I would like to share my own perspective with you: on 9-11 I lost my fiance, and with him the children we were planning to raise and the life we had been planning and building for years, and which we should have been enjoying for another 50 years or so. What should have been the happiest few months of my life, as I was planning our wedding for New Year's Eve (which would have also been my fiances 35th birthday) was in an instant turned into a period of grief and anguish beyond words. The bureaucratic problems I have been running into since my fiance and myself were not married yet, are nightmarish. I should also mention that his parents are deceased and the person considered his next-of-kin is an estranged sister with whom he has not had any contact for years and whom I have never met even though me and my fiance had been living together for the last four years. I do not think it is just or fair in any way to annull the decisions that individual victims had made in regards to their own lives. It is not reasonable to expect that the victims should have had wills made out, since the majority of them were much to young to think about this type of issues. It is fair to push aside the fiancees and domestic partners of these people just because they were not yet married or because they choose to live together un-married or because of their sexual orientation. This fund should be looking to compensate the family of the victim, and I think that the person you wake up with and go to bed with every day for years, the person that you make a promise of marriage to, the person that you share the expenses of your daily life with as well as plan a future with, is more of a family than someone you share some genetic charcteristic with but not much else. I hope that you will take my perspective and thoughts on this into consideration. Even though every situation and set of circumstances is unique, I know for a fact that I am far from the only person in this type of situation. I hope that you will be able to come up with a set of reasonable eligibility requirements for this compensation that will not exclude the "domestic partners" of the victims, but rather strive to accomplish basic fairness which would take into account the individual circumstances of each "victim" remembering that every single one of them was a person with a different cultural, ethnic, religious and ideological back-ground. Tuesday, January 22, 2002 7:45 AM (no subject) To Whom It May Concern First, I wish to request any available information concerning the Victims Compensation Act and the enrollment process. My brother-in-law was killed during the WTC attack, as he was on the 95th floor of the North building. I am attempting to assist his wife in the processing of benefits that she is eligible for. My name and contact information are listed below. Next I would like to address the provisions of the Act. Some criticism has come from familles that believe that the fund is insufficient and lacking. I personally feel that the government is being more then generous in it's efforts to provide compensation to the victims. I have persuaded my sister-in-law to pursue this avenue that is available to her and to disregard the legions of plaintiffs attorneys that have been attempting to derail this process. We have been subjected to numerous attorneys encroaching upon our families grief in an effort to ingratiate their pockets. If any piece of legislation should have been passed, it should have been a law protecting victims from attorney solicitations. As early as the second day after the attack, we had attorneys calling us, attempting to allow them to represent us, and no doubt, initiate a law suit. What I would like to see is the DOJ initiate actions against these attorney's that are steering the victims to institute class action suits against the airlines and Bin Laden. I truly believe that in the end, the victims will not receive additional compensation to this fund, and will be victimized again when they see how much their attorneys will walk away with. I also wish to say that I believe that the rules set up for the disbursement of the fund are both fair and adequate. I believe that other forms of compensation that the families received should be deducted from the total sum of the payment. I also believe that the total sum should be means tested. Since this is taxpayer money, it should not be a "free for all." I believe that people are becoming greedy and should be thankful for what is being provided, instead of looking for more. I also believe that families that receive large sums of money from insurance payouts should be zeroed out, as they have been provided for. I would encourage you not to bend to those who find the fund inadequate, and proceed on your original establishment of the rules. For there to even be such a fund available, is remarkable. If any of these people had simply died by any other means, they would not have any of this money available to them. Such discrimination is un-American. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. To Whom it May Concern: I am a survivor of the tragic attack on the World Trade Towers on September 11th and have just been made aware of the unfair exclusion of same-sex partners of compensation for their losses. This is the saddest and most embarrassing issue that has come out of this tragic event. Especially when you consider the first victim of these attacks was &nbsp (Death Certificate &nbsp ) who was a gay man. Just last week I saw an interview with his mother who appeared on national television to say how proud she was of her son, no matter his sexual orientation. When I was on the World Trade Center Plaza and saw the tragic results of the first attack I thought I had seen the worst sight of my life; people leaping to their deaths to escape the fire. Specifically Section 405(b)(1)(B)(i) of the Act, requires the Special Master to determine the "extent" of both of the economic and non-economic harm suffered by the claimant. The rules of statutory interpretation indicate that in determining the congressional intent, the language of the statute should be construed according to its ordinary meaning. The ordinary meaning of the word "extent," as given by Webster's Collegiate Dictionary, is "the range over which something extends to its fullest length." By its very terms, capping consideration of the economic loss suffered at the 98th percentile of individual income is not considering the full range of the economic loss of those who earned more than this sum. Second by establishing a single uniform amount of compensation for non-economic harm, the Special Master has again violated Section 405(b)(1)(B)(i) by failing to consider the "extent" of non-economic loss. Congress specifically instructed the Special Master in Section 405(b)(1)(B)(ii) to award compensation based on "the harm to the claimant, the facts of the claim and the individual circumstances of the claimant." Presuming a single uniform amount of compensation for non-economic loss does not fulfill Congresses mandate to consider the "individual circumstances of the claimant." Moreover the Special Master's proposed process for considering "extraordinary circumstances," falls short of the Congressional language of "individual circumstances." Nothing in the Act indicates that victims should be required to demonstrate that their individual losses are extraordinary. The Special Master, Mr. Feinberg, has said publicly in this regard that "I cannot make those distinctions, I will not make those distinctions." Yet the law clearly requires him to make such distinctions. If Mr. Feinberg publicly refuses to follow the explicit instructions of the law, then perhaps Mr. Feinberg should find other employment. Finally, the Special Master's determination that the total non-economic harm suffered by a child whose parent was murdered on September 11th is to be valued at $50,000 is nothing more than a sick joke upon these children. There is nothing in the Act that requires the Special Master to play a tight fisted Scrooge to these victims. Quite the contrary, Congress's gift of $15,000,000,000 to airline stockholders contained in the Act, demonstrates the generous mood which animated Congress when passing this law. A generosity that is obviously lost upon Mr. Feinberg who values the lost love and guidance of a parent to be worth a mere pittance. Bah Humbug to you Mr. Feinberg. A Merry Christmas indeed! The September 11th Victim Compensation Fund of 2001 has been hijacked by the Justice Department for its own ends while preparing to give perhaps half of the intended recipients of the fund no money at all. I do not know if one of the hidden objectives is to simply discourage participation in the Fund, especially by those who would be the most costly to the Fund. How else can one explain the enormous number of material objections to the Final Interim Regulations which at every turn pick and choose the lowest possible entitlement and the lowest possible payout. This can't be explained by sheer incompetence alone, for just by chance the plan would have missed some ways of making a reduction or left a reasonable award alone, but no, each and every opportunity has been seized! In order to carry out this fraud the victims of the act have to be neutralized -- hence the Victims and the Heroes 9/11 are being slandered in a disinformation campaign authored by Mr. Feinberg. I bring up a case in point : In an unsigned editorial of the 10th of February, the Chicago Tribune published a PR piece that might as well have come straight from the desk of Kenneth Feinberg. He claims to be appalled by the cry of greed on the part of the uninformed public, while still repeating the deceptive "$1.65 million average award" figure, this time not even adding the fine print "before deductions." The article states that some of us [ the victims] have said that this is not enough, but what I hear is that many say that the $1.65 million figure is meaningless. A significant number of families will get zero ("$0") under the final interim rules. From a show of hands it appears that about half of the families in one meeting which I have attended, expect to receive nothing from the Fund, myself included. Are we wrong to complain? The headline of the piece is "Putting a price on a life" but the reader has to wait for the closing punch line for the answer that "There is no dollar value of a human life" but $250,000 is the best we can come up with. We are told to believe it makes no sense to look at the history of "tort" law where slip and fall injuries routinely run past that figure, major surgical procedures and rehabilitation can exceed this and today the cost of raising and educating one child through college exceeds $300,000. The government's position is like saying the value of a Van Gogh masterpiece is a little less than the cost of the canvas, turpentine and oil paint used to produce it. The article alleges that " that Congress clearly intended the fund as a safety net for those who did not have substantial life insurance or other assets" but I can not find any language in the law or implementing instructions that corroborates this assertion; the law does state, however, that its purpose is "to provide compensation to any individual ... who was physically injured or killed" This is not a welfare program. In fact, if the intent of the law were to narrow the gap between the have and have nots, this peculiar implementation by the Special Master exacerbates the gap by artificially capping all non-economic losses which include the extraordinary pain and suffering of being incinerated alive, to the cost of painting supplies, if you will. We are reminded that "[o]f course, no one is forcing the families to take the money and forfeit the right to sue" but, the Special Master spends 15 minuets of his presentation telling us that the government has stacked the deck by capping the liability of the airlines and giving itself the option of being first to recoup from the airlines insurance any payments made from the Victims' Fund. Under the present final interim rules, the government payout is estimated to be as low as $2 billion after deductions and that the entire sum could be recovered from the airlines insurance. So much for the Special Master's "generosity argument." Perhaps most disappointing is the way the Special Master promotes his pillaging of the victims in these airy PR pieces distorting the truth. He considers his job as "10 percent lawyer, 40 percent rabbi, 50 percent shrink." As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status.
